AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING ORDINANCE N0. 518 SO AS TO
CLARIFY SAME; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL OF ORDINANCES IN
CONFLICT; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Village Council on July 30, 1996, adopted
Ordinance No. 518, thereby adopting the Employees' Pension Trust
Fund and the Plan Document relating thereto; and
WHEREAS, Section 1 of Ordinance No. 518 provided that the
participation of said Plan and Trust in the Florida Municipal
Pension Trust mound is hereby rescinded in its entirety; and
WHEREAS, it was not the intention of the Village to rescind
the participation of said Plan and Trust in the Florida Municipal
Pension Trust Fund, but only to restate the terms thereof so as to
be in accordance with the newly established "Employees' Pension
Trust Fund";
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
• Section 1. Section 1 of Ordinance No. 518 is hereby
amended to read as follows:
"Ordinance No. 460 of the Village of Tequesta, as
amended, which ordinance provided for the establishment
of a Local Law Retirement Plan and Trust for the
firefighters of the Village of Tequesta, Florida, and
authorized the participation of said plan and trust in
the Florida Municipal Pension Trust Fund is hereby
restated in the manner and form attached hereto and
incorporated herein."
Section 2. All other portions of Ordinance No. 518 shall
remain unchanged.
Section 3. Severability. If any provision of this
Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of
this Ordinance which can be given effect without the invalid
provisions or applications, and to this end, the provisions of this
Ordinance are hereby declared severable.
Section 4. Repeal of Ordinances in Conflict. All other
ordinances of the Village of Tequesta, Florida, or parts thereof
which conflict with this or any part of this Ordinance are hereby
repealed.
Section 5. Codification. This Ordinance shall be codified
and made a part of the official Code of Ordinances of the Village
of Tequesta.
Section 6. Effective Date. This Ordinance shall take
effect immediately upon its passage and approval, as provided by
law.
