FUEL THEFT 12.9 TEQUESTA POLICE DEPARTMENT GENERAL ORDER TITLE: RETAIL FUEL THEFT GENERAL ORDER: 12.9 EFFECTIVE: May 1, 2000 RESCINDS: NEW ACCREDITATION STANDARDS: CFA NONE PAGES: 2 CONTENTS: This order consists of the following numbered sections: I. INVESTIGATION II. GLOSSARY PURPOSE: To establish guidelines for the investigation of retail fuel theft. SCOPE: This order applies to all Police Department members. POLICY: Retail fuel thefts will be actively investigated according to law and this order. PROCEDURE: I. INVESTIGATION: A.Communications Division Responsibilities: The communications operator will obtain the following i- nformation when a retail fuel theft complaint is received: 1. Vehicle Description; a. Make, model, style, year, color, and tag number. b. Direction of travel and number of occupants. 2. Suspect Description; a. Race, sex, age, weight, height, eyes, and hair color. b. Clothing description. 3. Identification of the suspect(s) by the clerk or any witnesses. B.Officer Responsibilities: An officer will be dispatched to the scene if sufficient information exists to help in the G.O. 12.9  immediate investigation of the crime. The officer will: 1. (A shortage in receipts or in a Document the theft when the investigation confirms that a crime actually occurred. cash register does not constitute this type of theft.) 2. Have the complainant complete an Affidavit of Theft. 3. Complete the investigation by attempting to locate and question the suspect(s). 4. Refer charges to the State Attorney’s Office, when appropriate. II. GLOSSARY: AFFIDAVIT OF THEFT - A document upon which the complainant swears to the fact that a theft occurred, and that the information reported is true, under penalty of law. THEFT - F.S. 812.014 states that a person commits theft if he knowingly obtains or uses, or endeavors to obtain or to use, the property of another with intent to, either temporarily or permanently deprive the other person of a right to the property or a benefit therefrom, or appropriates the property to his own use or to the use of any person not entitled thereto.
