WHEREAS, Section 125.01 (1) (q) 2, Florida Statutes, provides that `?lal taxin a un is pursuant to the to r da ConstitutionW~andn municlp 5 WHEREAS, pursuant to Section 125.01 (1) (q) 2, Florida statutes, a municipality shall be included in a municipal service taxing unit upon approval by ordinance of the municipality and by a majority of the electors of the municipality, voting at a regular Or special election; and . WHEREAS, the Village Council of the Village of TequQCta desires that all of the area lying within the municipal limits of the Village of Tequesta be included within the county municipal service taxing unit providing fire/rescue services; and WHEREAS, the Village Council of the Village of Tequesta desires that a referendum election be held in order to comply with the provisions of the Florida Statutes and hereby requests the Supervisor of Elections to place the measure on the March 12, 1991 ballot; and WHEREAS, the Village Council of the Village of Tequesta .desires that Palm Beach County be authorize8 to levy the taxes necessary to carry out the said fire/rescue services. NOW, THEREFORE, BE 1T ORDAINED liy the Village Council of the Village of Tequesta, Palm Beach County, Florida, as follows: 5,ection ~. Intent, Purpose and Effect. This Ordinance is created in order to comply with Section 725.01 (1)(q) 2 Florida Statutes. All of the area within the municipal boundaries of the -~ Village of Tequesta as set forth in Exhibit "A" attached hereto shall be included within the county Fire/Rescue Municipal Service Taxing Unit for the purposQ of providing/fire rescue services upon the adoption of this ordinance and the affirmative vote of the electors of the Village of Tequesta, and upon the adoption of an ordinance of the Board of County Commissioners of Palm Beach County, Florida, providing for the inclusion of the territorial limits of the Village of Tequesta within the county Fire/Rescue Municipal Service Taxing Unit for fire/rescue purposes. Section 2• Referendum. A referendum shall bs held at a regular election to be schedule8 on March 12, 199]., held in accordance with the requirements of the Constitution and the laws of the State of Florida and the question on the ballet shall be as follows: "INCLUSION OF THE VILLAGE OF TEQUESTA WITHIN THE COUNTY FIRE/ RESCUE MSTU. Shall Palm Beach County be empowsrQd to include all of the territory within the municipal boundaries of the Village of Tequesta on file at the Village Clerk's Office 1 ~ ' in the c:vuttty Municipal Service Taxing Unit fOr the purpose of providing fire/rescue services to the residents therein upon adoption Of an ordinance by the Board of County Commissioners, and shall the Village of Tequesta be empowered to rep®al such inclusion without referendum? Yes No Section 3~ Severability. If any provision of this ordinance or the application thereof is held invalid, such lnvdl idity Shall not aftect the other provisions ar application, of this Ordinance which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. Section 4. kepeal of Ordinances in Conflict. All other ordinances of the Village of Tequesta, Flor~.da, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Sect- 0~5. Cvditication. This Ordinance shall be codified and made a part of the official Code of Ordinances of the village of Tequesta. Sect~on.~ Effective Date.
