HomeMy WebLinkAboutResolution_03-05/06_10/11/2005RESOLUTION N0.03-05/06 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, DECLARING ZONING-IN-PROGRESS FOR THE ZONING AREAS KNOWN AS THE C-2, COMMUNITY COMMERCIAL DISTRICT AND FOR PLANNED COMMERCIAL DEVELOPMENTS (PCD), TO CONDUCT A STUDY OF THE VILLAGE'S CODE OF ORDINANCES CHAPTER 78, ZONING; COMMENCING ON SEPTEMBER 15, 2005 FOR APPROXIMATELY 4 MONTHS. WHEREAS, The Village Council of the Village of Tequesta conducted a Workshop Meeting on September 15, 2005; WHEREAS, at the Workshop Meeting, the Village Council discussed the future growth and needs of the Village; WHEREAS, the Village Council expressed a desire to attract commercial development and preserve the commercial chazacter of the C-2 zoning district; WHEREAS, the Village Council expressed concern that there are format inconsistencies in the Code provisions related to the C-2 zoning district and for planned commercial developments; WHEREAS, the Village Council has determined there is a need to conduct a zoning study of the Village's Code of Ordinances Chapter 78, Zoning; WHEREAS, at the Workshop Meeting, the Village Council by consensus vote declared Zoning-in-Progress for the C-2 zoning district and planned commercial developments; WHEREAS, at the regulaz meeting of the Village Council on October 11, 2005 the Village Council voted in favor of exempting from the Zoning-in-Progress referenced herein two zoning applications pending before the Village of Tequesta for sites owned by Royal Tequesta and Grassy Flats Restaurant; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1: For the reasons stated in the preamble hereto and to memorialize the declazation made by consensus at the Workshop Meeting, the Village Council hereby declares Zoning-in-Progress for the C-2 Community Commercial and Planned Commercial Development (PCD) districts of the Village while a zoning study is being undertaken with regards to Chapter 78, Zoning. Section 2: Pursuant to the Zoning-in-Progress, no permits or approvals will be issued for projects that are designated as C-2 Community Commercial or Planned Commercial Developments (PCD), as defined by Chapter 78, Zoning, Article 5, Schedule of Regulations, and Article VIII, Planned Commercial Developments, during the pendency of the Zoning-in-Progress so as not to frustrate the purposes of the zoning study being undertaken. Section 3: The Zoning-in-Progress will commence on September 15, 2005 and shall be in effect for approximately 4 months, at which time the Village Council will review the progress and determine the status of the zoning study. Section 4: Except with regards to the pending zoning applications pertaining to sites owned by Royal Tequesta, and Grassy Flats Restaurant the Zoning-in-Progress shall apply to all other applications. The applications as to Grassy Flats Restaurant and Royal Tequesta may proceed through the Village of Tequesta's zoning approval and review process. Section 5: This Resolution shall take effect immediately upon passage. THE FOREGOING RESOLUTION WAS OFFERED by Vice Mayor Watkins who moved its adoption. The motion was seconded by Council Member Genco, and upon being put to vote, the vote was as follows: FOR ADOPTION Jim Humpage Pat Watkins Geraldine A.
