AN ORDINANCE OF THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, PALM
BEACH COUNTY, FLORIDA, AMENDING
CHAPTER 18 OF THE CODE OF ORDINANCES
"WATER" AT SECTION 18-2 RATES AND
CHARGES IMPOSED, AMENDING SECTION
18-3 (a) MINIMUM MONTHLY SERVICE
CHARGES AMENDING SECTION 18-3 (i)
RELOCATION OF METERS, FIRE HYDRANTS
AND OTHER CUSTOMER FACILITIES;
AMENDING SECTION 18-6, METERING OF
MULTI-UNIT BUILDINGS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL
OF ORDINANCES IN CONFLICT; PROVIDING
FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, AS FOLLOWS:
SECTION 1. Chapter 18 of the Code of Ordinances of the
• Village of Tequesta relating to "Water" is hereby amended at
Section 18-2 by deleting the language currently appearing in
such section and substituting the following:
Definitions:
a) Village of Tequesta, Florida: For the
purposes of Chapter 18 unless otherwise
specified, "Village of Tequesta" may also
be referred to as "Village" and
"Utility."
b) Backflow Prevention Device: The customer
is responsible for the installation and
testing of all devices pursuant to the
Utility's Backflow and Cross-Connection
Control Manual and Water System
Installation requirements as previously
adopted.
c) Developer: Any property owner, business,
builder or other entity proposing to
develop property and seeking water
services for property within the
Village's service area.

• d) Developer Agreement: A written agreement
setting forth in detail the terms and
conditions under which the Village will
provide water service to Developer's
property, and setting forth the
obligations and requirements of each
party to the agreement.
e) Equivalent Residential Connections~ERC
A factor used to convert a given average
daily flow to an equivalent number of
residential connections. For this
purpose, the average daily flow of one
equivalent residential connection (ERC)
is estimated at 350 gallons of water per
day.
1) Single-Family Residential: Single-family
residential includes detached residences,
duplexes, triplexes, townhouses and one-
story garden apartments.
2) Multi-Family Residential: Multi-family
includes individual residential units in
a multi-family structure(s) of one story
• and above served by one master meter.
3) Irrigation Service: Metered connections
used for the sole purpose of irrigating
lawns and vegetation. Irrigation uses
are converted to ERC's by dividing the
water demand by 350 gallons of water per
day.
4) Non-Residential: All property devoted to
industrial, commercial, educational,
governmental or other non-residential
categories not covered by the above shall
be considered to be non-residential uses.
Capital improvement charges to be paid to
the Village for non-residential uses
shall be calculated by determining the
(ERC) of each use. The Village will use
statistical data published by the
Department of Health or other such
agencies concerned with water consumption
to determine the pertinent ERC
calculations.

Based upon such data, the Village shall
calculate the anticipated water
consumption on a daily basis and divide
such consumption by 350 gallons per day.
The amount from such calculation shall
then be multiplied by the Capital
Improvement Charge then in effect for
single-family residential uses. No non-
residential use shall be less than one
ERC. The Village may, at its discretion,
review consumption for any subsequent
twelve (12) month period and adjust
Capital Improvement Charges to correspond
with that demand. Service may be
terminated after due notice upon failure
of customer to pay the adjusted Capital
Improvement Charge.
SECTION 2. Chapter 18 of the Code of Ordinances of the
Village of Tequesta relating to "Water" is hereby amended
at Section 18-3 and 18-3 (a) by changing the title of
such section to "Rates and Charges - Imposed" and by
• deleting the language currently appearing in section 18-3
(a) and substituting the following:
"(a) Minimum Monthly Service Charge.
(1) Residential and Non-Residential:
5/8" inch meter $ 8.80
3/4" inch meter 8.80
1.0 inch meter 22.00
1.5 inch meter 44.00
2.0 inch meter 70.40
3.0 inch meter 132.00
4.0 inch meter 220.00
6.0 inch meter 440.00
(2) Metering of Multi-Family Buildings
(M.F.) where a single meter is
installed in a water connection
serving a multi-family structure,
the minimum monthly service charge
shall be not less than an amount
equal to the number of dwelling
units multiplied by the minimum
charge for a 5/8 x 3/4 inch meter or
installed meter size, whichever is
• greater.

(3) Metering of Multi-Unit Buildings -
• Non-Residential. In the case of any
non-residential building housing
more than one business or entity,
each business or entity therein
shall be metered individually.
Monthly minimum service charges
shall be based on the established
charge by meter size. Where an
existing single meter is installed
in a water connection serving two
(2) or more businesses or entities,
the minimum monthly service charge
shall also be based on the
established charge by meter size.
Fire protection charges for fire
lines shall be separately included."
SECTION 3. Chapter 18 of the Code of Ordinances of the
Village of Tequesta relating to "Water" is hereby amended at
Section 18-3(i) to read as follows:
"(i) Meter Sizing, Relocation of Meters, Fire Hydrants
and Other Appurtenances. The Water Department
reserves the right to determine the appropriate
meter size for each connection to the water system
• as referenced in American Water Works Association
(A.W.W.A) Manual of Water Supply Practices M-6. If
any customer requests that a meter, fire hydrant or
any other water system appurtenance be changed, or
relocated for their convenience, the customer shall
pay the actual cost of such change or relocation,
including material, labor, equipment, inspections,
fees, overhead and permitting."
SECTION 4. Chapter 18 of the Code of Ordinances of the
Village of Tequesta relating to "Water" is hereby amended to
delete Section 18-6, in its entirety.
SECTION 5. Severability. If any provision of this
Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or
applications of this Ordinance which can be given effect
without the invalid provisions or applications, and to this
end, the provisions of this Ordinance are hereby declared
invalid.

SECTION 6. Repeal of Ordinances in Conflict. All other
Ordinances of the Village of Tequesta, Florida, or parts
thereof which conflict with this or any part of this Ordinance
are hereby repealed.
SECTION 7. Codification. This Ordinance shall be
codified and made a part of the Official Code of Ordinances of
the Village of Tequesta.
SECTION 8. Effective Date. This Ordinance shall take
effect immediately upon its passage and approval, as provided
by law.
THE FOREGOING ORDINANCE was offered by
Councilmember Schauer who moved its
adoption. The Ordinance was seconded by Councilmember
Hansen and upon being put to a vote,
the vote was as follows:
