VILLAGE OF TEQUESTA, FLORIDA
The first regular monthly meeting of the Councilmen
of the Village of Tequesta was held at 7x30 P.M,, Nov~nber 13,
1973 at the Village Hall. Co~ci]men present were Messrs: Russell,
Frank, Leone, Little and Shay. Also present were Robert Harp,
Village Manager, Christopher H. Cook, Village Attorney, Police Chief
Henry M. Dusenbery, Gary Preston, Recreation Director and Charles R.
Jonas, Village Clerk.
The meeting was opened with Prayer and the Pledge of
Allegiance to the Flag by CounciLnan Frank.
Upon motion by Leone, seconded by Little and t~nan?~usly
passed., the minutes of the October 23, 1973 meeting were approved
with the verbal changes attached.
Mayor Russell .stated he was sorry that Mr. Karl
Kandell's ordinances for annexation and rezoning from R-1 to R-2
multiple family dwellings could not be discussed. The Public
Hearing held in connection with Mr. Kandell's applications was
not legally published, and any action taken tonight can be subject
. to court action, therefore the Kandell ordinances-will not be
discussed tonight. Vice~tayor Little wanted to~k~w how this error
could happen and who was responsible. Mr. Cook stated-that Mr.
Harp, the Village Manager published the legal notice in the
Outlook in time but later found that the Outlook could not publish
legal ads. The State of Florida states that one must use a local
newspaper of general circulation. The Beacon complained that the
Outlook could not take legal ads, but the time period was not
long enough even though the ad was published twice.
Motion by Frank, seconded by Little and passed by
four (4) for and one (1) against that all Village legal notices be
published in the Palm Beach Fost Times and a notice be inserted in
the local papers. Little voted against the motion.
Councilman Leone stated he was very disturbed about
the ordinances for Mr. Kendall and personally apoligized both to
the residents and to Mr. Kendall. He also-stated that it was an
expensive goof and the Council is subject to criticism. Counci Lnan
Shay stated that he felt the same way.
Mr. Wood asked if Mr. Frank worked for the Palm Beach
Post Times and stated it was a conf lict of interest and a violation
of the Florida laws for Mr. Frank to propose the motion. When
published in the Pa]m Beach Post Times there will be more confusion
to the public because of the many legal notices in that paper. A
local newspaper would better serve the community. Mr. Murphy
stated that ®v'eryone would be happy to go along with the motion if
the notice would be issued in the local paper also.

Mayor Russell recommended that the dates for the
Public Hearing on the Karl A. Kandell Associates, Inc. petitions
and a special Council meeting follow immediately after the Public
Hearing for first reading of the ordinances be held November 30,
1973 at 7:30 P.M. Also a special Council meeting be held for the
second reading of the ordinances on December 18, 1973, allowing
enough time for the legal notice to be .published.
Mr. Peter Baron objected to the dates due to the fact
that some of the residents would be out of town for Thanksgiving
and over to Christmas. He had hopes the dates would be changed
to sometime in January. Councilman Leone stated "just exactly
based on pour statement Mr, Baron is why I am matting the motion
to accept these dates , The pillage cannot do business based upon
personal transactions. We do it for the good of the Pillage!',=and
added "Mr. Baron, your decision to leave the Pillage is yours not
ours".
Motion by Leone, seconded by Little and i~nan;me~l,y
gassed that the dates recommended by Mayor Russell be accepted.
Public Hearing with special council meeting following on November 30,
1973, and a special council meeting on Dece~tber 18,1973.
Councilman Frank stated that the piling of trash on
Tequesta Drive in the road Swale in front of empty lots should be
discontinued by setting up °No Dumping" signs. Motion by Frank,
seconded by Shay that all dumping of trash, grass cuttings and
garbage in the road swale in front of empty lots on Tequesta Drive
be prohibited. Mr. Cook stated that the prohibiting o~ dumping of
trash on Tequesta Drive would have to be by ordinance instead of
by motion. Councilman Frank amended his motion and asked the
Pillage Attorney; Mr. Cook to prepare an ordinance so a vpte can
be taken to prohibit dumping of all trash, grass cuttings. and
garbage in the Swale in front of empty lots on Tequesta Drive only.
Mr. Baron, with great sorrow, resigned as Chairnaan
of the Solid Waste Committee because of the remarks passed by
Mr. Leone.
Mr. Harp reported that Mr. H. J. Woodard of the State
Department of Natural Resources had asked for the location of wells
in the Jupiter Hills Club in connection with our getting approval
for putting in wells in Tequesta Park. We received bids on modifi-
cations to elevated .water storage tanks. Two (2) bids were
received, one fur $14,933.43 from Webb General Contracting and the
other for $25,842.00 from Crabtree Construction Company. All bids
were given to the Water Department Consulting Engineers for review
and recommendations to Council.

Mr. Harp reported that the speed study on SR 707 (Beach
Road) has been scheduled within the next two (2) weeks and the
Village will be notified of the results shortly thereafter. The
Florida Department of Transportation will make the study.
The Village continued asking the Martin County
Administrator about the bridge and road constx~action to be done by
the Kandell interests to handle the traffic from the Little Club
and Riverbend and the road from the bridge south to. County Line
Road.
The Annual Finaaacial Report for units of local
goverr~nent is to be filed with the State before December 29, 1973.
Also the Village Manager's Annual Report was completed and each
Councilman received a copy of this report for the period October 1,
1972 to September 30, 1973. We received our statement from
Nichols Sanitation, Inc. under the new contract, and 128 homes were
on the closed house list of the Police Department. The Vi1la.ge
received credit for these. As of now the Administrative Office
has received only one notice of closed .house. He reminded all
residents that anyone leaving the Village for a period of thirty.
(30) days or longer to please notify the Office, and for their
protection to also notify the Police Department.
• On November 6, 1973 we received a letter from Mr.
A, F. Tolius, Department of Natural Resources, indicating several
additional items that will be necessary to be resolved before their
Department can seriously make a recommendation on the Village's
request to construct wells in Tequesta Park, Installation of one
or more test and observation wells and to run a pumping test in
order to develop deisgn criteria and spacing for wells. The
appearance of the wells is a major concern to the Department of
Natural Resources, who feel chain link enclosures around wells
would not add to the aesthetic view in a public outdoor recreation
area. We have assured the Department that we also are concerned
and will provide adequate landscapi~ag to insure the best possible
appearance. Also a problem has arisen between the Department of
,Natural Resources, the Division of Recreation and the trustees of
titled land holders.
At 2:00 P.M., November. b, 1973 was the time scheduled
for all bids to be in the Village Hall for Beacon Street improvement,
but no one placed a bid for these improvements.
We have been in touch with Congressman L. A. "Skip"
Bafalis, County Commissioner Robert Culpepper and Congressman Paul
Rogers to check if the U.S. Coast Guard Station property can be
obtained by Palm Beach County to be available for use by the
citizens of the northeast part of the County. Palm Beach County
would like an auto inspection station, parks and recreation and
the location of the Jupiter Fire Control District #1 Fire Station
on this land.

S On November 7, 1973 the Councilmen and Mr. Harp
attended a hearing of the Loxahatchee River Environmental Control
District to review the plans to start Phase I of construction.
Letters were prepared for the Salary and Wage Review
Committee and sent to ten (10) municipalities, as requested, asking
for information on their policies. We also received a copy of
"Uniform Guidelines on Employee Selection Procedures" and forwarded
a copy to each member of the Wage and Salary Review Committee
On November 9, 1973, Mr. Peter Baron, Mr. Robert
Hicks and Mr. Harp attended the Palm Beach County Municipal League
meeting held at the Lake Worth City Hall. The agenda was "Solid
Waste Management Seminar" with Mr. John. Garland and Mr. Elmer
Cleveland from the U.S. Environmental Protection Agency and
Mr. John Lamberoto, Manager of the Southeastern Oakland County
Michigan incinerator authority. Various docunnents were obtained
and were sent to each member of the Solid Waste Committee.
On November 10, 1973, our bookkeeping clerk, Miss
Kathleen Hamm was married.
The Village is looking for an assistant Water
Department Superintendent to help Mr. Worth, and a meter reader/
water analyst.
• The PaLn Beach County crews clewed the weeds and
debris from the drainage ditch running between Tequesta and Jupiter.
Since the Tequesta Country Club Association decided to mow their
vacant lots we are now proceeding to review the other areas in
the Village and prepare resolutions for adoption by the Village
Council to provide mowing of lots violating the Iot clearing
ordinance.
Mr. A. W. Butterfield, Building Official, is obtaining
the necessary information and data to make the Village eligible for
flood insurance. When all items are available they will be referred
to the Village Attorney to put into proper form for adoption by
the Village Council.
The Palm Beach County Engineering Department advises
that the traffic light installation at Tequesta Drive and Seabrook
Road will be made between December ? - 15, 1973.
Mr.-Meeks stated the bids were open to the public
and publication of specifications was sent to five (5) bidders. on
the Beacon Street project but no bids were received. He suggested
that the work be combined with Tequesta Drive improvements.
Tequesta Drive is waiting for completion of a traffic study due
sometime in December. We also have to wait for the right-of Hay
from the County for the intersection.

i Mr. Peter Baron again resigned as Chairnian of the
Solid Waste Committee and. stated he bitterly resented the remarks
of Councilman Leone and that he cannot serve under these conditions.
Councilman Leone stated that his remarks were not directed at Mr.
Baron, but that the Village had to function whether the residents
were in or out of town.
Motion by Councilman Frank to accept Mr. Peter Baron's
verbal resignation as Chai roan of the Solid Waste Committee. Due
to lack of a second, the motion died.
Mr. Peter Baron withdrew his resignation as Chairman
of the Solid Waste Committee. Mayor Russell stated he was very
happy when Mr. Baron accepted the Chairmanship of the Solid Waste
Committee because he thought Mr. Baron was very thorough and would
do a good job.
Councilman Leone stated that a meeting of the Water
Committee was held Monday, at 2:30 P.M. Present were Messrs: Harp,
Worth,-Cook, Barnes, DeWolf, Walker and Leone,
1. Altitude valve for the water tank.
Our consulting engineer feels that the two (2) bids $14,900 -
$25,000, are too high. We will now work on a negotiated
contract. The law permits us to do this, if this contract is
still too high we are going to try to do the work ourselves
• using hired labor.
2. Instrumentation of our wells and draw-down monitoring wells.
Our engineers will have the specifications completed this week
and plan to do the instr~ementation ourselves. The monitoring
wells will have to be done by contract, which we hope to start
getting .bids for when specifications and bid forms have been
completed.
3. Tequesta Park area well sites.
We have received approval from the pepartment of Natural Resources
to drill a test well and several small observation wells. The
estimated costs for this work is $500.00 and we hope to have
this work done at the same time we do the drilling for the draw-
down wells.
Motion by Leone, seconded by Shay and unanimously passed that
the Village Manager be authorized to have the test well .drilled
along with several small observation wells in the Tequesta Park
area,
4, Analysis of water pumping information.
Our consulting engineer has requested that the Village
continue ,with the analysis o~ our water pumping information
and hire a part-time employee to do this work at an estimated
cost of $2,000.00. This information is needed to see if our
rate structure is correct and to help plan the improvement
and expansion of our water system.

• Motion by Leone, seconded by Little and unanimously
passed that the Village Manager be authorized to hire a part-time
clerk to continue with the analysis of our water pueaping and water
rate infornlation.
The Natural Resources Department is concerned with
the aesthetic appearance of well sites, We have notified them
that we will submit the plans for these installations to them
for their approval. Submerged pumps might be necessary to
obtain their approval of this matter.
Mayor Russell asked. when the Martin County Little
Club is disconnected from the Village water supply, will there
be any taps available for the residents of Tequesta.
Counci]man Leone stated that our engineers Irnow how
much water is being used and are trying to measure this into
equivalent taps if and when the cut-off is available we will be
able to have the taps but the number of taps has not been determined.
CounciLnan Leone stated that the cut-off for the Little Club is
dormant due to Martin County"s objections that Mr. Kandell"s water
system is not a public utility.
Vice-Mayor Little stated that Mayor Resell and
• himself attended a meeting of the Jupiter-Tequesta Atietic
Association and that they are doing a wonderful Soh and have
over 1000 bays and girls particupating in athletics in this
community.
Tequesta Park was initiated Monday by the residents
of the community and a wonderful time was had by all. The bicycle
path on Beach Road has not been surveyed and Mr. Little asked
Mr. Harp to continue work on this matter.,
Mayor Russell asked about signs for Tequesta Park
and also about rules and regulations. Mr. Harp stated that all
signs have been taken care of with the exception of the Kiwanis
sign, which they are working on. The rules and regulations are
in the hands of the Village Attorney, Mr. Cook. Councilman.
Little stated that the master plans for Tequesta. Park are in the
preliminary stages and when it is finalized it will be brought
to the Council for approval, also a copy of the preliminary plans
will be sent to each Councilman.
Councilman Shay stated that Tequesta"s biggest
problem was drainage and i.n conferring with the Department of
Transportation in Ft, Lauderdale on the improvements on U.S. #1,
the holdup is drainage. Also drainage on Old Dixie and Tequesta
Drive. A meeting is set up with ENCON on November 14, 1973 to
discuss the problems. At the present time there are no rules or
regulations from the State, stating this is E~iCON"s responsibility.

Mayor Russell inquired if there was anptking done
about the sign violations, also beautification of the lot east of
the Village Hall. He recommended that Mr. Preston contact Mr.
John Teare to see if he could help with improvements to .the lot.
Mayor Russell then spoke of the problems the Village
Police were having on the parking problems. After some discussion
he recommended a memoranduam be given to Police Chief Dusenbery,
effective immediately, to issue a summons for any violation of park-
ing vehicles other than passenger cars in the front yard.
Mayor Russell asked about the impact fees, both fire
and Village. He also inquired if EN~N had raised their sewerage
rates and if they did, it is a violation of the sewerage contract.
Mayor Russell then read a very constructive letter
from the Jupiter-Tequesta Chamber of Commerce. (Letter attached
to minutes).
Mayor Russell then spoke of Mr. Lowell Jarrett Jr.
and recommended with the complete support of the Council that if
all facts are true, the building permits be denied.
Mayor Russell stated he had received several
approvals for the Waterway Beach ordinance for special exceptions,
with several against it. Alter some discussion from the floor
about density, changes in ordinance, how many variations were
involved in the special exception and just what was involved in
the changes. Mr. Cook read the proposed ordinance by title only,
which would allow special exception use to construct three (3)
story buildings in R-2 Districts after public hearing and approval
by the Village Council.
Motion by Little, seconded by Leone and unanimously
passed that the ordinance not be adopted.
Mayor Russell then read the Village Manager-s Annual
Report consisting of 45 items that took place in the Village of
Tequesta from October 1, 1972 to September 30, 1973. (Annual report
attached to minutes)
Motion by Leone, seconded by Shay that Mr. Harp be
instructed to write a letter to Mr. John Maioy, Chairman, Pa]m
Beach County Area Planning Board, stating the Village approved the
removal of the oyster bar in the Loxahatchee River.
Councilman Little suggested that anyone not on the
agenda be given a set amount of time of five (5) minutes. If on
the agenda, no time limit or ground rules.

Mayor Russell stated due to ,the energy crisis he would
recom~uend that there be no Christmas lights and to turn off all
lights not needed.
Motion by Little, seconded by Shay and unanimously
passed to adjourn at 13:21 P.M.
