Dear Mike:
The purpose of this letter is to request that a matter be placed on the agenda for the
upcoming Village Council meeting of December 14, 2006. As you and I have discussed, it
would be prudent for the Council to reconsider the various options available to it in relation to
filling the current Council vacancy created by Mr. Dalack's refusal to take the Village's oath of
office. While the Council initially considered that ma>litaining the status quo would be
appropriate during the pendency of the appeal, it did so with the expectation that the Eleventh
Circuit Court of Appeals would expeditiously consider and resolve the appeal. As it happens,
the appeal has been pending for some time now without any indication of a forthcoming
decision.
It has also become apparent that the existence of the vacancy on the Council has created
difficulties in the conduct of Village business as a result of tied votes. Since the Village Charter
contemplates a mechanism fir fillin` ('n„nr;l ya~anriP~ ~~~h;r„h , ~igl:* ?lam ~pplic; ~l~ ,n this
instance, I would like to address this issue with the entire Council at the earliest opportunity.
