CRIM INT PROC 13.7 TEQUESTA POLICE DEPARTMENT GENERAL ORDER TITLE: CRIMINAL INTELLIGENCE PROCEDURES GENERAL ORDER: 13.7 EFFECTIVE: February 1, 1999 RESCINDS: NEW PAGES: 4 CONTENTS: This order consists of the following numbered sections: I. GLOSSARY PURPOSE: To establish procedures for the collection, submission, security, and dissemination of criminal intelligence information. SCOPE: This order applies to all department members. POLICY: Criminal intelligence information will be collected, evaluated, maintained, and disseminated in conformance to law and this order. PROCEDURE: I. INFORMATION SUBMISSION: A. Criminal intelligence information may be submitted to the detective division in various ways including Offense Incident Reports, Field Interview Reports, memoranda, and telephone calls. Information that may be submitted to the division includes the following: 1. Organized crime, racketeering; 2. Motorcycle gangs, youth gangs, or traveling criminals; 3. Terrorist activity; 4. All criminal extremist groups; 6. The illegal manufacture, possession, and sale of narcotics; 7. The corruption of public officials; G.O. 13.7  8. Any other criminal activity. B. Intelligence information believed to be highly sensitive should be delivered to the detective division in person. Use of a land line telephone is also acceptable. C. All criminal intelligence information supplied to the detective division will be subject to collation and analysis to determine its quality and accuracy, the identification of the subject’s involved, and criminal activity. This process will occur only in the secure environment of the detective’s office. D. Information involving officer safety will have the highest priority. The detective division will research and distribute information to all affected law enforcement components and outside agencies. E. The detective division supervisor or designee will review all reports to ensure the information collected is limited to criminal conduct, and relates to activities that present a threat to the community. F. All unit members are responsible for ensuring the legality of the intelligence effort by avoiding indiscriminate collection or distribution of information, and by purging outdated information as prescribed by Florida State Statutes. II. FILE SECURITY: A. Access to agency intelligence files will be limited to members of the detective division unless approved by the division supervisor. B. Individuals outside the detective division must request and obtain prior approval from the division supervisor to review any intelligence file or information. Upon approval, the file may be reviewed in the presence of a detective or supervisor. C. Intelligence files will not be removed from the intelligence office without the approval of the detective. D. The detective division maintains intelligence information in a self-contained computer system, which has no outside access. The system is protected against unauthorized attempts to access, modify, remove, or destroy stored information. Each authorized user is assigned a password. E. Secured, restricted, and controlled access will be maintained on the files of all informants to ensure their anonymity. For established procedures, see the general order indexed as criminal investigations. III. INFORMATION DISSEMINATION: A. Authorized representatives of law enforcement investigative agencies may request criminal intelligence - information contained within the detective division by verbal or written request. Under no circumstances will any information contained in intelligence files be disseminated without the approval of the detective. B. Depending upon the sensitivity of the information, approval by the division supervisor may be required before releasing specific information. C. Individuals requesting information must either be personally known or have their identity verified before any information is provided. D. Photocopies of intelligence file material will be furnished only in situations determined to be extraordinary by the division supervisor. The detective division will furnish a summary of the information requested, if approved by the unit supervisor. A copy of this summary will be placed in the appropriate intelligence file. E. Files containing uncorroborated or unfounded information are subject to being purged. Information contained in 2 G.O. 13.7  such files may not be released in written form. F. Criminal intelligence information disseminated by the detective division is confidential and will be marked as such. The recipient of the information will treat the contents as confidential and will not release the information to anyone outside their respective unit or division without the permission of the detective division supervisor. G. Under certain circumstances, criminal intelligence information maintained by the detective division, or originating from the unit and provided to a requestor, is exempt from disclosure under the Florida public records law. Therefore, intelligence information should not be released to any non-law enforcement agency or individual without the prior consent of the detective division supervisor. H. Requests or demands for information contained in agency intelligence files from individuals not authorized to receive such information, or not having a legitimate need to know, will be documented and brought to the immediate attention of the division commander. IV. ASSISTANCE TO OTHER DIVISIONS: A. The detective division will assist operational units by the continuous collection, analysis, and dissemination of information on individuals suspected of, or associated with, criminal activity. Information developed by the detective division that pertains to an active criminal investigation will be supplied to the appropriate division. B. All requests for the utilization of the detective division’s intelligence will be directed in writing or verbally to the detective division supervisor. Each request will state the specific reason for the utilization. The detective division supervisor will evaluate the request; select the appropriate members, equipment (audio/visual surveillance equipment, unmarked police units, etc.), and techniques (undercover, decoy, surveillance, etc.) for the operation. V. RECORDS MAINTENANCE: A. All non-computerized intelligence records will be secured in a locked filing system in the detective division office. B. Under no circumstances will intelligence reports be forwarded to the administration division. C. All intelligence records will be maintained until obsolete or superseded, or their administrative value is exhausted, in accordance with General Records Schedule GS2. D. Intelligence files and reports will be purged or destroyed only in accordance with agency policy and Florida statutes, and only with the consent of the State of Florida Division of Archives. A “Records Disposition Document” will be completed and forwarded to the RMLO (Village Clerk) for approval. Once approved, the documents will be forwarded to the RMLO for final destruction. No report or file will be purged until careful consideration is given to the current value of the file. VI. GLOSSARY: ACTIVE CRIMINAL INTELLIGENCE - Information concerning “an identifiable person or group of persons collected by a criminal justice agency in an effort to anticipate, prevent, or monitor possible criminal activity.” Such information is considered “active” as long “as it is related to intelligence gathering conducted with a reasonable, good faith belief that it will lead to detection of ongoing or reasonably anticipated criminal activities.” INTELLIGENCE FILE - A created number file that contains information about suspected ongoing criminal activity by an individual or individuals identified in the file.
