HomeMy WebLinkAboutMinutes_Special Meeting_09/27/1973MINUTES OF THE PUBLIC HEARING OF THE COUNCIII-~N OF THE PILLAGE OF TEQUFSTA, FLORIDA . A Public Hearing was held by the Councilmen of the Pillage of Tequesta, Florida at ?:30 P.M., Thursday, September 27, 1973 at the Pillage Hall. Councilmen present were Messrs: Little, Frank, Leone, Shay and Mayor Russell. Also present were Robert Harp, Pillage Manager, Edward Welch, Pillage Attorney. Mayor Russell stated the Hearing was to add a "Special Exception Use" to the R-2 Multiple Family District classification and at this meeting no action would be taken, this meeting .was to hear residents in support of or in opposition to this matter, The Clerk advised that proper publication of the hearing had been made and the Legal Notice was then read. Mr. Harp then read from the Zoning Ordinance No, 211, Section. 10,3 - Building Height Regulations -"No building shall exceed two (2) stories nor 30 feet in height", also-Section 10.2 - Special Exception IIses - where the Pillage Council may allow planned develop- ment after a public hearing and if in the public interest, also . Section 16,7 - Criteria - to comply with the requirements as set forth. Mr. Archer stated he felt that the voters of the Pillage of Tequesta should have the right to make the decision to change ordinances and felt that a referendum should be brought to the voters. Mr, E1Liott wanted to 1ffiow why the request was being made, is there any objection to the Pillage as it is. Mr. Sylvester stated that the Waterway Beach Condominiums now have three stories and 42 units and all they wanted was to build one more condominium the same as the others so they will not lose the beauty of Waterway Beach Condominiuums. He said a three story building would be no higher than Food-Fair or any two story building on higher ground, that Waterway Beach Conda~miniums sit in a valley and want to have more green space and less units. If they build two stories they would have 42 units, but if three stories the units would. be bigger and less of them, either 30 or 36 units. Mr. Frank asked the people if they were sure of what they really wanted, if there are just two stories that would mean less green space and 42 units, three stories-would give more green space and all the buildings in the complex would be the same. Mr, Baron stated he felt the referendum was the only way to justify the change in the Zoning Ordinance, -2- Mr. Rowe stated that is why they bought in Water~a,y Beach condominiums because of the three stories and were told there would never be anything other than.-three stox~i.es built. Mrs. Jones said it would be the same as when Blair House West was built, aad then Blair House East. It was zoned for R-1 but they got it rezoned to R-2, and if we rezone this property where will it stop. She also said Council 1ffiows how the residents feel about changing zoning and highrises and she feels it is a waste of time to keep holding these meetings, Mr. Moon stated he was. sure that all the residents of Tequesta want are low buildings, no highrises and as far as three stories are concerned, we have enough already. Mr. Spindler stated that the village spent a lot of time getting a committee picked out, a lot of hours getting the new Zoning Ordinance passed and feels if any changes are to be made the people should have the right to vote for it, and it should be submitted to the public . Mr. Bob White wanted to luaow how many parcels of land we have zoned R-2 in Tequesta. The Village Manager then showed the areas so zoned on the map. They are Carriage House ~,rith 16 units, Tequesta • Garden Apartments with 248 units, Whitehall with 36 units, Blair House West with 36 units, Blair House East with 13 units and along Cy~oress Drive there are 28 units and Watenaay Beach Condominiums have 42 units. Mr. White then asked what zoning was adjacent to Waterway Beach Condominiums and was told it was C-1, Retail Commercial and he stated since it was all commercial around the condominiuuas, they should be able to go three stories without any objection. Page 3, paragraph 1 - Mr. Baron requested a referendum to be put to the voters of Tequesta and let them decide the re-zoning. Page 100, paragraph 1 - The unallocated $22,0.00 received from the Federal Revenue Sharing Fund was also, earmarked for recreation. Page 101, paragraph 1 - Councilman Leone then advised that the recommendation from our Consulting Engineers, Gee ~ Jenson stated ... Page 101, paragraph 3 -should be July 1,.1975 A motion vas made b~ Leone, seconded by ,Shay and *~~n;m~usly passed that the Village Manager authorize the Consulting Engineer to design a treatment facility to satisfy the requirements of Chapter lOD-4.02 of the Florida Administrative Code. Councilman Leone-then read three letters which Gee F~ Jenson had sent to (1) Mr. tern. Becker, Palm Beach County Health Department with carbon copy sent to .Central fa Southern Florida Flood Control District, (2) Florida Departffient of Health i~ Rehabilitative Services, with carbon copies sent to Martin County Board of Commissioners and Central ~ Southern Florida-Flood Control District, {3) Central ~ Southern Florida Flood Control District with carton copy sent to Mr. Hang Rodis.
