HomeMy WebLinkAboutOrdinance_393_11/9/1989w ti ORDINANCE N0. 393 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 10, "HEALTH AND SANITATION" BY ENACTING A NEW ARTICLE V, "RECYCLING BINS AND CONTAINERS", TO PROVIDE THAT IT SHALL BE UNLAWFUL FOR ANY UNAUTHORIZED PERSON OR AGENT TO REMOVE ARTICLES OR OTHERWISE DISTURB MATERIALS IN THE VILLAGE'S RECYCLING BINS, OR TO REMOVE, DAMAGE, OR DESTROY SAID RECYCLING BINS, OR TO REMOVE ARTICLES OR OTHERWISE DISTURB MATERIALS IN CURBSIDE RECYCLING CONTAINERS, OR TO REMOVE, DAMAGE OR DESTROY CURB RECYCLING CONTAINERS; PROVIDING A GENERAL REPEALER CLAUSE; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Chapter 10, "Health and Sanitation, of the Code of Ordinances of the Village of Tequesta, be and the same is hereby amended by enacting a new Article V, Recycling Bins and Containers, to read as follows: "ARTICLE V. RECYCLING BINS AND CONTAINERS It shall be unlawful for any unauthorized person or agent to remove articles or to otherwise disturb materials in the Village's recycling bins or to remove, damage or destroy said recycling bins. It shall be unlawful for any unauthorized person or agent to remove articles or otherwise disturb materials in curbside recycling containers, or to remove, damage or destroy curbside recycling containers." Section 2. All ordinances or parts of ordinances which are in conflict herewith are hereby repealed. Section 3. Should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity or the remainder hereof as a whole or part thereof other than the part declared to invalid. Section 4. This Ordinance shall be codified and made a part of the Official Code of Ordinances of the Village of Tequesta. Section 5. This ordinance shall take effect immediately upon its approval and passage as provided by law. THE FOREGOING ORDINANCE WAS OFFERED BY Councilmember inn T_ M trail , who moved its adoption.
