HomeMy WebLinkAboutOrdinance_458_05/27/1993ORDINANCE NO. 458 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING ORDINANCE NUMBER 355, AS AMENDED, THE COMPREHENSIVE ZONING ORDINANCE OF THE VILLAGE, AT SECTION XII THEREOF RELATING TO SIGN REGULATIONS SO AS TO PERMIT ONE OPEN HOUSE DIRECTIONAL SIGN DURING DAYLIGHT HOURS ON SATURDAY AND/OR SUNDAY ONLY FOR PROPERTIES WITHIN THE R-lA, R-1, R-2 AND R-3 ZONING DISTRICTS OF THE VILLAGE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. Section 1. Ordinance No. 355, as amended, the Comprehensive Zoning Ordinance of the Village of Tequesta, is hereby amended at Section XII, Sign Regulations, Section (J), General Requirements, subitem (2)(a), so as to read as follows: "(J) General Requirements. (2) Signs in zoned residential districts: (a) In residential districts R-lA, R-1, R-2 and R-3, no more than one (1) sign per lot shall be permitted within an exposed area of not more than four (4) square feet, and advertising only the sale, lease or rental of said lot or the improvement thereon. No off-site signs shall be permitted except, however, one (1) open house directional sign of not more than two (2) square feet, located on the same block as an advertised open house is permitted during daylight hours on Saturday and/or Sunday only. Said sign shall be exempt from any Village permitting requirements." Section 2. Ordinance No. 355, as amended, the Comprehensive Zoning Ordinance of the Village of Tequesta, is hereby amended at Section XII, Sign Regulations, Section (L), Exemptions, so as to include a new item (12) to read as follows: "(L) Exemptions. (12) Those signs described in paragraph (J)(2)(a) which permit one sign per lot in the R-lA, R- 1, R-2 and R-3 districts advertising the sale, lease or rental of the lot on which said sign is located and so as to allow one (1) open house directional sign, all pursuant to the regulations set forth therein." Section 3. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. Section 4. Repeal of Ordinances in Conflict. All other ordinances of the Village of Tequesta, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. 1 Section 5. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 6. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember Schauer , who moved its adoption. The Ordinance was seconded by Councilmember Collings and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION tiVilliam E. Burckart Joseph N. Capretta Earl L.
