HomeMy WebLinkAboutOrdinance_380_12/15/1988 ORDINANCE NO. 380 • • AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING APPENDIX B, SUBDIVISION REGULATIONS, AT ARTICLE V RELATING TO IMPROVEMENTS PRE-REQUISITE TO FINAL APPROVAL BY PROVIDING ~I AN ADDITIONAL SECTION 11 WHEREBY ALL UTILITIES, EXISTING ~!, AND PROPOSED, SHALL BE PLACED UNDERGROUND, THEREBY PRO- VIDING ADDITIONAL REQUIREMENTS FOR FINAL PLAT APPROVAL; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Ordinances Article V follows: Appendix B, Subdivision Regulations of the Code of of the Village of Tequesta is hereby amended at by the addition of a new Section 11 to read as "Section 11. Underground Utility Service. • The subdivider shall provide for all utilities, existing and proposed, to be placed underground which shall serve any individual lot, public right-of-way or common grounds. This provision shall apply to, but not be limited to, waterlines, sanitary sewer lines, storm drainage lines, gas lines, electrical lines, CATV service lines and telephone service lines." Section 2. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. Section 3. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 4. This Ordinance shall take effect immediately '' upon its passage and approval as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember Earl L. Collings who moved its adoption. The Ordinance was seconded by Councilmember Joseph N. Capretta and upon being put to a vote, the vote was as follows: FOR ADOPTION William E. Burckart Edward C. Howell Ron T. Mackail Joseph N.
