In follow-up to our recent communications regarding the fine for your late campaign termination report,
unfortunately, the Village Attorney found no option for me to waive the report due to a personal emergency;
therefore, I contacted the State Election Office to inquire further. Mr. Gary Holland, legal counsel advised
that as the filing officer, I have no discretion under State law to waive the fine; however, he noted you could
appeal the decision to the Florida Elections Commission. Per the Commission website, the appealing party
must provide the Commission with documentation supporting the claim.
The "Termination Report — TR" report was due by 5:00 p.m. on Monday, June 11, 2018 and was filed on
Friday, June 15, 2018. Per F.S. 106.07(8)(b), "The fine is $50 per day for the first 3 days late and, thereafter,
$500 per day for each late day, not to exceed 25 percent of the total receipts or expenditures, whichever is
greater, for the period covered by the late report."
You had zero contributions during the reporting period (3/9/18-6/11/18) and $546.56 in expenditures. The
report was four days late at $50 per day for the first 3 days and $500 per day for day four (total of $650);
however, the fine cannot exceed 25% of your total contributions/expenditures for the period covered. The
amount due is $136.64 made payable from personal funds to the Village of Tequesta - or to file an
appeal, contact the Florida Elections Commission:
