However, any such vehicle shall be removed from the residential district within 24 hours by wrecker towing, if necessary, regardless of the nature of the emergency, and the cost of such towing shall be at the expense of the owner of the vehicle. Construction equipment, panel trucks, pickup trucks, vans, or similar types of trucks used for commercial purposes of not over three-quarters ton rated capacity, recreational boating and camping equipment in the form of travel and camping trailers, boat trailers, boats on trailers and truck trailers designed and used as temporary living quarters for recreation, boating, camping or travel uses, parked on a lot containing asingle- family residence in R-1, R-2 and R-3 zoning districts within the village, shall be parked subject to the following conditions: (1) The equipment described in this section must be owned by and used primarily by a resident of the premises; provided, however, that a guest of the resident of the premises may park such equipment in the front yard driveway for not more than three consecutive days in any 14-day period. For the purpose of this subsection, any part of a 24-hour period, measured from midnight to midnight, shall be considered as one day. (2) The location for such parked equipment shall be in the rear yard or in the side yard to the rear of aline established by the front building line adjacent to the side yard where the equipment is located; provided, however, that such equipment is effectively screened on three sides against direct view from abutting properties. A person who reasonably attempts to comply with the screening described in this subsection by planting and maintaining a hedge which will become an effective screen in a reasonable period of time, not to exceed two years, shall not be in violation of this subsection. Further, this subsection is not to be construed as requiring screening from direct view from the street in front of the lot. (3) Any of the vehicles or equipment described in this section may be parked in a garage or carport which is effectively screened on three sides; provided, however, that no portion of the vehicle or equipment shall extend beyond the roofline. (4) Such equipment and the area of parking shall be maintained in a clean, neat and presentable manner, and the equipment shall be in usable condition at all times. (5) Such equipment shall at all times have attached a current vehicle registration license plate and, if required, a current inspection sticker. (6) No major repairs or overhaul work on such equipment which constitutes either a public or private nuisance shall be made or performed on the site. (7) When parked on the site, such equipment shall not be used for living or sleeping quarters or for housekeeping or storage purposes and shall not have attached thereto any service connection lines, except as may periodically be required to maintain the equipment and appliances. (8) None of the vehicles or equipment described in this section may be parked in the area between the street lot line and the structure or in the right-of--way in front of the structure; however, one of the vehicles described in this section may be parked in the front yard driveway for a cumulative period not exceeding four hours in any one 24-hour period. (9) These restrictions shall not apply to the parking of emergency vehicles, provided that the time parked is actually necessary for the emergency. Further, the restrictions shall not apply to volunteer emergency vehicles driven by residents of the village and parked on their property. (10) The provisions and conditions set forth in this section are not intended to regulate the parking of vans or similar types of vehicles only used for personal transportation rather than commercial purposes. (11) In the case of doubt as to the proper classification of a specific vehicle under the terms of this section, the determination by the state motor vehicle commission shall be controlling. The body description and classification on the motor vehicle certificate of title shall be prima facie evidence of such determination. (Code 1977, app. A, § X(L)(2)) Sec. 78-644. R-lA district. ACCUMULATIONS OF WEEDS AND OTHER PLANTS Sec. 30-31. Findings. The village council finds and determines that the continuous growth of the village requires the reasonable and effective control of the growth and accumulation of weeds, undergrowth, and other plant life to prevent adverse affects on the economic welfare of adjacent property and to protect the public health by preventing infestation by rodents and other wild animals and the breeding of mosquitoes and vermin. (Code 1977, § 10-16) Sec. 30-32. Excessive accumulations prohibited; declaration of nuisance. The existence of excessive accumulations or of untended growth of weeds, undergrowth, or other dead or living plant life, as defined in this article, upon any lot, tract or parcel of land, improved or unimproved, within 100 feet of any improved or unimproved property within the village, to the extent and in such manner that the lot, tract or parcel of land becomes or may reasonably become infested with rodents, vermin, or wild animals, or may become a breeding place for such, or in any other way threatens the public health, safety and welfare, or which may reasonably cause disease or adversely affects and impairs the economic welfare of adjacent property, is hereby prohibited and declared to be a public nuisance. (Code 1977, § 10-17) Sec. 30-33. Prohibited conditions. (a) It shall be unlawful for the owner of any lot, parcel or tract of land with or without improvements constructed thereon within the village to permit grass, weeds, or undergrowth to grow thereon to a height of 12 inches or more from the ground. (b) It shall be unlawful for the owner of any lot, parcel or tract of land whether with or without improvements constructed thereon within the village to permit rubbish, trash, debris, dead trees or other unsanitary or unsightly conditions to remain on the premises. (c) It shall be unlawful for the owner of any lot, parcel or tract of land with improvements constructed thereon within the village to permit the existence of depressions or excavations or any other condition on such premises thereon in which water may accumulate in such a manner or fashion to make possible the propagation of mosquitoes therein. (d) It shall be unlawful for the owner of any lot, parcel or tract of land whether there are improvements and construction thereon or not to permit rubbish, trash, debris, dead trees or other unsanitary or unsightly conditions to remain on the premises. (e) If properties are protected under chapter 50, article II, pertaining to environmentally sensitive lands, they shall be exempted from those provisions of this section which require the removal of weeds, grass and undergrowth where it is determined by the village that to remove such weeds, grass and undergrowth will be in violation of chapter 50, article II. (Code 1977, § 10-18) Sec. 30-34. Notice to abate violation; right of village to do work and assess costs. (a) Upon the failure of an owner or tenant to comply with the provisions of this article, the village shall give one written notice by certified mail, return receipt requested, to the record owner of such property at the address indicated in the records of the county property appraiser's office, that a violation exists which is in violation of this article. If return receipt of the notice is not received by the village within ten days of mailing, then notice shall be published in a newspaper of general circulation in the community. (b) The notice shall: (1) Advise the owner of the existence and nature of the violation. (2) Specify what corrective action must be taken. (3) Require the owner to remedy or abate the violation within ten days from the date of receipt of a notice mailed by certified mail, return receipt requested, or, if notice is provided by publication, such notice shall require the property owner to remedy or abate the violation within ten days of such notice. (4) State that failure to take the prescribed corrective action within the specified time will result in the village abating the violation without further notice to the owner by entering the premises and taking such steps reasonably necessary to effect abatement, the cost of which action, plus administrative charges, shall constitute a lien against the property. (5) Advise the owner of a right to request a hearing as provided in this Code. (6) Advise the owner that upon reoccurrence of the violation the village may without further notice to the owner enter the premises and take such steps reasonably necessary to effect abatement, the cost of which, plus administrative charges, will be a lien against the property. (7) Advise the owner that upon reoccurrence the violation may be referred to the special master and fines may be levied. Page 1 of 2 CONCLUSIONS OF LAW Respondent, JOHN MCCAFFREY, is in repeat violation of Section 30-33of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Code Enforcement Special Magistrate that Respondent, JOHN MCCAFFREY, shall immediately bring the property into compliance with Section 30-33 and request a reinspection of the property. A fine of Twenty-Five-dollars ($25.00) per day is hereby assessed for the repeat violation that has existed. The fine is imposed beginning on October 13, 2008, for the violation that exists. The Respondent shall be assessed Two-Hundred-Sixty-Three-dollars and Ninety-Two Cents ($263.92) for administrative costs to be paid within ten days of the date of this order. QRDER It is the Order of the Code Enforcement Special Magistrate that Respondent, JOHN MCCAFFREY, shall comply with Section Chap. 78-643 Art. IX and Chap. 30, Art I, Sec 30-33, of the Code of Oxdinaatces of the Village of Tequesta on ar befare the 4th day of February, 2007. If Respondent does not comply within the time specified, Respondent shall be assessed a fine of up to two-hundred-fifty-dollars ($250.00} per day until the property is in full compliance. It further the Order of the Cade Enforcement Special Magistrate that Respondent, JOHN MCCAFFREY, shall continue to comply with Section 30W33 the Cade of Ordinances of the Village of Tequesta regarding the Swale. Future violations of the aforementioned code sections maybe considered a repeat violation far which a fine of up to five-hundred-dollars ($500.00) per day maybe imposed beginning an the date the violation begins. A Fine Assessment Hearing will be held befare the Special Magistrate an the 22"d day of February, 2007, at 10;00 a.m., at the Village of Tequesta, Cade Compliance Division, 345 Tequesta Drive, Tequesta, Florida.
