HomeMy WebLinkAboutMinutes_Regular_03/12/1974MINUTES OF THE MEETING OF THE COUNCLLMEN OF THE VILLAGE OF TEQUESTA, FLORIDA The first Regular March Meeting of the Councilmen of the Village of Tequesta was held at 7:30 F.M., March 12, 1974 at the Village Hall. Councilmen ,present were Messrs: Russell, Frank, Leone, Little and Shay. Also present were Robert Harp, Village Manager, Police Chief Henry Dusenbery, Gary Preston, Recreation Director, Charles R. Jonas, Village Clerk and Mr. Edward Welch as Village Attorney for Mr. Christopher Cook who was unable to attend. The meeting was opened with Prayer and the Pledge of Allegiance to the Flag by Mayor Russell. Upon motion by Shay, seconded by Leone and unanimously passed, the minutes of the February 26, 1974 Regular Council Meeting were approved with the added statement recommended by CounciL~an Shay perta3.n-- ing to accounting procedures requested by the Auditors that will be added to Page #61. Mayor Russell then called upon Mr. Sohn Giba, Chairman of the Wage and Salary Review Committee to present their final report. Mr. • Giba stated that this E'Ad Hoc" Committee was started on September 11, 1973 at the recommendation of Mayor Russell and added the Council was to be comarended for the selection of a most competent and. industrious group of Committee members. Namely: Mr. William T. Dwyer Mr. Herschel McCalley Mr. Lee Moon Mr. John Roberson Mr. Giba said the report and recommendations made by the Committee were covered by five (5) exhibits and comments to cover each exhibit. The five (5) exhibits are: 1. Organization chart and functional descriptions 2. Job descriptions 3. Wage and salary plan 4. Pay policy 5. Recommended. fringe benefits Mr. Giba said the Committee had performed their task and hoped the Village Council would be satisfied with the results, therefor the Committee assumed it was disbanded. Mr. Giba distributed a complete final report to each Counci]men. Mayor Russell stated he had not had an opportunity to read the report of the Wage and Salary Committee but assumed it was a report worthy of the Committee and codmended theme highly. 62 3-12-?4 - 2 r~ L ~J Vice~tayor Little stated the Committee would be discharged as requested, but would like to be able to call upon them to answer any questions that may arise when the report is given to the new Council. Mr. Peter Baron, Chairman of the Solid Waste Committee, stated the Committee has not been able to contact Mr. Paul Hardy, but would do so later, but has been able to contact several other municipalities concerning the handling of their solid waste. Also they have contacted Mr. Guy W. Spicola of the Environmental Protection Agency who stated, if the goverment or State does not take over the solid waste handling within ten (10) years, there will be no place to dump trash and garbage. Mr, Baron ended his statement by saying the Solid Waste Committee would give a complete report to the new Council in the very near future. Mayor Russell then spoke of the "Ad Hoc" Commmittee formed to review Village financial investments, stating they had no recoms-endation they felt would benefit the Village in either Village funds or Water Department and-that this Committee is also disbanded. The Village Manager reported that permission was granted by Mr. Ney Landrum, Division of Recreation and Parks, to leave test well and monitoring well casings in the ground at Tequesta Park; sent a copy of Tequesta Drive Traffic Study to Jupiter Mayor, Carlin White; a copy of the traffic study with a copy of Resolution No. 3-73/74 was sent to County Commission Chairman Robert E. Culpepper and Palm Beach County Engineer, Mr, H. F. Kahlert; seat a letter to Chief A. V. Baird, re: proposed fire station on Old Dixie Highway; sent copies of Annual Audit report to the .State Department of Administration, Mr. Edward T. Walker, Mr. Anson B. DeWoll', Mr. W. C. Goss and Christopher H. Cook, Village Attorney; sent a letter to Mr. Edward T, Walker, Gee b• Jenson, regarding the proposed site of Loxahatchee River Environmental Control District pumping station No. 53, located on Old Dixie Highway in Well Field #4, also location of water and sewer lines on Old Dixie. Righway to be discussed with the District. The following building permits were reported: Building Permits: Februarv_1974 Year to Date No. Valuation No. Valuation 12 135,582.00 84 ?81,449.00 Last Year 21 (6 houses) 1,622,950,00 158 (15 houses) 2,820,345.00 The Village Manager reported that on March 8, 1974 we advertised for bids for exterior painting of the Village Ha]~, ~.nd garage. Bids to be received no later than 5:00 P.M., March 29, 19?4, He contacted the United States Coast Guard and Trustees of Internal Improvement Fund about permits for the Kandell bridge. They have sent the application to 63 3-12-?4 - 3 • several other committees for their approval and grill be at least another ninety (90) daps; sent the Villages application for reinstate- ment of eligibility for flood insurance to Mr. Richard Krimm, Assistant Administrator of Flood Insurance Program and a copy to Congressman Bafalis, also contacted Mr. Krimm personally on March 11, 1974 when Mr, Butterfield and the Pillage Manager attended a meeting of the Flood Insurance Program at Punta Gorda, Florida. Met with Mr. Charles Hntnell of the Farmers Home Administration for possible loan for construction of proposed water treatment plant. Mr. Hutnell asked for several items of information to be forwarded to the Gainesville office to see if application should and can be made. These items are: 1. Copy of present Water Department Budget 2. Copp of proposed Water Department Budget 3, Total number of present users classified as: a) residential b) multi-dwelling c) commercial 4. Present rate schedule 5. Estimated amount of money to be borrowed 6. Any possible problems with right-of way water rights 7. Reasons why loan is needed Mr, Kandell~s latest date that he expects to finalize his water plant is March 15, l9?4. An average of 2.4M gallons of water per dap has been ,pumped in the first eleven (11) days of March. At this rate approximately 74,000,U(~ gallons will be pimped in the month of March. Nichols Sanitation, Inc. has requested a Workshop Meeting Stith the Village Council as early as possible following the reorgan- ization of the Village Council, March 26, 1974, to discuss garbage collection. U.S. Senator Lawton Chiles advised he would support Bill FIlt 11221 as the Village requested. The Village General Election will be held Tuesday, March 19, 1974. Polls will remain open from ?:00 A.M. to ?:Q© P.M. More information on dry wells and catch basins has been received and final designs will be completed in several areas within the next several weeks. Everyone has been notified of the violations of lot clearing and all lots will be reviewed next week, There is no word as pet from the Department of Transportation on the bicycle path for SR ?©? (Beach Road). Beacon Street temporary right of access fox~ns are ready and will be sent to all residents. Councilman Frank requested the fors be hand carried to get alI signatures as soon as possible so it wontt take another two (2) years. 64 3-i2-?4 - 4 The Village Manager stated a problem has arisen pertaining to the Water Waiting List concerning Mr. William Peifer. Mr. Peifer stated on April 12, 1973 he was refused an application for a water connection and feels he should be on the list for the first to s to be released. Mr. Peifer has a request for two taps for two (2~ lots. Councilman Leone asked the Village Manager if both he and the Village Attorney felt that Mr. Peifer should legally appear on the Water Waiting List and-was advised they did. Motion by Leone, seconded by Little and unanimously passed that Mr. Peifer~s name be added to the Water Waiting List for two (2) taps, dated April 12, 1973. The Village Manager stated that Mr. Gaio also felt he should be on the Water Waiting List but after-quite a discussion Mr. Gaio~s name appears on the list as of March 12, 1974. Motion by Leone, seconded by Shag and unanimously passed, that Mr. Gaio~s name appear on the Water Waiting List as of March I2, 1974. Mayor Russell. asked the Village Manager to discuss with the residents the Financial Consultant Mr. W. C. Goss as to how much he is paid and by what department. Also how Iong he has been employed by the Village. The Village Manager stated Mr, W. C. Goss has been the Village Water Department Financial Consultant for over ten (10) years and is paid $1()O.l~ per month by the Water Department except for any additional work to be done if bonds are to be issued, then on a percentage basis. @uestions arose from the floor covering various phases of water - water pressure, franchise, taps to be released, when will Mr. Kandell~s water system take Martin County Little Club off Tequesta~s water system, if the Council couldn~t enforce the ©rdnance covering the restriction of water usage throughout the system. Mr. Welch, Acting Village Attc~rneg, stated the Ordinance would only apply to the residents of Tequesta and no one else and there was no wag to force theta to cuatply. ~' Vice-Mayor Little .stated when the water moratorium star'ted` vn`April 10, 1973, letters were sent to-`all municipalities then on the Tequesta water system asking that all adopt the same ordinance to help in the water shortage. "No one answered the letters". Mayor Russell with the unanimous approval of Council, recommended the Village Manager issue a Public Notice requesting the :restriction of watering lams during the existing dry period stating this would be a voluntary water-use restriction. 55 3-12-?4 - 5 • Councilman Leone reported on the Water Committee stating the Committee was started by the Council in April 1973. Some of the items completed in this year are as follows -Analysis water supply wells, exploratory wells, pera~a.nent filter hookup, water use data report, construction seventeen (17) monitoring wells, agreement with U.S.G.S., test well in Tequesta Park, altitiude valve, estimated cost preliminary engineering report, metering all wells, purchase ten (10) acres for proposed water treatment plant at a total cost of $95,077.86. Counci]man Leone continued by saying that all this did not give Tequesta more water. All the items that have been done in one (1) year should. have been done ten (10) pears ago. This is a catch-ups, mot a relief for water, but with what has been accomplished there is hope of water soon. As far as what kind of water treatment plant Tequesta needs, the Council apppinted Gee Fa Jenson as our Consulting Engineers and he feels they can do their job if given half a chance. Vice Mayor Little stated that March 23, 1974 was the day all groups were going to turn out at Tequesta Park to clear and burn off five (5) acres of land where two (2) football fields and two (2) baseball fields will be constructed. The First Aid Squad, Police, Fire trucks and all, old and young, that would like to help,-feel free to participate at the Park that day. Vice-Mayor Little then called upon Mr. Preston, Recreation Director, to discuss the bicycle path proposed by the County. Mr. Preston stated he had been in contact with Mr. Morley of Palm Beach County, who stated the Village would be responsible for two tenths of a mile in the Village limits. The bicycle path would run from Riverside Drive up Seabrook Road to County Line Road to Tequesta Park. The path would either be six (6) feet wide or eight (8) feet wide to be decided by Council. The approximate cost to the Village would be between $6,000. or $7,000. Motion by Little, seconded by Shay and unanimously gassed to have Mr. Preston notify Mr. Morley that the Village will cover the cost of the two tenths of a mile at a cost of $6,000. - $?,fl00. Councilman Shay asked about the lot east of the Village Hall and when the-work will start on it, Mr, Preston stated the work would start in approximately one (1) week and the Travelers Palm Garden Club has several trees and flower-bearing plants donated at the present time. Mayor Russell asked several questions such as - will the County stand the cost of moving water mains on Seabrook Road, rules and regulations for Tequesta Park, trash on Tequesta Drive, County Line Road improvements. Mayor Russell then read a letter from the Jupiter-Tequesta Chamber of Commerce requesting the Council's support in locating I-45 closer to Tequesta to help traffic problems and requested ~ letter be sent to the Governor supporting this request. 66 3-L2-74 - 6 Motion by Leone, seconded by Shay and »nAn~~usly passed, that the Village Manager write the Governor of the State of Florida stating the Council completely supports the request made by the 3upiter-Tequesta Chamber of Commerce. Mr. Welch presented the Modification Agreement for,the Palm Beach Cable Television Coampany to provide a security performance bond in the amount as stated in the franchise to replace the cash escrow as requested on June 5, 1970. This Agreement, signed and adopted on this date -March 12, 1974. Mr. Welch then presented the Temporary Right of Access Indenture to be signed by residents on Beacon Street to allow the contractor to enter upon their land with all reconstruction of land disturbed replaced as before. Jop Village Cle~t'c ~ Vice-Mayor Little stated that his statement on Page b5, Paragraph 9, shown in the Minutes of March 12, 19?4 was not referring to the Moratorimm of April 10, 1973 but was referring to a water use restriction Ordinance adopted several years ago and at which time the Village requested all governmental units served by the Village water system to adopt similar ordinances so that we could enforce the water usage restrictions with all users of the Tequesta water system to be treated equally. 6?
