ORDINANCE NO. 479
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING ZONING
ORDINANCE NO. 355, AS AMENDED, BY AMENDING SECTION IV,
DEFINITIONS, BY ADDING A DEFINITION FOR TOWNHOUSES
AND REVISING THE DEFINITIONS FOR LOT DEPTH AND MULTIPLE-
FAMILY DWELLING; BY AMENDING SECTION VII, SCHEDULE OF
REGULATIONS AND APPLICATION OF REGULATIONS, SUB-SECTION
(C), SCHEDULE OF SITE REQUIREMENTS, BY AMENDING THE R-
lA, R-1 AND R-2 DISTRICT SITE REQUIREMENTS BY ADDING
REQUIREMENTS FOR MINIMUM LANDSCAPED OPEN SPACE AND BY
AMENDING THE R-3 DISTRICT SCHEDULE OF SITE REQUIREMENTS
IN ITS ENTIRETY; BY AMENDING SECTION VII (D), SCHEDULE OF
DISTRICT AND USE REGULATIONS, SUB-SECTION (4), R-3
MULTIPLE-FAMILY DWELLING DISTRICT, PARAGRAPH (b),
PERMITTED USES, BY DELETING SINGLE FAMILY DWELLINGS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE.
• NOW, THEREFORE, Be it ordained by the Village Council of the
Village of Tequesta, Palm Beach County, Florida, as follows:
SECTION 1. Section IV of the Official Zoning Ordinance of
the Village of Tequesta, Ordinance No. 355, as amended, is hereby
amended by adding a new definition and revising existing
definitions as follows:
1. TOWNHOUSE. A single family dwelling constructed in a
series or group of attached units with property lines
separating each unit.
2. DWELLING, MULTIPLE. A building or portion thereof used
for occupancy by three (3) or more families in separate
independent units, providing permanent provisions for
living, sleeping, cooking, eating and sanitation.
Includes condominiums, apartments, group homes and row
houses, but excludes Townhouses.
3. LOT DEPTH. The mean horizontal distance between the
front lot line and the rear lot line of a lot measured
within the lot boundaries. For the R-3 Zoning District
only, the definition for lot depth is as follows:
A minimum lot depth of 200 feet, existing on that
. portion of a lot where the foundation for primary or

accessory structures is to be constructed, is required
before building permits will be issued in the R-3
district. Lot depth is defined as the mean horizontal
distance between the front lot line and the rear lot
line of a lot measured within the lot boundaries. The
term primary or accessory structure shall not include
walls, paved parking or decorative features. The
determination of minimum lot depth shall not include
submerged lands, conservation easement areas, protected
wetlands, or similar environmentally protected areas.
Accessory structures not exceeding 10 feet in height
may be constructed on lots with less than the minimum
lot depth, with approval of the Village Council.
SECTION 2. Section VII of the Official Zoning Ordinance of
the Village of Tequesta, Ordinance No. 355, as amended, is hereby
amended at sub-section (C), schedule of site requirements,
by amending the R-lA, R-1 and R-2 district site requirements by
adding requirements for minimum landscaped open space as follows:

SECTION 3. Section VII of the Official Zoning Ordinance of
the Village of Tequesta, Ordinance No. 355, as amended, is hereby
amended at sub-section (C), schedule of site requirements, by
amending the R-3 district site requirements in its entirety as
set forth in exhibit "A" attached hereto.
See Exhibit "A", Schedule of Site Requirements, attached
hereto.
SECTION 4. Section VII of the Official Zoning Ordinance of
the Village of Tequesta, Ordinance No. 355, as amended, is hereby
amended at sub-section (D), Schedule of District and Use
Regulations, sub-section (4), R-3 multiple-family Dwelling
District by amending paragraph (b), permitted uses to read. as
follows:

(4) R-3 Multiple-Family Dwelling district.
(b) Permitted Uses:
1. Multi-family dwellings.
SECTION 5. Severability. If any provision of this
Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications
of this Ordinance which can be given effect without the invalid
provisions or applications, and to this end, the provisions of
this Ordinance are hereby declared severable.
SECTION 6. Codification. This Ordinance shall be codified
and made a part of the Official Code of Ordinances of the Village
of Tequesta.
SECTION 7. Effective Date. This Ordinance shall take
effect immediately upon its passage and approval, as provided by
law.
THE FOREGOING ORDINANCE was offered by Councilmember
Collings who moved its adoption. The
Ordinance was seconded by Councilmember Schauer
and upon being put to a vote, the vote was as follows:

(3) Not more than two (2) compost bins shall
be permitted for each residence within the
Village and said bins shall be located within
the rear yard so as not to be visible from a
public street and shall be located within the
setbacks applicable to the zoning district in
which they are located.
(4) The composting of trash, debris or waste
generated by products used for human
consumption shall be prohibited.
Sec. 10-73. Penalties.
Violations of the provisions of this article, after
notice by a village official, shall constitute a
misdemeanor. Any person upon conviction of such
misdemeanor shall be fined in accordance with the
penalties prescribed by Florida Statutes relating to the
same.
Sec. 10-74. Administrative Fines.
Consistent with law and this article, the Village
Code Enforcement Board shall have jurisdiction to enforce
the provisions of this article within the corporate
• limits of the Village. The Code Enforcement Board, upon
notification by the Code Enforcement Officer, that an
order of the Code Enforcement Board has not been complied
with by the set time, or upon finding that the same
violation has been repeated by the same violator, may
order the violator to pay a fine in an amount consistent
with the fine allowed by state statute, and by the Code
Enforcement Ordinance of the Village relating to
violations within the jurisdiction of the Code
Enforcement Board."
Section 2. Severability. If any provision of this
Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of
this Ordinance which can be given effect without the invalid
provisions or applications, and to this end, the provisions of this
Ordinance are hereby declared severable.
Section 3. Repeal of Ordinances in Conflict. All other
ordinances of the Village of Tequesta, Florida, or parts thereof
which conflict with this or any part of this Ordinance are hereby
repealed.
Section 4. Codification. This Ordinance shall be codified
and made a part of the official Code of Ordinances of the Village
of Tequesta.
