MINUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA OCTOBER $, 1974 The first Regular October. Council Meeting was held starting. at 7:30 P.M., Tuesday, October $, 1974 in the Village Ha11. Councilmembers present were: Little, Jones, Leone, Campbell and Taylor. Also present were Robert Harp, Village Manager and John C. Randolph, Village Attorney. The meeting was opened with Prayer and the Pledge of Allegiance to the Flag by Councilmember Taylor. There. were two corrections to. be made to the September 24, 1974 Council Meeting minutes. Jones made a correction on page 139 paragraph 2 to read, "strip would be six (6) feet wide", Taylor asked that on page 140 the complete letter from the Tequesta Association of Voters and Taxpayers be apart of and attached to the minutes. Taylor moved, seconded by Campbell that the minutes of the September 24, 1974 Council Meeting be approved. The minutes were then passed with the two corrections. Leone moved, seconded by Campbell that the 6dater Department financial statement for .August, 1974 be approved. the vote on the~_motion_-was: Taylor- - For Campbell- - For Jones ~- For Little ~ For Leone - For ar~d the motion therefore passed. The Village Manager read his report for the period September 25, 1974 October 7, 1974• Campbell suggested that we send copies of our correspondence about the Kandell Bridge to Martin County. Taylor moved, seconded by Campbell that the Village Manager's report be approved. The.vr~te on the motion wasr 1 • Taylor - For Campbell -For Jones - For Little - For Leone - For Mr. William Smallwood, President, North County First Aid Squad, Inc. had asked to speak to the Council in regard to the Tequesta Drive Improvement project. He related some of the problems the ambulance has while answering calls in the Tequesta area. One problem he stated was afternoon congestion, around 6.00 P.M., at Tequesta Drive and the railroad crossing and another was people riding in the ambulance with any kind of fracture would be bounced a lot ~n the bumpy road.. He s aced. it takes fire trucks approximate y fifteen '(15~ minutes longer -when there is heavy co~igestion and the probleg~ will get worse Frith the new brid e. Mr, Smallwood asked the the Jupiter Council to ask t;e CoUnfiy if Alternate AlA from Indiantown Read to Unian 76 are U.S. No. 1 could be made one-way heading North. Mr. Smallt~aad also` advised-the Council that he had been in Tallahassee and a pr~~esal for a new hospital south of Tony Penns Road, west of the railroad tracks had. been approved, Mr. Smallwood then suggested the Council appoint a study committee to find the main traffic problems and to get them solved. Mrs.. Campbell asked Mr. Smallwood; if .anyone had contacted the Ambulance Squad about their problem on Tequesta Drive. Mr. Smallwood replied, 'ino". Campbell also advised the firm: making the traffic study. had. not asked Chief Dusenberry about the traffic.proble~ ran `!'equesta Drive east of the-railroad to U.S. No. ~. Mr, John Giba took the podium.-next. He said there were two ways to govern, one is plannng'ahead, the other is by crisis. He' told the C©uncil w'e had spent money for the experts to study the project and tossed-the project aside because of the economy .and if` it's going to have to coma about, ,lets do it at the most,economicaT time, lets do it today. Mr. Giba stated he; hacl talked to Robert Culpepper and that Mr. Culpepper was horrified that the project didn't pass. Campbell then suggested Mr. Giba look at the plans. Other places in the Tillage need improvements-and the primary motive of the Village is to save the pillage atmosphere. Mrs. Campbell stated the Village has been god parent far this area for tao long and she doesn't think that Tequesta should pay for the road. The ambulance or~police department have not been asked about their problems and this was not very good .engineering study. Mr. George Barlow spoke next and argued that: the improvement of Tequesta Drive was budgeted every year and was turned down every year. The cost of the improvment has- gone up from $130,000 • 2 l0-$-74 - 3 • to its now figure of $250,000. Itts going to have to be done, so quit stud~'ing and restudying' they problem please reconsider the widening of Tequests~Drve;and,approve it tonight. Mr. Tancum corrected Mr. Barlow and gave the figures of $300,000 to $350,000 as the; price for the improvement. He asked the Council not to make any decision now but wait until the next Council meeting. ~[r. Paul Thc~son° asked Mr. Harp what taxes does the Village ~reca:ve From cigarette. and sales taxes. Mr. Harp replied about $130,000 annually. Mr.'~homson ..said that about $100,000. of these taxes come from the Jupiter people and some of the people that opposed the improvement only pay about $35 to 40 a year in taxes and that .isn't even enough to pay for garbage pick-up. Jan Davis.son from WRYZ said she was here to represent the merchants in the Village who were surprised the four laving t+vas not approved and that the four-laving should be done. Mr.-Peter Baron suggested the shops on Tequesta Drive pay or help pay for the improvement, Leone brought up the letter from the Tequesta Association of Voters and Taxpayers and said there were three items in the report that were disturbing. Leone then read, in full,. a letter,.dated October 4, 1974 from Mr. A.L. Hutchison. In the letter Mr. Hutchison said in part that his participation in the report, of the Tequesta Association of Voters and Taxpayers, involQed • no intention of using misleading or false statements. Mr. Graham W. Corddry, who*s name was also on the letter told, Leone tie first time he read-the letter was in the newspaper. Campbell told the people she appreciated the people being at the meeting and that she herself represented the people of the Village, Campbell suggested to put the four laving to a referenda®. Taylor said the Council was elected to represent the"people of Teque sta and he did not feel the Council used good judgement in not approving the project. Taylor-moved the Village Council accept plan of the four laving of Tequesta Drive. Taylor called paint of order after-being interrupted by Mr. Tatum in the audience. Leone then, seconded. Mr. Tatum announced Taylor could not make motion, the motion had to come from someone that voted against°`"the four laving. Taylor then withdrew his motion. Little .asked the Council to table until next meeting. Taylor wanted .the problem solved now. Jones didn't think the Council had to retract. vote. ~ Jahn ~' Randolph, the Attorney was not that familiar with'"Rbbertts Rules of Order" and could. not give ruling at the time. Taylor again withdrew his mot-ion, but according to "Robert's Rules of Order1T, said " I will put motion on floor at the next meeting". -~ See reverse side ~€ See reverse side 3 # Correction by Jones: "the matter was brought before the Council, by a form • of a motion, it was seconded, it was voted 3 to 2 against 4 laving. Therefore I did not feel the Council needed. to retrace any of our vote". ~ Correction by Campbell: ~'I suggested. the formation of a permanent traffic coaanittee" . • s • Next on the a ends was consideration of bids for purchase of three ~3) police cars. Leone moved, seconded by Campbell that the Village accept Palm Beach Dodge, Inc. bid in'the amount of X10,625.40 for the three (3) cars. The vote on the motion was: Taylor --For Campbell -For Jones - For Little - For Leone - For and was therefore passed. Jones moved, seconded by Leone that the Village accept Silvestri Concrete Per, Inc. bid for a six (6) foot wide concrete bicycle path, on Beach Road, The vote on the motion was: Taylor - For Campbell -For Jones - For Little - For Leone - For • and was therefore passed. Leone asked for Water Committee meeting on potable wells on October 15, 1974 at 1rG0 P.M, in the Village Hall, and asked the press to accept his notice. The Village Attorney read in full the proposed Ordinance to provide for the granting of permits to allow the drilling of individual hame supply wells for domestic, non-irrigation purposes within the Village of Tequesta, for all properties located within the peninsula area between the North fork .and the North-west fork of the Loxahatehee River. Leone moved, seconded by Taylor to approve first reading. The vote on the motion was: Taylor - For: Campbell -For Jones - Fo r Little - For Leone - For and the first reading was approved. Campbell asked the Attorney if there is another city that has this kind of an ordinance. What would happen if someone had to vacate their home because of this. Thee,-`Attorney told Campbell • 4 10-$-74 -5 ~~ that he didn't know of another city, but it could happen, that a family had to vacate their home. Taylor wanted to make people aware that they might have salt water intrusion into their wells. Gary Preston, Recreation Director announced there will be a Flea Market October 12, 1974 beginning at 9:00 A.M. at Te~uesta Park. Taylor asked that annexation be put on the agenda for a November item. Campbell told of a meeting on October 9, 1974 about the Kandell bridge. She asked how long we gave the stores on U.S. No. 1 to remove the signs. Mr. Harp told the Councilmembers that the State has put into effect new annexation rules. Mr. Harp was asked by Campbell to send congratulation to the Warriors on winning their football game. Mr. Harp announced that Tequesta was reinstated for flood insurance as of September 23, 1974 and that there was going to be a Public Hearing October 11, 1974 at 7:00 P.M, on raising of property tax millage above that certified by the tax assessor. He also discussed drainage problems in the Villa a and gave plans set up with ENCON to pack rock four ~4) feet b three (3) feet around ENCONS pipes, the cost being $y5,500. Leone moved, seconded by Campbell that Underground Utilities, Inc. be authorized to make this improvement. The vote on the motion was: Taylor - For Campbell -For Jones - For Little - For Leone - For and therefore passed. Mr. Shay complimented the Council for getting the ball rolling on the drainage problems. Upon moti~:~n by Campbell, seconded by Taylor and unanimously passed, the meeting was adjourned at 10:07 P.M.
