Apparently, Finance was having staffing issues on this day and had to close the counter for a lunch hour. A note was placed on Finance's counter explaining this. Therefore, Mr. Jones was unable to make his payment at Finance. However, he left with the records without payment rather than telling me they were closed. Address: 250 BEACH ROAD #402 Tequesta, Florida 33469 Legal Description: REGENCY CONDOMINIUM APTS UNIT 402 P CN: 60-43 -40-31-12-000-4020 The Special Magistrate appointed by the City Council to hear code enforcement cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Enforcement Hearing held on the 23~d day of October, 2008, and based on the evidence and testimony presented finds that a reduction in fine is warranted. The following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are hereby entered: FINDINGS OF FACT 1. The Respondent's son, EDWARD JONES, was present at the hearing and has requested a reduction in fine. 2. Mr. Jones testified that his mother owns the condominium; she suffers from dementia; and he has a Power of Attorney over her affairs. 3. Mr. Jones letter requesting the abatement of the fine was entered into the record along with the entire code enforcement file. 4. Mr. Jones explained that the delay in complying the violations was due, in part, to his and his brother's absence from the state (both live out of state), his mother's illness, and confusion as to what actions were needed to bring the violation into compliance. He testified that he Page 1 of 3 made several calls to the Village to speak with staff regarding compliance; and both he and his brother Stewart Jones, travelled to Tequesta for extended periods in order to bring the property into compliance. 5. Code Enforcement Officer Petrick testified that there are no previous violations at this property; the violation was serious as it could have involved the safety of persons in the condominium unit and other units; and during the course of obtaining compliance, the Village's efforts to inspect the property on at least 5 occasions were frustrated by the lack of a local family member being present and/or a lack of the permission of the family to conduct the inspections. 6. The Village did not agree to a reduction in fine. CONCLUSIONS OF LAW The Respondent is no longer in violation of the above listed code sections of the Code of Ordinances of the Village of Tequesta and no other violations were brought to the undersigned's attention. ORDER It is the Order of the Code Enforcement Special Magistrate that the Respondent's fine shall be reduced from Seven Thousand Eight Hundred Dollars ($7,800.00) to Three Thousand Nine Hundred Dollars ($3,900.00), to be paid in full within thirty (30) days of the date of this order or the original fine of $7,800.00 shall be reinstated. Nancy Jones, Respondent I acn writing to you in the captioned matter under the authority of a legal Power of Attorney (cc. pages I and Sigccature attached) executed in my favor by tlcc owner /Respondent, Nacncy B. Jones, of Ucut #402 at 250 Beach Road iJCC the Village of Tequesla. Under the terms of the captioned case aced related Code Enforcement Order, a fine of $4,b00 dating from June 8 (and at a continuing nut rate of $100 /day subsequent to the date of the order, with compliance is achieved), plus costs of $299.36 has been unposed. The Respondent is requestalg a Fuse Mitigation Heariccg to reduce or elinuccate the fine based on the following facts and circwnstances. 1) Itily mother, the owner /Respondent, is 9h years old acid iu ace advanced stage of dementia While she still lives independently, her primary residence is 1400 Hiles removed from llnc preuiscs in question, icn Wicmetka, II.,. Her 3 children all live in tlce nearby Chicago area and are regularly attendant on her (nearly daily). That said, arriving mail is often (mis)placed in unusual and difficult to detect spots. 2) No-one is ice residence at the Beach Road property. Thus a Notice of Code Enforcement taped to the door was not seen (unfit a personal visit by the writer in mid-August). 3) Because; of 1) above, the Notice of Code Enforcement and flee Notice of Hearing mailed to the Winnetka address was not discovered by a responsible party, her soar, with July 13. Tlus Notice cited a July 24 Court Hearing date on the matter. 4) Icwnediately upon discover5° of the Notice on July 13, the writer called both the Village Attorney, Iiieth Davis, and the City Inspector, Buck Evans, who had issued the Notice of Code Enforcement. 5} Because the entire situation giving rise to the violation was fomented by a mold infesiatioc~, for which several inspections were performed, uicluduig a "final inspection", the writer uusicclerprcted the reference to 'Yinal inspection ' occ the Notice as cncarciccg tine mold inspection. Furthermore, flee language of the Notice of Code Enforcement is terse and ice tncncaled phrases, obscuring the full meaning. 6) In his conversations of the 13'}' wiQi Davis and Evans, the writer asked if provision of die "final inspection" report' prior to the Hearing would resolve the issue and make the Hearing moot. He was assured it would. 7) The w-ritcr called Dan~l Wafters, the mold inspcctar, on July 14, requesting that copies of the "final inspection', long since completed in April, be emailed to the Village. This was done on July 22. The writer felt at this point that the issues at hand had been resolved. since the inspection (April) had been done prior to the commencement of the fine (Jw~e 8). and that no cause penalty thus existed. 8) On August 7, the writer became aware of the receipt (perhaps received earlier but misplaced per 1) above) of an Order Assessing Fine of July 24 in the amount referenced above. 9) The writer called Attorney Davis on August 8 (Friday) and was informed that the mold was actually ocily one of TWO issues involved: the other being aplumbing /electrical issue. On August 11 (Monday). the writer spoke to Inspector Evans seeking clarification of the etact nature of the plumbing /electrical violation.. and was told it involved the need for installation of a water heater "disconnect" on a new water heater, the attendant permit, and the "final inspection". 10) The tivriter inm~ediatel~~ contracted with an electrician. James Humpage. to have a permit issued, to effect the needed electrical work, and to request the appropriate inspection. The work was done on the 15`x`, with a subsequent "clean" inspection, and a certificate of Compliance issued on August 25°i 11) Further nutigaling the citaGai~. in coimection with the mold remediation and subsequent repair and restoration, we were dealing with rnan_y projects (drywall, electrical, plumbing, carpeting, cabinetry) as well as with several construction projects being completed by the Regency Condominium Association of the building per se (which involved repeated entry into Unit #402) and it was often unclear when permits were required and who (contractor or owner) was charged with securing same. While we recognize that ultimately the owner is responsible, we perhaps expected the contractor to undertake these details as a part of their professional services, and the circumstances were certainly trying and confiising for those not used to having this kind of work done in this jurisdiction. 12) Finally, in petitioning for fine mitigation. we would submit that a fine of $6,000 or more is significantly out of proportion to the severitti~ of the violation. especially given a) the confusing circumstances. and b) the distance, owner dementia, and timing of the cammunicatians to the owner.
