PBSO JURIS ARR 11.3 TEQUESTA POLICE DEPARTMENT GENERAL ORDER TITLE: PBSO JURISDICTION ARRESTS GENERAL ORDER: 11.3 EFFECTIVE: January 1, 2009 RESCINDS: New PAGES: 2 CONTENTS: This order consists of the following numbered sections: I. ARRESTS PURPOSE: The purpose of this General Order is to establish guidelines for making arrests in jurisdictions where Palm Beach County Sheriff’s Office has primary law enforcement responsibilities for crimes committed in the Village of Tequesta Police Department jurisdiction. These guidelines are more restrictive than the language that is in the Palm Beach County Law Enforcement Agencies Combined Operational Assistance and Voluntary Cooperation Mutual Aid Agreement. SCOPE: This order applies to all members and applicants of the Police Department. DISCUSSION: This General Order only applies to investigations of a criminal offense regarding a Forcible Felony, as defined in Section 776.08, Florida Statutes, or any Act of Domestic Violence as defined in section 741.28, Florida Statutes, that has occurred within this Agency’s jurisdiction, and the arresting officer has probable cause to arrest a subject, who is located in any jurisdiction where Palm Beach County Sheriff’s Office has primary law enforcement responsibilities. The following procedures define and limit your scope of authority in said Palm Beach County Sheriff’s Office jurisdiction, under the above circumstances. POLICY: Arrests will be made in conformance to law and this order to ensure officer safety and to protect the rights of arrestees. PROCEDURE: I. ARRESTS A. When a Tequesta Police Officer has established probable cause to arrest an individual(s) as a result of an investigation regarding any Forcible Felony, as defined in Section 776.08, Florida Statutes, or any Act of Domestic Violence as defined in Section 741.28, Florida Statutes, that occurred within the jurisdiction of the arresting officer, he/she is authorized to make this arrest in any jurisdiction where the Palm Beach County Sheriff’s Office has primary law enforcement responsibilities under the following conditions: 1. Exigent circumstances exist, and said offense occurred within the previous twenty-four (24) hours; G.O. 11.3 2. Prior to any officer making an arrest which falls under this General Order, the officer shall notify the Palm Beach County Sheriff’s Officer Commanding Officer in charge of the district in which the action will be taken; 3.
