Further, this subsection is not to be construed as requiring screening from direct view from the street in front of the lot. (3) Any of the vehicles or equipment described in this section may be parked in a gazage or carport which is effectively screened on three sides; provided, however, that no portion of the vehicle or equipment shall extend beyond the roofline. (4) Such equipment and the area of parking shall be maintained in a clean, neat and presentable manner, and the equipment shall be in usable condition at all times. (5) Such equipment shall at all times have attached a current vehicle registration license plate and, if required, a current inspection sticker. (6) No major repairs or overhaul work on such equipment which constitutes either a public or private nuisance shall be made or performed on the site. (7) When parked on the site, such equipment shall not be used for living or sleeping quarters or for housekeeping or storage purposes and shall not have attached thereto any service connection lines, except as may periodically be required to maintain the equipment and appliances. (8) None of the vehicles or equipment described in this section may be pazked in the azea between the street lot line and the structure or in the right-of--way in front of the structure; however, one of the vehicles described in this section may be parked in the front yazd driveway for a cumulative period not exceeding four hours in any one 24-hour period. (9) These restrictions shall not apply to the parking of emergency vehicles, provided that the time parked is actually necessary for the emergency. Further, the restrictions shall not apply to volunteer emergency vehicles driven by residents of the village and parked on their property. (10) The provisions and conditions set forth in this section aze not intended to regulate the parking of vans or similaz types of vehicles only used for personal transportation rather than commercial purposes. (11) In the case of doubt as to the proper classification of a specific vehicle under the terms of this section, the determination by the state motor vehicle commission shall be controlling. The body description and classification on the motor vehicle certificate of title shall be prima facie evidence of such determination. (Code 1977, app. A, § X(L)(2)) Sec. 78-644. R-lA district. In the R-lA zoning district of the village, the parking of trucks, tractors, trailers, buses, mobile homes, campers, motor homes, boats, recreational boating and camping equipment in the form of travel and camping trailers, boat trailers, boats on trailers and truck trailers is prohibited on any lot or right-of--way unless adequately screened or fenced on at least three sides so as not to be visible from any roadway, waterway, or golf course. For purposes of this section, the term "trucks" shall mean trucks of not over three-quarters ton rated capacity, either commercial or noncommercial, and shall include panel trucks, pickup trucks and other trucks, but shall not include passenger vans or panel vans with side passenger windows and rear passenger seats, or four-wheel drive vehicles, such as Ford Explorer, Bronco and similaz vehicles. In all other respects the vehicle classifications of the state motor vehicle commission shall control. Any vehicle with commercial lettering on its side is deemed to be a commercial vehicle unless the lettering is on a removable sign which is removed when the vehicle is pazked. The pazking of trucks of more than three-quarters ton rated capacity is prohibited within this zoning district pursuant to the provisions of section 78-642. In addition the following conditions shall apply: (1) The equipment described in this section must be owned by and used primarily by a resident of the premises; provided, however, that a guest of the resident of the premises may pazk a motor or mobile home in the front yard driveway for not more than 24 hours in any 30-day period while the owner or driver thereof visits the home of the lot owner. (2) The exceptions set forth in section 78-642 shall be applicable to the vehicles described in this section. (3) The location for such parked equipment shall be in the rear yard or in the side yazd to the rear of aline established by the front building line adjacent to the side yard where the equipment is located; provided, however, that such equipment is effectively screened in the manner described in this section. A person who reasonably attempts to comply with the screening described in this section by planting and maintaining a hedge which will become an effective screen in a reasonable period of time, not to exceed two yeazs, shall not be in violation of this section. (4) Any of the vehicles or equipment described in this section may be parked in a garage or carport which is effectively screened on three sides; provided, however, that no portion of the vehicle or equipment shall extend beyond the roofline and that the equipment is screened in a manner described in this section. (3) Any of the vehicles or equipment described in this section may be parked in a garage or carport which is effectively screened on three sides; provided, however, that no portion of the vehicle or equipment shall extend beyond the roofline. (4) Such equipment and the area of parking shall be maintained in a clean, neat and presentable manner, and the equipment shall be in usable condition at all times. (5) Such equipment shall at all times have attached a current vehicle registration license plate and, if required, a current inspection sticker. (6) No major repairs or overhaul work on such equipment which constitutes either a public or private nuisance shall be made or performed on the site. (7) When pazked on the site, such equipment shall not be used for living or sleeping quarters or for housekeeping or storage purposes and shall not have attached thereto any service connection lines, except as may periodically be required to maintain the equipment and appliances. (8) None of the vehicles or equipment described in this section may be parked in the area between the street lot line and the structure or in the right-of--way in front of the structure; however, one of the vehicles described in this section may be parked in the front yard driveway for a cumulative period not exceeding four hours in any one 24-hour period. (9) These restrictions shall not apply to the parking of emergency vehicles, provided that the time pazked is actually necessary for the emergency. Further, the restrictions shall not apply to volunteer emergency vehicles driven by residents of the village and parked on their property. (10) The provisions and conditions set forth in this section are not intended to regulate the parking of vans or similaz types of vehicles only used for personal transportation rather than commercial purposes. (11) In the case of doubt as to the proper classification of a specific vehicle under the terms of this section, the determination by the state motor vehicle commission shall be controlling. The body description and classification on the motor vehicle certificate of title shall be prima facie evidence of such determination. (Code 1977, app. A, § X(L)(2)) Sec. 78-644. R-lA district. In the R-1 A zoning district of the village, the parking of trucks, tractors, trailers, buses, mobile homes, campers, motor homes, boats, recreational boating and camping equipment in the form of travel and camping trailers, boat trailers, boats on trailers and truck trailers is prohibited on any lot or right-of--way unless adequately screened or fenced on at least three sides so as not to be visible from any roadway, waterway, or golf course. For purposes of this section, the term "trucks" shall mean trucks of not over three-quarters ton rated capacity, either commercial or noncommercial, and shall include panel trucks, pickup trucks and other trucks, but shall not include passenger vans or panel vans with side passenger windows and rear passenger seats, or four-wheel drive vehicles, such as Ford Explorer, Bronco and similar vehicles. In all other respects the vehicle classifications of the state motor vehicle commission shall control. Any vehicle with commercial lettering on its side is deemed to be a commercial vehicle unless the lettering is on a removable sign which is removed when the vehicle is parked. The pazking of trucks of more than three-quarters ton rated capacity is prohibited within this zoning district pursuant to the provisions of section 78-642. In addition the following conditions shall apply: (1) The equipment described in this section must be owned by and used primarily by a resident of the premises; provided, however, that a guest of the resident of the premises may pazk a motor or mobile home in the front yard driveway for not more than 24 hours in any 30-day period while the owner or driver thereof visits the home of the lot owner. (2) The exceptions set forth in section 78-642 shall be applicable to the vehicles described in this section. (3) The location for such parked equipment shall be in the rear yazd or in the side yard to the rear of aline established by the front building line adjacent to the side yard where the equipment is located; provided, however, that such equipment is effectively screened in the manner described in this section. A person who reasonably attempts to comply with the screening described in this section by planting and maintaining a hedge which will become an effective screen in a reasonable period of time, not to exceed two years, shall not be in violation of this section. (4) Any of the vehicles or equipment described in this section may be parked in a gazage or carport which is effectively screened on three sides; provided, however, that no portion of the vehicle or equipment shall extend beyond the roofline and that the equipment is screened in a manner described in this section. The Respondent, MARK PETERSON, was present at the hearing and there a finding of proper notice. 2. Tequesta Code Enforcement Officer Petrick testified to and offered photos of the repeat violation of Section 78-642. He testified that the repeat violation of Section 78-642 was first cited on September 19, 2008 and was brought into compliance on October 13, 2008. 3. The entire code enforcement file was entered into the record. 4. The Respondent, MARK PETERSON, testified that he lost some of the magnets for the van and that he requested that his work order him more. While waiting for his employer's response, he purchased the magnets himself and brought the van into compliance with Section 78-642. Page 1 of 2 CONCLUSIONS OF LAW Respondent, MARK PETERSON, is in repeat violation of Section 78-642 of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Code Enforcement Special Magistrate that a fine of Twenty-Five- dollars ($25.00) per day is hereby assessed for the repeat violation that has existed. The fine is imposed beginning on September 19, 2008 and ending on October 13, 2008, for the violation that existed. The Respondent shall be assessed Two-Hundred-Twenty-One-dollars and Ninety-Two Cents ($221.92) for administrative costs to be paid within ten days of the date of this order. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount.
