RECESS PUBLIC MEETING TO COMMENCE THE CLOSED ATTORNEY-CLIENT EXECUTIVE SESSION: The Village Council will hold a closed attorney/client executive session under the authority of Section 286.011(8), Florida Statutes. The closed attorney-client executive session has been requested by Village Attorney Keith W. Davis to obtain advice regarding settlement negotiations and/or strategy related to litigation expenditures concerning the case of GMH Holdings, LLC, d/b/a Futures of Palm Beach v. Village of Tequesta, Case No. 18-CV-81164-DMM, currently pending and active in the United States District Court, Southern District of Florida. The closed attorney-client executive session will be closed to the public. The estimated length of the closed attorney-client executive session is not to exceed thirty (30) minutes, and will be recorded by a certified court reporter. In attendance will be: - Mayor Abby Brennan -Vice Mayor Tom Paterno - Council Member Vince Arena - Council Member Laurie Brandon - Council Member Kristi Johnson -Village Attorney Keith W. Davis, Esq. -Village Litigation Attorney Chris Stearns, Esq. -Acting Village Manager Jim Weinand Village of Tequesta Page 1 Village Council-Special Council Meeting Agenda January 10,2019 Meeting The closed attorney-client executive session will be held in the Village Manager's Conference Room in the administrative offices of Village Hall. The court reporter's recording documentation including the final transcript of the closed attorney-client executive session shall be confidential and exempt from public records disclosure under Florida law until such time as the litigation referenced above is concluded. RECONVENE THE PUBLIC MEETING IN THE VILLAGE COUNCIL CHAMBERS UPON CONCLUSION OF THE CLOSED ATTORNEY-CLIENT EXECUTIVE SESSION: The Mayor shall publicly announce the conclusion of the closed attorney-client executive session. The Village Council may publicly take action based upon the discussions from the attorney-client executive session. Sponsors: Mayor Brennan ADJOURNMENT PLEASE TAKE NOTICE AND BE ADVISED: If any person decides to appeal any decision made by this Council with respect to any matter considered at this meeting or hearing he/she will need a record of the proceedings, and that, for such purpose, he/she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. COMMUNICATIONS FROM CITIZENS: Public comments / communications from citizens are limited to 3 (three) minutes. Anyone wishing to address Council should complete a "Comments by the Public" card and present it to the Village Clerk prior to the Communications from Citizens. When you are called to speak, please go to the podium and state your name and address for the record prior to addressing Council. Council will not discuss this item this evening; however, Council may choose to have the item placed on a future agenda for discussion. Reference Resolution 25-18 regarding public participation. OTHER AGENDA ITEMS: Any citizen is entitled to be heard on any official agenda item when the Village Council calls for public comments subject to the three-minute limitation. Village Council Meetings are public business meetings, and as such, the Village Council retains the right to limit discussion on any issue.
