HomeMy WebLinkAboutMinutes_Regular_08/13/1974T x MINUTES OF THE MEETIlJG.OF THE CQUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA AUGUST 13, 1974 The First Regular Council Meeting for August was held at 7:3Q P.1~.~ Tuesday, August 13s 1974 in the"V'illage Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were: Jones, Campbell and Taylor. Also present were Robert Harp, Village Manager and Mr. John C. Randolph, Village Attorney. Mayor Little and Councilmember Leone advised they would be out of town and unable to attend the meeting. Vice Mayor Jones chaired the meeting. The meeting was opened with Prayer and the Pledge of Allegiance to the Flag by Councilmember Campbell. Taylor moved, seconded by Campbell that the minutes of -the July 23, 1974 Public Hearing be approved. The vote on the motion was: Taylor - For Campbell - For Jones - For and the m©tion therefore passed. • Taylor moved, seconded by Campbell that the minutes of the July 23, 1974 Regular Council Meeting be approved. Taylor moved, seconded by Campbell that the minutes of the July 3Q, 1974 Budget Workshop Meeting be approved. The vote on the motion was: Taylor - For Campbell - For Jones - For and the motion therefore passed. Taylor moved, seconded by Campbell that the minutes of the August 6, 197, Special Council Meeting be approved.. The vote on the motion was: Taylor - For Campbell - For Jones - For 116 $-13-74 - 2 • and the motion therefore passed. The Village Manager advised that Mr. Tatwnts statement in regard to, the Board of County Commissioners adopting anordinance-reducing the height of high rise buildings was mentioned in the minutes as a non Agenda item and the statement attached to the minutes. Taylor moved, seconded by Campbell that the Water Department financial-statement for June 1974 be approved. The vote on the motion was: Taylor - For Campbell - For Jones - For and the motion therefore passed. The Village Manager read his report for the period July 21, 1974 - August 10, 1974. Building permits for July were: J 19 Year to Date No. Valuation No. Valuation 1$houses) 95, 25« 17$ ~7 houses) 1,171,345. Last Year 29 (-) $47,325. 339 (31 houses) $ 4,095,475. Mr. Tatum asked about a report on the recent Water Committee Meeting and the Village Manager said he would report for Committee Chairman Leone under that Agenda item. He mentioned ENC©N was going to reconsider their action in approving the Jupiter Inlet Corporation (Broadview) application and Campbell said a recent newspaper article stated that the ENCON Board was advised they could reconsider their prior action. Mr. Tatum asked who would make the final decision on the application and the Village Manager advised it would be the Central and South Florida Flood Control District since the Board of County Commissioners asked for their report on their findings in the matter. Taylor moved, seconded by C ampbell that the Village Manager write to the Loxahatchee River Environmental Control District asking clarification of their position on the Jupiter Inlet Corporation (Broadview) application and the Village Attorney is to review the reply. The vote on the motion was: Taylor - For Campbell - For Jones - For and the motion therefore passed. Mr. Baron wished Vice-Mayor Jones well in her chairing the meeting tonight. u7 ~-13-74 - 3 Mr. Randolph explained and discussed the prior actions taken to make the Village eligible for flood insurance for its property owners. He advised HUD had given him wrong information in regard to proposed changes in Article XIX, Section '~, of Village Ordinance No. 211. They had advised that they should have told him that the building percentage destroyed should be fifty (50~ percent not seventy-five (75) percent as previously advertised and discussed at the July 23, 1974 Public Hearing on the proposed Zoning Ordinance changes. Mr. Randolph said this would be a substantial change making the Ordinance more restrictive. He said the Council should hold another Public Hearing on the Zoning Ordinance revisions and second reading of the Ordinance should not be made tonight as scheduled under Agenda item No. b. Taylor moved, seconded by C ampbell that another Public Hearing on the proposed Ordinance changes be properly advertised and scheduled as quickly as possible. The vote on the motion was: Taylor - For Campbell - For Jones - For and the motion therefore passed. The Village Attorney explained the content of Section 7 at the request of Campbell, Many questions were asked from the floor, with the persons being advised to consult their insurance, agents about their. questions since the Village would not be • involved in the technical, mechanical portion of the program, only setting standards for future construction in the Village. The Village Manager read a July 12, 1974 letter from Chief Baird of Jupiter Fir~'Control District No. 1 setting forth requirements for a substation site. Taylor suggested a workshop meeting between the Fire Di strict ,Com~issione~s and the Village Council to fully discuss the Districtts present and future requirements. Campbell spoke of the recent discussions she had had with Chief Baird and the necessity of resolving the matter of $ substation for the north side of the River as quickly as possible. Taylor said the District is looking for the donation of a -site and they should invite the entire area and discuss their overall pro~asal. Mention was made of the Districtts attempts to obtain land on Old Dixie Highway and U.S. Coast Guard property. Campbell mentioned the present site of the Loxahatchee River Environmental Control District on Dover Road as a possible site when the existing plant is,~emoved. She further stated the matter should be worked on now, before the problem occurs. Taylor again requested the District give an areawide proposal. Campbell suggested that the Loxahatchee Council of Governments be asked to pursue the matter and Jupiter Mayor White should be contacted. Taylor moved, seconded by Campbell that the Village Manager write to the Commissioners of Jupiter Fire Control District No. l requesting them to schedule a workshop meeting to discuss their present and future needs and to invite representatives of local governmental agencies within the • District to participate in the workshop meeting. The members in attendance believed item 3 should be deleted which would allow residents on corner lots to use the side street line instead of the front of their house for placing their yard trash for collection. It was also suggested .that item $ be changed to include plastic bags to be sold ,by-the Village at cost to anyone who desires to purchase-same. The Village Manager is to get information on the cost of plastic bags. The matter was tabled until next meeting, at Taylorfs suggestion, so all Council members could be in attendance to discuss the matter. The next item discussed was easements A, B and C in the Tequesta Country Glub Gom~~~~ty. Campbell said the easements had been deeded by the Tequesta Country Club Association to the Vi].7.age who then gave the Association a lease on the easements subject to the provisions of the Tequesta Subdivision Restrictions and especially providing that the use of the easements is reserved-for the use of the owners of lots in the Tequesta Subdivision f©r entry into the waters of the Loxahatchee River. She said easement "AM has a doer, parking area and loading ramp. Easement "B" has a path and benches and easement "C" has no improvements. The lease was granted July 19, 1967 for a period of ten (10) years. Taylor suggested the Village Attorney look into the lease and deed. Campbell suggested the Village Attorney pursue if the Association would release the easements for use as public parks; if the lease would be cancelled and easements transferred back to the Association and there should not be a tax shelter for the Association. Campbell says she favors park areas. Tatum asked about tax shelter to the Village and was advised it was to the Association. Mr. Baron wanted to know if all residents of the Village could use the easements and Campbell .said no. Mr. William Gotwals, of the Tequesta Country Club Community Association said approximately 90~ use of the easements was by non-Tequesta Subdivision residents., The Village Attorney was asked to thoroughly review the matter and advise the Village Council. Taylor said he had attended a Chamber of Commerce meeting today and the meeting was advised that it was questionable whether the U.S. No. 1 improvement project of the State Department of Transportation had been funded for the fiscal year 1974/75. The Council advised the Village Manager to write the Florida Department of Transportation to find out the status of this project. He spoke on the recent letter from Sheriff Heidtman regarding helicopter evacuation service for high-rise buildings and the possibility of 119 8-13-7~. - 5 amending building codes to provide for helicopter landing pads on high-rise buildings in the future. The Village Manager was advised to write to the Fire District to determine the maximum building height limit they can presently service and the future maximum height they expect to be able to service. Taylor appealed for Village residents t© serve on various committees. Campbell suggested curtailing the number of persons attending the Florida League of Cities Annual Meeting. Campbell moved, seconded by Taylor and unanimously passed that no more than two (2) Village personnel and the Police Chief be authorized to attend the Annual T~Ieeting in Tampa, October 21~, 25 and 26, 1974. Campbell requested status of lin;nroa of Tequesta Drive. No definite word had been received but was in the County1s work schedule; upon question was advised there is no further information on Kandell Bridge; asked if assistance was needed in the formation of the Municipal Credit Union for smaller municipalities in the County; complaints she had received on high grass at Baptist Church and Episcopal Church and if Robert McKee had replied as to service on Pension and Fringe benefit Committee. Campbell again advised that the contractor for Loxahatchee River Environmental Control District had not completed replacement of sod, etc. along Country Club Drive, together with two (2) broken sprinkler heads at her residence. The Village Manager was advised to again write the District in regard to this matter and to also request that all future repair-work in the Village be taken care of properly and promptly. She was advised the Tequesta Park tennis courts wereopened for public use today and that bicycle rodeos had been held at the Park five days. Campbell asked the status of the installation of a short stretch of bicycle path opposite Bermuda Terrace and was adv~,sed Lowery Construction had not given a price as yet,..' Campbell then proceeded to discuss the August ~, 1974 dater Committee Meting which she was advised of verbally at the August 6, 19 74 Council Special Meeting. Campbell spoke of the Sunshine Law, procedures and proper notice of such meetings and possible Sunshine Law violations. She said she was concerned about the makeup of the Committee, saying she feels it should be broadened and again questioned th.e way the Committee is presently operating. Paul Philips said the last ,.two meetings were held without the press being notified. t-fir. Tatum said :he concurs with Campbell. The Village Attorney spoke of the Sunshine Law in general and said advisory boards do not take action for the Council. There are certain procedural matters to be taken when applicable and no secret meetings can be held. He asked for a list of the various Village Committees and functions so he can review and attempt to resolve the matter. Campbell was quite concerned with what she believes was improper handling of the recent meeting by Chairman Leone. Taylor suggested a workshop meeting on committees and committee procedures. Campbell suggested any action be tabled until next Council meeting 120 w 5-13-74 - 6 when all members might be present and the Village Attorney would have an opportuhity to review the lists of committees and report to the Council. Campbell spoke of lot clearing procedures and requested a copy of the ordinance. Mr. Jack Chadnick of the Bermuda Terrace Association discussed possible annexation of that area to the Village and the Village Manager advised he would send him information in this regard. He also spoke of recent damage to his property in the Village done by the contractor for the Loxahatchee River Environ- mental Control District and was advised the matter of the replace- ment of sod was being worked on. He was advised the Village would be glad to meet with his group re: annexation. Gary Preston advised the tennis courts would be open seven days a week from b:30 A.M. to sundown, with no reservation policy. The County had advised the Seabrook Road bicycle path should be started sometime in October. The Village Manager reported on the August 7, 1974-Water Committee Meeting in the absence of Gomtru.ttee Chairman Leone. Larry Land of U.S.G.S. reported the water level was -0- in July and should show some improvements with the recent heavy rains; that there had been a long term rise in chlorides in the transition zone from 2000 PPM in 1971 to k000 PPM in 1974. Final submission of application to FCD should be made early next week and amendment of Tequesta Park lease should be on the State Cabinet's September 3, 1974 Agenda. The Engineer reported we should be able to go to bid shortly on emergency water line crossings. Part of the work has been done on the installation of the altitude valve and monitoring meters are expected to be delivered August 12, 1971+. Engineers should complete analysis of Village Water System in an estimated 45 days and feasibi]ity report should be completed in an estimated 75 days. engineers have written a letter to FCD outlining why the Village opposes the Jupiter Inlet Corporation (Bf~oadview) application and will meet with FCD tomorrow in this regard. A few minor items still have to be resolved with Pa]~n Beach Cable Television for the purchase of the ten acre tract of land. Campbell and Jones requested a copy of the up to date Water Waiting List. Mr. Tatum spoke of a legal question in the Jupiter .Inlet Corporation (Broadview) application. Mr. Robert Ferreira said no taps should be allowed in light of the water shortage. A Mr. Godfrey ~iacColeman asked many questions in regard to release of water taps. The Village Attorney said advisory committees do not fall under the new Financial Disclosure Law. He also requested specific questions concerning, individuals so he could review same and advise. Campbell and Jones-asked him several questions. He spoke of the minor items in the purchase and sales contract being worked on by ?~~iater Department Engineers and Palm Beach Cable Television Company; 121 ~-13-74 - 7 The Village Manager reported that a letter had been received from Jupiter Inlet Colony suvporting our opposition to Jupiter Inlet Corporation (Broadview); that a copy of a letter had been received from the Town of Jupiter sent to Congressmen Rogers and Bafalis and Senator Chiles, asking their support of Palm Beach- Martin County Medical Clinic at the August 22, 1971. hearing of the Palm Beach County Area Health Planning Council and suggested the Village also support the clinic and the Councilmembers present approved a letter to be written in this regard. The Village Manager advised of the need for the Comprehensive Plan Workshop Meeting, Tequesta Drive 7~provements Workshop Meeting and appoint- ments to Zoning Board of Adjustment and Co~++~n~ty Appearance Board.
