MII~IIT$S OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, PL~tIDA January 27, 1976 A Council meeting of the Village ~f Tequesta was held on Tu®sc~y, January 27, 1976 at 7:30 P.M., in the Village Hall. Present were Little, Campbell, Baron and fader. ` Jones was out of town on business. Also present were Robert Karp, Village Manager, Cyrese Colbert, Village Clem and John C. Randolph, Village Attorney. Opening Prayer and Pledge of Allegiance to the Flag was given by Count ilman Baron. Campbell moved, "we adjourn at 10:00 P.M.~' The motion was adc,pted. Campbell moved, nthey (minutes of the December 23, 19-75 Council meeting) be accepted as received". The motion was adopted. The motion was adopted. Cempbe~;l, aroved, that the bvt~dget statement of Deceer, 1975 be rece~,ved". The motion was adopted. Campbell moved,. "that the Water Departarent ~'inanci~l Statement (December, 1975) be received". The motican was adoptes~. H. Brown Mr. H©ward Brown, President ©f` the Country Club Commur~t Association, informed Council that there is growing conceti~n over the campers, business trucks, boats, etc. parked: in the front yards: iz~ violation .e~f the Village Zoning Ordi~anee. ~ ~~hect R. Fulling Mr. Roger W. Pralling, Water Committee Chair®an, told Council, that the Village needs raw water and sooner or later the Village will need permission from Martin County for some triad of a permit. ~. Porter 'Mr. M.B. Porter told Council; that parking has no place in the Zoning. Ordinance. -20- 41-27-76 -2 3.~ McDermott Mr. B.J. McDermott told Council of two (2) capers and one (1) boat parked at the house .across fr©m his. r.R. Dewey Mr..J.R. Dewey asked Council when something was doing to be done about the ~riolation$~of the-sign ©rdinance. The village Attorney presented txo (2) sample truck traffic ordinance to Council for thdir review. Council instructed the .village Att€>rraey to present • an Ordin~ce 'at the next meeting on the same suk~~ect with their ideas incorporated into it. The Village Atts~rney told Council of the Bond validation Hearing to be .held on March 5, 1976 at 9:30 A.M. in the County ~©urt Huuse. The Village Manager read. ~ letter addressdd~~to Mayor Little from ~Qressman Skip__.~a,~alis in reference t.o the January 14, 1976 meeting on Interstate. 95 at Tequestats Village Hall. dim. B. Sydow Mr. William ~. Sydow, Gee 8c Jenson ,Consulting Fngine~:rs. was present to inform Council of the results of.the bid opening on January 15, 1976 for the relocation and installation of-..the water mains on. U.S. Highway No. 1. Campbell moved, "that the contract be awarded to Gorham Construction Company. at an estimated contract cost of $12$,594.60 and a contingency fund of $6,500.40 be ®stablished for unknown conditions • encountered by the eontractor_requiring extra work". The motion was adopted. The Council reviewed recommendations of the Tequesta Association of Voters and Taxpayers. The motion was adopted, Baron opposed. S.A, Halas Mr. S.A. Halas was present to present his view as a property owner on Beacon Streetfs improv®ment. Mr. Harp ~_ reviewed with Coutaci~. the vari~us~ problems.. -.involved 3.a the two (2) lining of $eacon Street sir~,ce it was brought into the village. After some discussion Campbell moved, "that the Beacoq; Street impr4veme~ats, as s~tbtnitted by the Beacon Street paving plans, be implemented. by whatever means accessary". The motion was adopted. Yoder submitted to the Council a "working draft resolution's so Council could study the resolution and review the resolution st the next Goune3l meeting. Baron opposed the s'working draft resolution" with.the following statement: (inchided per Baron)~s'~+ir. Chairman, ladies and gentlemen; ` let not our aruciety and concern,f4r water prevail over our good judg-meat. Let me quickly Feview-some matters to date, dealing with our legitimate and .legal s~a~^tax. 1. APri1 17, 1975 we received from Martin C€~untg. the following letter -off' request and for brevity's sake I will quote pertinent parts. of this letter. (Baron did not quote due to time of meting (Baron)~point (1) of letter; our surtax is illegal, pwint (2) if we don't remove surtax-thee--are going to sue us .. 2. :August 14, 1975 as a result of . a phone call to our Attorney we again received another request frog Martin County ahd I cote. (Baron did not;~quote due to time of meeting(Baron}. basically the same"thing, I unde~sto~d the letter as a threat letter_amd if we don't remove the'surtax they will sue. As you~.ladies and gentlemen know Tequesta Water Works has nor.franchise or contract to supply water to Martin County neither }has Martin County any. contract that they must purchase their water from Tequesta. In my opinion Martin County ,ha s.var~.ous legal ways to resolve this problem without"ue~.ng'coersion or threats, as an example if Martin County-feels the water and surtax is -too high or illegal they have the perfect right to refuse to purehs~se Tequesta water and or'have'this matter settled in court, Instead of using these legal and legitimate proceeding Martin-County in the form of t~ieir;resolutions ~?5-9-19, X75-9-20 do X75-9-21 hold a gun ,torthe heads of Tequesta Village. I for one refuse to suppdr~ any act or motion brought about by any threating acts frQm_anone. In m~ opinion this motion without question is con rary and contradictory.:, to parts of Tequesta Qrdinanc~e `13'$ and 134. There .may be some that say, "we want water and whatss the difference how we get ittt, they mag suggest we overlook the rules, look the other way and or who cares? etc. etc. If we the Council and people of Tequesta allow and make our decision under any form of threats, we are opening the door for Martin County and any other towns and Village to-come forth with other request us12~~ the same or Other t~,J@s Of threating~ actions. Let us not go off in all direction. The V3,llage f~ounc~il has agreed, to seek and loin with ERGOR fora master water plan. By wogking together with EP~C4N and pursuing some of them plays a~d~~ideas for water we can and must soave our water, proble~s. ~ submit by passing of any mcatiQ~ of this sari or .constantly reviving the same question we are uadermirala~; and making ineffective the R®solution pa-seed by ERC~R, supporting our request for water, letters of support from -22- r.~ _ ... Dewey's letter of support from the Voters League of Tequesta and the letters sent to Governor Askew in behalf of the Village of Tequesta, by our Attorney. I ask that you vote against this motion." Campbell moved, "that we set March 16, 1976 as the date of the General Election,, per our Charter, for Election of Council Seats 1, 3 and 5. Polling place Village Hall and polls open from 7:00 A.M. to 7:00 P.M.". The motion was adopted. Campbell moved, "that these people; Mary W. Elliott, Charotte P. Kadlec, Mildred E. Graef, Ruth Schlusemeyer, John Stead and Ethel H. Reaney be appointed to serve as Inspectors of Election at our Municipal Election on March 16, 1976." The motion was adopted. Baron gave several suggestions for the ENCON and Tequesta Water Negotiations Committee. The meeting was adjourned at 1:x+2 P.M. Cy se Colbert -23-
