HomeMy WebLinkAboutResolution_19-06/07_12/14/2006RESOLUTION NO. 19-06/07 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, APPROVING A CONTRACT WITH JLH ASSOCIATES FOR PREPARATION OF AN EVALUATION AND APPRAISAL REPORT (EAR), FOR THE AMOUNT OF $35,000, REQUIRED TO AMEND THE COMPREHENSIVE PLAN OF THE VILLAGE OF TEQUESTA ACCOUNT NO. 001-150- 531.322. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: SECTION 1. The Evaluation and Appraisal Report is required by March 1, 2007, as a preliminary document in preparing amendments to the Village of Tequesta, Comprehensive Plan, required to be reviewed every ten (10) years; SECTION 2. JLH & ASSOCIATES prepared the prior EAR Report in 1996 for the Village of Tequesta; SECTION 3. JLH & ASSOCIATES has the historic knowledge and experience to prepare this Report in a timely and cost-effective manner. SECTION 4. This Resolution shall take effect immediately upon its adoption. THE FOREGOING RESOLUTION WAS OFFERED by Council Member Watkins, who moved its adoption. The motion was seconded by Council Member Paterno, and being put to vote, the vote was as follows: FOR ADOPTION Jim Humpage Tom Paterno Geraldine A. J~IA ~[~,5. ~, VILLAGE OF TEQUESTA CONTRACTUAL SERVICES AGREEMENT THIS AGREEMENT is made this '~ day of !~ ~ 2004 by and between the Village of Tequesta (the "Village"), a Florida municipality, and JLH Associates, (the "Contractor"). WHEREAS, the Village needs to obtain professional planning and zoning services in the Department of Community Development on apart-time basis; and, WHEREAS, the Village has authorized the Village Manager to secure such services on a part-time basis from a Qualified independent contractor; and, WHEREAS, the Village Manager finds that the Contractor possesses the necessary skills, qualifications and abilities to provide the planning and zoning services needed by the Village, NOW THEREFORE, in consideration of the mutual covenants, promises and conditions contained herein, and other good and valuable consideration, the parties hereto do covenant and agree as follows: I. SERVICES • A. The Village hereby retains the services of JLH Associates to provide planning and zoning services for the Village of Tequesta. B. The dates and times associated with Contractor's performance shall be determined by the Director of the Department of Community Development and JLH Associates pursuant to this Agreement. II. STATUS OF CONTRACTOR A Contractor understands and agrees to provide all services herein as an independent contractor and not as an employee, agent or servant of the Village. B. Contractor understands that he will not be entitled to any health, dental or life insurance, workers' compensation coverage or other benefits which may be applicable to certain other employees of the Village. C. Contractor voluntarily waives and forfeits all rights any Contractor had or may have as a classified employee of the Village. III. TERM A Contractor's services hereunder shall commence on October 1st, 2004, and continue through September 30, 2005. This contractual agreement may be extended for an additional period of time agreed upon by both parties in writing. B. Nothing in this Agreement shall prevent, limit, or otherwise interfere with the right of JLH Associates to resign at any time from its position with the Village by providing at least one (1) month written notice giving a reasonable date of termination of such Agrce- ment such that the Village shall have an opportunity to fill said vacancy. • C. Nothing in this Agreement shall prevent, Iimit, or otherwise interfere with the right of .,.. • Village to termnrate the services of JLH Associates at any time by providing at least one (1) month written notice stating the date of termination of services. IV. HOURS OF SERVICE AND COMPENSATION A. The hours of service to be provided by the Contractor hereunder shall be as agreed upon by Contractor and the Director of the Department of Community Development. B. The Contractor shall be paid in monthly installments at the regular rate of $100.00 per hour for services provided. C. The Village shall compensate for other reimbursable expenses, if necessary, with the prior approval of the Director of the Department of Community Development (e.g. out-of- pocket support services D. As an Independent Contractor, Contractor shall receive a 1099 IRS Tax Form fro the Village, and the Village will report monies earned by the Contractor to the IRS. Con- tractor shall be responsible for all applicable taxes. IV. MISCELLANEOUS A This contract sets forth all terms and conditions for the provision of services hereunder and no modification shall be made to this Agreement without the express written con- sent of the parties hereto. • B. This Agreement shall be construed in accordance with the laws of the State of Florida. Venue for any litigation shall be in Palm Beach County, Florida.
