It is understood that the objects in this loan will remain in the condition received and will not be repaired, restored, cleaned or altered in any way without the written permission of the owner. Denis Joseph -Photograph Album: Jupiter 1955 -1969 BACKGROUND NOTE: Capt. Denis Joseph Killane was born October 16, 1905 in Brooklyn, NY and died in Tequesta, FI. May 9, 2003. He was the son of Dennis Killane and Emma Dalmus. He moved to the area in 1946. He owned and operated Killane's Tavern of Rosedale, L. I. NY. He was a veteran of VWVII serving with the US Army Corps of Engineers. He captained a charter fishing boat called "Ho Hum" for many years. (From Palm Beach Post Obituary) He moved to Jupiter and got a place on the Loxahatchee River (From "The Loxahatchee Lament", Vol. 1, ©1978 The Stuart News Company, ©1978 Cary Publications, Inc., All Rights Reserved) Capt. Killane was an early employee of the Town of Jupiter. Town Council minutes from 1962 - 1969 show him working on such projects as: • Landscaping and cleaning right of ways, repairing pot holes • Moving the Quacker (sic) Oil sign • Installing horseshoe courts • Repairing storm shutters at the Chamber of Commerce • Installing "No Parking" signs at the Civic Center • Mowing in Jupiter in the Pines • Repairing fire hydrants • Maintaining Town Parks In January of 1984 a suggestion was made by Commissioner Johnston that Pennock Rd. be changed to Killane Rd. in recognition of his service. Ordinance 9-84 renaming Pennock Rd. Killane Dr. was adopted March 6, 1984. I've worked for or in museums for over 20 years [ I say "for" because I worked for a museum vendor for five years). My MA is in museum studies and the emphasis of my degree was in the legal administration of collections. »> the difference is between a donation and a permanent loan I was taught that the term, "permanent loan" is an oxymoron and makes no legal sense. If an object is given to an organization on a permanent basis, it's not on loan. We accept nothing as a permanent loan. In rare cases we do accept items on a long-term or indefinite basis. As an example: We are currently negotiating a long- term loan from the Palm Beach County School District of "Meeting Minute" books from the late 1880s. The books are public property and the School District does not have the right -short of considering them to be 'deposable' - to give them away. Loaning the books to us will make them more available to the public [and researchers] than they are currently. The loan agreement asconstructed -the wording is currently with County attorneys -would be on a long-term and indefinite basis to be reviewed every five years. A "donation" is a gift whereby the owner passes "good title" to the museum. This, of course, presumes the current holder owns the item outright and has the right to pass good title. I know of no case here where this has ever been aproblem -but I've heard of situations where someone donates something; it actually belongs to let's say a parent who says, "hold on there, you didn't have the right to give that away," and wants it back. A donation is tax deductible and we occasionally have donors get appraisals before making the donation and we sign-off on the IRS form acknowledging that we have received the material. [We can't make appraisals as it's considered a conflict of interest.] To the best of my knowledge, loans of any kind are not generally tax deductible. I can imagine possible circumstances where a loan might have such great utility to an institution that a value could be set on the mere display of something, but in practice I've never heard of this being done. How would the value be set? How would you measure in dollars and cents increased prestige from displaying the object. By comparing admissions to the museum while the object is on display? Beyond this I'd have to search case precedents to find an example. She said they do consider donations tax deductible but they area 501C(3), and she did not know if that would be the same for a municipality. She felt she could not answer my questions since it might be different for amunicipality-she didn't know. So I believe Steve Erdman's information would be better. She was glad to hear the Village is establishing a Historical Committee, and expressed interest in working with the Village. Their museum collects the history of the area through photographs and artifacts-that's what they do. They probably have hundreds of photos of things in Tequesta. If the committee receives anything notable they would like to loan to the museum, they would like that. She referred me to Lynn Drake. She works in research and archives, and has been imaging their collection. She has written books on the area. She works with the Town of Jupiter's history committee.
