ORDINANCE NO. 333
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, PROVIDING FOR
' AN AMENDMENT TO SECTION 11-17, 11-18, 11-19 AND
11-25, OF THE CODE OF ORDINANCES, TO PROVIDE FOR
AMENDMENT OF ADMINISTRATIVE DUTIES IN REGARD TO THE
SALE OF LICENSES; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
CIE TEQUESTA, FLORIDA, AS FOLLOWS:
Section 1. Section 11-17 of the Code of Ordinances of the
Village of Tequesta is hereby amended to read as follows:
! "Before the Village shall issue a license for engaging in
~~ or carrying on any of the businesses, professions, or
occupations specified and set forth in this article, it shall
~ be the duty of the applicant to file an application with the
Village, in the form provided by the Village."
I~ Section 2. Section 11-18 of the Code of Ordinances of the
Village of Tequesta is hereby amended to read as follows:
'i "All licenses shall expire on September 30 of each year.
No license shall be issued for more than one (1) year. For
each license obtained between April 1 and September 30, one-
half (1/2) of the full year's tax for one (1) year shall be
paid except as otherwise provided for. Each license obtained
between January 1 and March 31, three-fourths (3/4) of the
full year's tax for one (1) year shall be paid except as
otherwise provided for. Upon payment of such tax, the Village
shall issue to the person paying it, a license signed by the
individual designated by the Village Manager or, in his/her
absence, the Village Manager, which license shall expire at
the end of the period for which it is issued, as hereinabove
specified. Every license shall be kept posted in a
conspicuous place in the place of business for which it was
procured."
Section 3. Section 11-19 of the Code of Ordinances of the
Village of Tequesta is hereby amended to read as follows:
"Whenever the amount of the license applied for depends
upon the amount of stock-in-trade carried by the applicant or
`. the number of rooms in a hotel or rooming house, or the number
of employees, or on any other facts not within the personal
knowledge of that person designated by the Village Manager for
occupational license oversight, no license shall be issued
until the applicant, therefore, has made and filed with the
Village an affidavit, duly authenticated, setting forth the
amount of his/her stock-in-trade, number of rooms in his/her
hotel or rooming house, or other facts on which the amoun~~ of
such license depends."

Section 4. Section 11-25 of the Code of Ordinances of the
Village of Tequesta is hereby amended to read as follows:
"It shall be unlawful for any person to engage in any
trade, business, profession, or occupation within the Village
'! without a license or upon a license issued upon false
statements made by any person, or in his/her behalf. All
~: licenses shall be sold by the Village beginning September 1 of
each year and shall be due and payable on October 1 of each
year and shall expire on September 30 of the succeeding year.
Licenses not renewed by October 1 shall be considered
delinquent and shall be subject to a delinquency penalty of
ten (10) percent for the month of October plus an additional

five (5) percent penalty for each month of the delinquency
thereafter until paid; provided, however, that the total
delinquency penalty shall not exceed twenty-five (25) percent
of the occupational license fee for the delinquent
establishment. Any person engaging in or managing any
business, occupation, or profession without first obtaining a
local occupational license, if required, hereunder shall be
subject to a penalty of twenty-five (25) percent of the
license determined to be due in addition to any other penalty
~ provided by law or this Code."
If Section 5. If any provision of this Ordinance or the
application thereof is held invalid, such invalidity shall not
affect the other provisions or applications of this Ordinance
j which can be given effect without the invalid provisions or
applications and to this end the provisions of this Ordinance
~1 are hereby declared severable.
Section 6. This Ordinance shall be codified and made a part
of the Official Code of Ordinances of the Village of Tequesta.
Section 7. This Ordinance shall take effect immediately
upon its passage and approval, as provided by law.
THE FOREGOING ORDINANCE was offered by
Councilmember William E. Burckart who moved its
adoption. The Ordinance was seconded by
Councilmember Edward C. Howell and upon being put
to a vote, the vote was as follows:

AGAINST ADOPTION
The Mayor thereupon declared the Ordinance duly passed
and adopted this 23rd day of February 1989.
