Case No. 2008-00258 Re: Violation of Section 30-33 of the Code of Ordinances of the Village of Tequesta. Address: 324 LEIGH ROAD Tequesta, Florida 33469 Legal Description: NPITER IN THE PINES SEC D LOT 3 BLK 37 PCN: 60-43-40-30-04-037-0030 The Special Magistrate appointed by the Village of Tequesta to hear code enforcement cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Enforcement Hearing held on the 23rd day of October, 2008, and based on the evidence and testimony presented, the following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are hereby entered: FINDINGS OF FACT 1. The Respondent, DEBORAH DREYER, was not present at the hearing, however, there was a finding of proper notice. 2. Village Code Enforcement Officer Petrick testified to and produced photographs of the violation. He indicated that the property appears to be abandoned. 3. The photographs indicated extensive overgrowth of weeds that could breed rodents, vermin, and snakes; and that could be a breeding ground for mosquitoes. 4. The entire code enforcement file was entered into the record. CONCLUSIONS OF LAW Respondent, DEBORAH DREYER, is in violation of Section 30-33 of the Code of Page 1 of 2 Ordinances of the Village of Tequesta. The conditions that the violation presents are a serious threat to the public health, safety, and welfare. ORDER It is the Order of the Code Enforcement Special Magistrate that Respondent, DEBORAH DREYER, shall comply with Section 30-33 of the Code of Ordinances of the Village of Tequesta by the 3rd day of November, 2008. If the Respondent does not comply within the time specified, a fine of up to Two- Hundred-Fifty-dollars ($250.00) per day maybe assessed for each day the violation continues to exist. If the Respondent does not comply within the time specified, the Village has the authority to abate the serious condition and to charge the Respondent with the reasonable costs of abatement along with the fine. Respondent shall be assessed Two-Hundred-Fifty-One-dollars and Ninety-Two Cents ($251.92) for administrative costs to be paid in full by the 3rd day of November, 2008. A Fine Assessment/Status Hearing will be held before the Special Magistrate on the 18`h day of December, 2008, at 10:00 a.m. at the Village of Tequesta. Future violations of the aforementioned code sections maybe considered a repeat violation for which a fine of up to five-hundred-dollars ($500.00) per day may be imposed beginning on the date the violation begins. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. Upon .complying, it is the responsibility of the Respondent to notify the Village of Tequesta Code Enforcement Clerk at (561) 575-3826 to request a reinspection of the property.
