WCOMP 5.4A G.O. 5.4A  TEQUESTA POLICE DEPARTMENT GENERAL ORDER ________________________________________________________________________________ TITLE: WORKERS' COMPENSATION GENERAL ORDER: 5.4A EFFECTIVE: January 1, 2004 REVISES: G.O. 5.4 PAGES: 2 _______________________________________________________________________________________________ CONTENTS: This order consists of the following numbered sections: I. REPORTING PROCEDURES II. REQUIRED REPORTS AND DOCUMENTS III. COMPENSATION BENEFITS PURPOSE: To establish guidelines for the processing of claims by members who have sustained an injury while on duty. SCOPE: This order applies to all Police Department members. POLICY: Members of the agency who are injured on duty (or off duty while performing or engaging in an activity that requires police action) are entitled to workers’ compensation benefits. The documents in this general order must be completed and submitted on the date of injury. PROCEDURE: I. REPORTING PROCEDURES: All on-the-job injuries will be reported and investigated. A.any The injured member will notify their immediate supervisor as soon as possible after on-the-job injury. B. The supervisor will notify the administration of the injury whether or not medical treatment is necessary. II. REQUIRED REPORTS AND DOCUMENTS: Within 24 hours of an injury or death, the following reports and documents must be submitted. A. A Supervisor’s Report of Accident/Injury will be completed by the immediate supervisor of the injured member and forwarded directly to the Chief. B. The Workers’ Compensation Notice of Injury form must be completed if the injury required medical treatment. The immediate supervisor will give the form to the injured member to be filled out. The injured member will return the completed form to the Chief within 24 hours. If the member is incapacitated, the immediate supervisor will ensure that the report is prepared completely and signed by the physician rendering medical treatment. C. An Offense Incident Report or memorandum documenting the circumstances of the on duty injury is required. An Offense Incident Report of a battery on a law enforcement officer, traffic crash, or similar incident will satisfy this requirement. A 1 G.O. 5.4A  memorandum will suffice for those incidents such as falls, back injuries, or cuts that normally do not require an Offense Incident Report. III. COMPENSATION BENEFITS: A. The payment of workers’ compensation to a member covered by the Workers’ Compensation Law. (F.S. 440) B. The agency will pay full wages to the member for the hours scheduled on the day the injury occurred. C. If an authorized physician determines that an insured member cannot return to work on the next scheduled workday, the injury will be considered a temporary total disability. This designation will remain in force until the member can return to work with or without restrictions. D. The Florida Workers’ Compensation law does not provide compensation during the first seven calendar days after an injury. The agency, however, will pay the member for normally scheduled work hours during this period. E. In cases where the disability is continued for eight calendar days or more, the percentage of benefits is based on the member’s status. 1. Full Pay Status: A member will receive 100% compensation for a worker’s compensation injury if considered a law enforcement officer (as defined in F.S. 943.10 \[1\], \[2\], or \[3\]), and it is determined that the member was maliciously or intentionally injured within the course of employment. 2. Any other injured member will be compensated by the workers’ compensation carrier 66-2/3% of pay received at the time of injury. Never will the rate of pay be adjusted to reflect any changes in status, such as a raise, longevity increase, promotion, or demotion. F. A member receiving workers’ compensation will continue to accrue paid leave and pension benefits.
