VILLAGE OF TEQUESTA, FLORIDA
The first regular monthly meeting of the Councilmen of
the Village of Tequesta was held at 7:30 P.M., January 8, 1974 at
the Village Hall. Councilmen present were Messrs: Russell, Frank,
Leone, Little and Shay. Also present were Robert Harp, Village
Manager, Christopher H. Cook, Village Attorney, Police Chief Henry M.
Dusenbery, James W. Worth, Water Department Superintendent, Alvin W.
Butterfield, Building Official, Gary Preston, Recreation Director and
Charles R. Jonas, Village Clerk.
The meeting was opened with Prayer and the Pledge of
Allegiance to the Flag by Councilman Frank.
Upon motion by Leone, seconded by Frank and unanimously
passed, the minutes of the December 18, 1973 Special Council Meeting
and the minutes of the December 18, 1973 Regular Council Meeting were
approved.
Upon motion by Little, seconded by Leone and unanimously
passed, the minutes of the January 3, 1974 Public Hearing and the
minutes of the January 3, 1974 Special Council Meeting were approved.
• General Thomas Darcy speaking as an interested citizen,
who feels all citizens need confidence in their government officials,
conenended the Council for a job well done in 1973. He stated that many
of the residents are prone to forget that the Council is serving in a
voluntary capacity with very little remuneration for performance of
duty. Sometimes it seems that in the heat of a debate the ire on
both sides is somewhat aroused and we all hope that in the year ahead,
we can work together in a joint effort. We will especially be
appreciative to the individual members of the Council for what they
are doing for our Village.
Mayor Russell then turned the meeting over to Councilman
Leone who introduced Mr. Anson B. DeWolf, Special Consultant with
Gee ~ Jenson, the Water Department's Consulting Engineer. Mr. DeWolf
sum~-arized his interim preliminary report of December 1973 on water
supply, treatment plant, distribution facilities, proposed needs and
possible solutions. Mr. DeWolf stated there was no immediate solution
to Tequesta~s water problem, that Tequesta was mining, which means we
are pumping more water than is being replaced per day. If this
continues there will be less water for consumption each year. The
aquifer is mainly replenished from rainfall. The situation Tequesta
has should be handled as an area responsibility. Mr. DeWolf introduced
Mr. Abe Kreitman of the Miami office of U.S.G.S.
Mr. John W. Dell, an attorney representing the Homebuilders
and Contractors Association asked Mr. DeWolf several questions relating

to Tequesta~s water moratorium, questions pertaining to water manage-
ment problems,-percentage of water used for sprinkling and what it
would take to release the moratorium if more wells were drilled,
would there be enough water to supply Tequesta and the surrounding
area,
Mr. DeWolf stated as he previously reported in December
of 1973 that this was just a preliminary report and statistical data
is being compiled for the final report and until that time the
questions cannot be answered.
Mr. Meeks of Brockway, Owen and Anderson Engineers,
reported that traffic experts had suggested that Tequesta Drive would
require four laning with five or siac lanes preferred in some areas.
~' Mayor Russell stated-he would be glad to meet with
Mr, Harp and Mr. Cook to look into issuing of bonds for the 2.? million
dollars to be used for the new water treatment plant. He also stated
he would be glad to meet with Palm Beach Cable Television Co. to
discuss the repurchasing of the ten (10) acres of land for the water
treatment plant when Mr. Harp sets the date.
Motion by Leone, seconded by Frank and unanimously passed
that Mayor Russell and Mr. Harp contact Palm Beach Cable TV about the
• price of land and cost of moving cables to south of the field.
Mr. Harp stated that in the last re~ort the Village had
from U.S.G.S., they were going to pay one-half (~) of the $17,000.00
for the water study for the Village of Tequesta but another change
has been made and they are now only going to pay one fourth (~), so
the Village cost will be approximately $13,000.00 at the present time.
Mayor Russell asked Mr. Cook and Mr. Harp if the Ordinance
to change Article %III, section 13.4 (1) and Article 7CIV, section
14.4 (1) of Ordinance No. 211, to provide an exception for charitable
organizations and non-profit corporations, had been legally published
with the second reading on January 22, 1974. (Answer was yes).
Mr. Harp stated that he and Mr. Butterfield, Building
Official, decided the Village needed Code Review Committees for the
purpose of updating, the several codes and recommended the following
persons be named as members of these committees:

Motion was made by Frank, seconded by Little and unanimously
passed to accept all names recommended by Mr. Harp and Mr. Butterfield
for code review committees to update all codes.
Mr. Cook stated that before any taps for water are issued,
there must be an ordinance written and published stating who is to get
water taps and a time limit set for each application. Under the
circumstances it could be an emergency ordinance and possibly passed
at first reading if all Councilmen voted for the ordinance.
Mayor Russell stated all residents and non-residents of
the Village of Tequesta on the Village water system should have the
same privileges and whether they have a well or not, if their name
appears on the list they should have the right to .receive water.
Mayor Russell with the total support of the Village
Council suggested a dead-line time be set in an ordinance in order
for persons to receive water meters. They would have thirty (30)
days to apply for water after notification and ninety (90) days to
start construction after a building permit was issued, or both
water meter and building permit will be revoked.
• Councilman Leone stated the latest date that Karl
Kandell has set to take over Martin County Little Club water system
is February 15, 1974.

• Mayor Russell recommended that Mr. Harp. and Mr. Cook
look over the list of persons waiting for water meters and decide
what procedure to use and forward it to Council for approval., Also
to check on the number of .homes that have wells, and desire to go
on the Village water system,
Mr. John Dell recommended the Council pass an Ordinance
limiting the number of times a resident can sprinkle his yard per
week, to eliminate over usage of water.
Mr. Harp reported a letter was sent, to Mr. Edward T.
Walker of Gee b+ Jenson, advising him of approval of Assay Drilling
Inc.; a letter was sent to Mr. Thomas L. Gilchrist Jr, of Palm
Beach Cable TV advising them of the interest-the Village has in
repurchasing the ten (10) acres of land next to the Well Field #4;
a letter was sent to-the Loxahatchee River Environmental Control
District advising-them the Village Council consented to a rate
reduction for commercial accounts; a letter was sent to the Village
Attorney advising him of a deadline for presenting proposed legis-
lation to the Legislative Delegation. On December 26, 1973 Council-
men Leone and Shay and the Village Manager attended a meeting at
the Burning Foot Auditorium, Proposed U,S. ~1 construction and
drainage was discussed by the Department of Transportation and the
Loxahatchee River Environmental Control District.
• On January 8, 1974, the Water Committee and all interested
parties were escorted by Mr. DeWolf to the Tri-Southern and Riviera
Beach Water Plants. The Loxahatchee-River Environmental Control
District will hold a public meeting in the Tequesta Village Hall at
7:30 P.M., January 29. 1974 to explain Phase IA of the Sewer Const-
ruction Frogram,
A map showing the proposed location of the bicycle path
on the east side of Beach Road was forwarded to Florida DOT for their
review and approval.

Prices were obtained for mowing various lots, prices
and specifications for french drains were obtained and given to
Councilman Shay and Mr. Butterfield, Building Official.
Councilman Leone reported that on January ?, 1974 at
3:00 P.M., the Water Committee met in the Village Hall. Fresent
were Messrs: W. E. Leone, Chairman, Robert Harp, Village Manager,
James Worth, Water Department Superintendent and Mr. A, B. DeWolf,
Consulting Engineer, Also present were Mr. Ed Walker, Mr. Larry

• Land. and Mr. Christopher H: Cook. Other interested people attending
were Councilmen Shay and. Little, Mrs. Bernhard and Mr. Dent from the
Loxahatchee River Environmental Control District and Mr. Eckes from
Martin County, Utility Rate Consultant.
Councilman Leone stated the bids were to be in Tuesday
January 8, 1974 for the installation of the altitude valve. The
contracts for the drilling of draw-down and monitoring wells were
given by Mr. Walker on Tuesday, January 8, 1974. The instruments
for the instrumentation of each well have been ordered and it would
be approximately minety (90) days before delivery. The Alsay
Drilling, Inc. has been provided a contract to drill test wells and
when signed a ten (10) day time limit to get started with ninety
(90) days to completion. Mr. Land of U,S,C.S, would monitor the
instrumentation and pumping of the wells..
Councilman Leone recommended the Council instruct Mr.
DeWolf to start designing the second submersive crossing for the
Intracoastal Waterway and the north branch of the Loxahatchee. He
stated this was necessary in case of damage of existing crossing.
Also Councilman Leone requested that Council should determine the
geological area covered by the Village water system which is needed
to plan and design the water distribution system and treatment facility.
The Water Committee instructed Mr, DeWolf to contact PaLn Beach and
Martin County to help determine the population density in the area
where the Village provides water.
Councilman. Little stated he-would like to make a motion
to transfer funds from one section ofplanning in Tequesta Park to
pay for a second tennis court, Councilman Leone suggested it was a
good idea but he felt the Recreation Committee should request the
transfer of funds, Councilman Little withdrew his motion and
instructed Mr. Preston to meet with the Recreation Committee before
next Council meeting. Counci Lean Little also called on Mr. Preston
to give Council information about the lot east of the Village Hall.
Mr. Preston stated it would cost approximately $350.00 with the help
of .the Garden Committee to improve its appearance and was told to have
it done.
Councilman Shay wrote Memo X12 and #13, subject Loxahatchee
River Environmental Control District ~ s sewer construction program
and Bridge Road drainage to be discussed at a later date when prices
are obtained for installation of french drains. (Memos attached to
minutes).
Mr. Harp then read a resolution adopting the right-of-
way map proposed by the Palm Beach County Comemission thoroughfare
plans related to Old Dixie Highway within the Village of Tequesta
limits,-running north from the south Village limits to the Village
limits on the north and provides that no building permits be issued
for building within the proposed right-of-way.

• Motion by Shay, seconded by Leone and unanimously passed
that the resolution adopting the right-of-way map be accepted as
written on first reading.
Mr. Harp stated the resolution would be published and
the second reading would be held at the regular Council meeting on
February 12, 1974.
Mayor Russell then read to the Councilmen the date for
the Village General Election which is Tuesday, March 19, 1974, with
the polling place being the Village Hall and the polls remaining
open from ?:00 A.M. to ?:00 P.M. to vote for CounciLnan Seat #l,
Seat #3 and Seat #5 fora two (2) year teen and Seat #4 for a one
(1) year terns. '
Motion by Leone, seconded by Little and unanimously
passed that Tuesday, March 19, 1974 be set for the Village General
Election.
Mr. Butterfield distributed copies of the Village National
Flood Insurance Program deficiencies to all Councilmen and Mr. Cook,
and stated the first ten (10) items must-have an Ordinance to cover
them. (Copy of report attached to mi.nutes).
Mr. Harp then read resolutions pursuant to 0 rdinance
• No. 196, the Lot Clearing Ordinance to find and determine that
certain described property within the Village of Tequesta- are
violating the Ordinance and will allow the Village-Manager to proceed
to correct the violations pursuant to the requirements of the
Ordinance.
[Tpon motion by Leone, seconded by Frank and unanimously
passed, the resolution pursuant to Ordinance # 196, the Lot Clearing
Ordinance was approved as read on first reading. Mr. Harp stated
this resolution would be published and the second reading will be
on February 12, 1974 at the regular Council meeting.
Mayor Russell commented on the unsightly spot along
Seabrook Road, where residents are allowed to dump yard clippings,
and stated that businesses from Jupiter were also using this spot
and asked if there was some way to prohibit non-r~si:dents from
dumping trash in Tequesta.
Mr. Harp stated that the Village of Tequesta received
from Mr. Walter Skinner, President of the Tequesta Voters ~ Taxpayers
Association, petitions requesting a referendum in connection with
two (2) Ordinances passed by the Village Council on December 18, 1973.
The petition in connection with Ordinance No. 215 has 496 signatures,
and the petition in connection with Ordinance No. 216 has 542 signatures.
These petitions were received at 2:45 P.M. on January 7, 1974.
Mr, Cook stated he had seen the petitions for the first
time during the Council meeting this evening and until a further

study can be made by the Village Clerk as to the legality of all
signatures and the petitions are certified to be valid, he could
give no legal opinion at this time. If the petitions are valid,
the Council has sixty (64) days from the date the petitions were
submitted to the Village Clerk, and not more than six (6) months
for the Council to take a vote.
IIpon motion by Leone secoaded by Little the meeting
was adjourned at 10:43 P.M.
