(Please understand that 1 material as listed in this contract is available at time of submittal, unlesant otherwise noted. However, availability may be subject to change by the time of acceptance, in which case we will notify owner or owner's representative to discuss alternatives.) 2. All prices for materials include five percent Florida Sales Tax, unless otherwise stated. 3. We guarantee for 90 days all container-grown plant material installed by Rood Landscape Company, provided that these materials are properly maintained and watered by owner (or by Rood Landscape Company, if so agreed in specifications.) 4. Due to the high mortality rate of newly planted, field-grown material from insufficient watering, we cannot guarantee these materials unless a bubbler or soaker line system is installed at time of planting, as designated by Landscape Contractor. If bubblers or soakers are installed and set on time clock at said time, our guarantee will be honored for 90 days, according to the conditions stated above. 5. We cannot assume responsibility for any "natural peril" which may prove detri- mental to plant material or postpone completion of the job; such as inability to use water during time of drought, high winds, excessive flooding, etc. 6. Requests for any extra work or materials above those included in the contract must be submitted to us in writing by the owner or owner's representative. 7. On this contract, estimated at $ Lr /" percent, payable upon acceptance. e remaining portion will bedduesas progress billings are rendered on the last day of each calendar month. 8. We will exercise all precaution during planting; however, if we run into any under- ground utilities during planting which were not previously marked by owner or owner's representative, we cannot assume responsibility. 9. Past due payments are subject to 1.5 percent monthly service charge, and an annual percentage rate of 18 percent. 10.
