HomeMy WebLinkAboutOrdinance_524_05/08/1997CJ ORDINANCE NO. 524 AN ORDINANCE OF THE VILLAGE OF TEQLIESTA, FLORIDAa AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES, BUILDINGS AND BUILDING REGULATIONS, AT ARTICLE HI, SECTION 6-41 AND 6-42, TO PROVH)E FOR THE ADOPTION OF THE 1996 NATIONAL ELECTRIC CODE AND THE 1996 EDITION OF THE UNIFORM COUNTYWIDE AMENDMENTS TO THE NATIONAL ELECTRIC CODE; PROVIDING FOR PREVAILING STANDARDS IN THE EVENT OF CONFLICT; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Village of Tequesta, Florida has adopted uniform building codes together with certain amendments to the codes which are intended to address specific local conditions within Palm Beach County, Florida; and, WHEREAS, new mode] codes have now been published in the several categories relating to building and construction, and the same have been updated and revised, including administrative changes, as recommended by the Palm Beach County Building Cade Advisory Board; and, • WHEREAS, the Villa e Council of the Villa Te of Te uesta has determined that the g b q 1996 edition of the National Electric Code and the Uniform. Countywide Amendments thereto, are consistent with the adopted Comprehensive Development Plan of the Village of Tequesta, Florida as required by Section 163.3194(2), Florida Statutes; and, WHEREAS, the Village Council of the Village of Tequesta, Florida deems it necessary and advisable to amend its building and construction codes by adopting the 1996 National Electric Code and Countywide Amendments as set forth herein, NOVA', THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQLIESTA, FLORIDA, AS FOLLOWS: Section 1. Section 6-41 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the National Electric Code, 1996 Edition as fully as if set forth at length herein as the Electric Code of the Village of Tequesta. Section 2. Section 6-42 of the code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the code the Uniform, Minimum Countywide Amendment to the National Electric Code, 1996 Edition, as fully as set forth at length herein. Section 3. Prevailing standards in the Event of Conflict. It is the intent of this Ordinance to maintain the highest standards for Building and Construction in the Village of Tequesta. Therefore, in the event of a conflict between the standards and requirements of the several codes hereby adopted, the more stringent provisions shall prevail. Section 4. Repeal of Ordinances in Conflict. All other Ordinances of the Village of Tequesta, Florida, or parts thereof which conflict with this or any other part of this Ordinance are • hereby repealed. Section 5, Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance, which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. Section 6. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 7. Effective Date. This Ordinance shall. take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE WAS OFFERED BY Council Member Mackail ,who moved its adoption. CHAPTER 1. General ARTICLE 100 -DEFINITIONS Scope. This article contains only those definitions essential to the proper application of this Code. It is not intended to include commonly defined general terms or commonly defined technical terms from related codes and standards. In general, only those terms used in two or more articles are defined in Article 100. Other definitions are included in the article in which they are used but may be referenced in Article 100. Exception: See Section 501-4(b), Exception. ARTICLE 348 -ELECTRICAL METALLIC TUBING 348-1. Use. The use of listed electrical metallic tubing shall be permitted for both exposed and • concealed work. Electrical metallic tubing shall not be used: (1) where, during installation or afterward, it will be subject to severe physical damage; (2) where protected from corrosion solely by enamel; (3) in cinder concrete or cinder fill where subject to permanent moisture unless protected on all sides by a layer of noncinder concrete at least 2 inches (50.8 mm) thick or unless the tubing is at least 18 inches (457 mm) under the fill; (4) in any hazardous (classified) location except as permitted by Section 502-4, 503-3, and 504-20; or (5) for the support of fixtures or other equipment except conduit bodies no larger than the largest trade size of the tubing. Where practicable, dissimilar metals in contact anywhere in the system shall be avoided to eliminate the possibility of galvanic action. Exception: Alumirrum~ttings and enclosures shall be permitted to be used with steel electrical metallic tubing. Ferrous or nonferrous electrical metallic tubing, elbows, couplings, and fittings shall be permitted to be installed in concrete, except for slab on r~, ade in direct contact with the earth, or in areas subject to severe corrosive influences where protected by corrosion protection and judged suitable for the condition. H: \common\1996nec.6.1 9 REV 6/21/96 ARTICLE 250 -GROUNDING • J. Grounding Conductors 250-91. Material. The material for grounding for conductors shall be as specified in (a), (b), and (c) below. (a) Grounding Electrode Conductor. The grounding electrode conductor shall be of copper. , - .The material selected shall be resistant to any corrosive condition existing at the installation or shall be suitably protected against corrosion. The conductor shall be solid or stranded, insulated, covered, or bare and shall be installed in one continuous length without a splice or joint. Exception No. 1: Splices in busways shall be permitted Exception No. 2: Where a service consists of more than a single enclosure as permitted in Section 230-40, Exception No. 2, it shall be permissible to connect taps to the grounding electrode conductor. Each such tap conductor shall extend to the inside of each such enclosure. The grounding electrode conductor shall be sized in accordance with Section 250-94, but the tap conductors shall be permitted to be sized in accordance with the grounding electrode conductors .specified in Section 250-94 for the largest conductor serving the respective enclosures. The tap conductors shall be connected to the grounding electrode conductor in such a manner that the grounding electrode conductor remains without a splice or joint. • Exception No. 3: It shall be permitted to splice the grounding electrode conductor by means of irreversible compression-type connectors listed for the purpose or the exothermic welding process. (b) Types of Equipment Grounding Conductors. Exception No 3 • When using electrical metallic tubing in an exterior use, for feeders or branch circuits an insulated equipment grounding conductor to carry the continuous bond shall be required.
