HomeMy WebLinkAboutMinutes_Regular_09/25/1973MINUTES OF THE MEETING OF THE COUNCIII~N OF THE VILLAGE OF TEQUESTA, FLORIDA The second Regular Council Meeting of the month of September was held at 7':30 PM., Tuesdays September 25, 1973 at the Village Hall. Councilmen present were Messrs: Little, Frank, Leone, Shay and Mayor Russ-ell.- Also present were Robert Harp, Village Manager, Christopher H. Cook, Village Attorney, Police Chief Henry Dusenbery, Gary Preston, Recreation Director and Charles R. Jonas, Village Clerk. The meeting was opened by Mayor Russell with a Prayer and the Pledge of Allegiance. Mayor Russell stated that the residents of the Village in attendance at the previous meetings left the hall a mess and if they are going to use the floor as ash trays there would be "No Smoking" signs posted.- Upon motion by Leone, seconded by Shay and unanimously passed, the minutes of September 11, 1973 were approved with the f~ Mowing changes: Page 96 - The Wage and Salary Rrview Caamnittee was not complete. Mr. Lee Moon should ~ listed and Mr. William Dwyer should-also be added. • Upon motion by Leone, seconded by Shay and ~~,an~m~usly passed, the financial statement for August 1973 was approved. The Water Depar~ent statement was not complete at meeting time, The Village Clerk reviewed the statement for the eleven (ll) month period ending August 31, 1973 which showed the following balances: Revenue Income $ 646.134.59 Expenses 356,606.18 First National Bank ~ Trost Co. 21,788.30 Petty Cash 25.00 Community Federal Savings ~ Loan 20,000.00 Fidelity Federal Savings ~ Loan 17,428.61 Certificates of Deposit 227,000.00 Federal Revenue Sharing Account ~ 20.185.18 $ 306,427.09 The Sinking Fund balance for. payment of principal and interest on bonds for the Village Hall and land was $41.953.43. The Village Manager then reporteel on pay~ent and interest on Village-Hall and land bonds, building permits and revenue received and percentages over and above the last--three (3) years; the meeting with Nichols Sanitation and stated there would be a 30 cent per house increase this year and a 40 cent increase next year with the stipulation that anyone on vacation £or one month ar longer, who notifies the Village Hall and Village Police will be deducted from the charges-for that month and-each month they are away;-the signs for the bicycle path will be installed at the end of the month; the~Water Department report requested by Gee 6+Jenson Consulting Engineers is complete and took 204 hours to complete; the Area Planning Baa rd meeting will be held October 5, 1973 98 9-25-73 - 2 at West Pa]m Beach; Mr. Shay cannot serve on-the Community Appearance Board and also be a Councilman, therefore a letter of resignation from Mr. Shay as a member of the. Community Appearance Board was submitted. Messrs: Harp, Leone, Meeks and Mayor Russell recommended that Councilman Shay replace Councilman Del Ninno on the committee to study the drainage and construction to increase Tequesta Drive to four lanes from U.S. ~#1 to Old Dixie Highway; flood insurance inforniation has been received from HUD,. Washington, D.C. and when a study has been made of the necessary requirements, the Council will receive:a report; a new law called "Roane Rule" states that all ordinances to be voted on must be legally advertised 14 days before a-vote can be taken. Mr. Harp then read three (3) letters, two (2) stating they requested their constitutional rights to vote directly for the candidate of their choice for Mayor. One (1) letter stating the choice of the Mayor to be left up to the Counci]men. Mayor Russell then read a letter from Mr. Roberts signed by sixteen (16) residents of the Village to reinstate the referendum to give the constitutional rights to allow individuals to vote. for their Mayor. Mr. Harp then brought. up the subject of the Pillage having a prosecuting attorney, stating due to the zoning ordinance and occupational license ordinance there is a need for an attorney on certain court days. Mr. Cook said he felt he should not be the presecuting attorney because he wrote most of the ordinances. He recommended Mr. Edward D. Welch of Winters, Brackett, Lord ~ Held • for prosecuting attorney because Mr. Welch knows why each ordinance was written. Mr. Cook stated that Mr, Welch would be happy to do this for sixty (60) dollars per court hearing, A motion by Leone, seconded by Shay and unanimously passed that Mr. Welch be obtained as prosecuting attorney for the Village of Tequesta. Mr.-Harp then. spoke of parking vehicles and warnin tickets the~Police Department have issued. Mr. Cook was asked if Article 19, section 5, would apply to parking, he stated it does not. Mayor Russell said he felt an honest attempt to comply with the ordinance and effectively screening the vehicles and boats by plantixag of trees and shrubs, would be all that was necessary. He asked Mr, Cook if he can legally direct the Police Chief to continue issuing warning tickets but no summons. Mr, Cook stated he can legally do so. Mayor Russell stated the ordinance was written to create a beautiful Village and not to entail hardship on the people. The only way to get the job accomplished was through trial and error. Mayor Russell then recommended Police Chief Dusenbery to continue issuing warning tickets but no summons until the Council can find a better answer. Mayor Russell stated that Mr. Del Ninno was to be present, but since he was unable to attend he would request Councilman Frank to receive the certificate and nameplate in absentia. 99 9-25-73 - 3 Mayor Russell stated that the millage rate-would be set at 3 mills for the year 1973-1974, which would give $12,-000 less in ad valorem taxes. Totals showing estimated income of $794,640.00 with estimated expense in a like amount. He stated the inca~ne included an estimated cash carry-over of $273,500.00 which resulted mainly--from not rebuilding Tequesta Drive and under spending in various other. accounts during the current budget. The 10~ salary adjustment increase is included, $46,440.00 for recreation and $22,000.00 received from the Federal Revenue Sharing Fund. Motion by Leone, seconded by Shay and unanimously passed, the millage rate was set at 3 mills. Mayor Rus-sell then called on Mr. Robbins, Palm Beach County Adult Education Director. Mr. Robbins-stated they were trying to .create a Caaumunity School, the joint effort would include Tequesta, Jupiter, Jupiter Inlet Colony, unincorporated Palm Beach County and Southern Martin County. The Community School would utilize the school year round and until 10:00 P.M. It would cost the Village of Tequesta $2,200. this year or approximately 53 cents per person.. It would not only benefit the school but, the community as well, less.. vandalism, and the students would take pride in their school and activities. Mr. Robbins said they had several calls for evening classes and other course and if the municipalities join together they • can have the community school now instead of waiting ti:l1 next years budget. Councilman Little stated he would ]ike to change the name from recreation to leisure time activities and recommended that $2,200. be drawn from the recreation budget for the community school. Upon motion bJ' Little, seconded by Shay and nnAn;mously passed $2,200. was set aside to start-the co~~n~ty school. The Recreation Director, Gary Preston said he had nothing to add to Mr. Harps report, but would like to receive permission to buy $3,368. of play ground equipment from Hunter Knepshield Co. Motion was made by Little, sea~aded by Leone and unanimously passed that the playground equipment be ordered in the amount of $3,368.00. Mr. Preston then stated he was planning to be in Tallahassee on October 19, to request the State to donate $50,000. without matching funds for recreation. Mr, ftarp-read a list of capital-improvements for Tequesta Park, and stated. that Gary Preston had the biggest office of anyone (The Village Hah) and the cost to put an office on the second floor of the concession stand would be $2,093.30. Motion was made by Little, seconded by Shay and unanimously passed that the Recreation Director's office be started at once in Tequesta Park, Councilman Little stated that the North County First Aid Squad had all the first aid equipment necessary for all police cars in Tequesta and would give training to anyone needing it, and the new North County First Aid Squad Building would be dedicated on October 21, at 2:00 P.M. 100 .. 9-25-73 - 4 Councilman Leone read a letter stating what we needed at our well fields an instr~aneat to ~ installed on each well to show the amount of water pumped, and drilling small wells bedise each well to show draw down at the cost of $30,000. Motion was made by Leone, seconded by Shay and unanimously passed that the ®illage Manager proceed • with having the necessary work done at a cost of $30,000. Councilman Leone then made a motion, seconded by Shay and ,~,an;m~usly passed that Mr. Harp issue a memoraxidnn of ~licy that water taps and building permits be on the-same 90 day basis, if ground is not broken in 90 days both mater tap permit and building permit are revoked. Councilman Leone then read a letter from the Division of Health about adequate treatment, filtration and chlorination on all water supplies required bg Chapter lOD-2.02 of the Florida Administrative Code. The designing and engineering must be done by July 1, 1973. and the Health Department must be notified of a dune table of compliance by January 1, 197. A motion was made by Leone, seconded by Shay and unanimously passed that this study be started. n Councilman Leone stated a meeting with Mr, Kandell and the Water Committee was held at-4:30 P.M., Tuesday, September 25 to discuss removing the Little Club from the Villages water system and • possible sale of the Villages water main, other mains, hydrants and valves in the Harbor Isles subdivision which has been purchased by Mr. Kendall, He stated he was unable to attend the meeting, but a written proposal is expected from Mr. Kendall in this regard in the near future, Mayor Russell stated that the water situation was verg serious, the moritorium was necessary and i.f all the residents of Tequesta could realize just how serious it is they could help to relieve the situation. Councilman Shay spoke on drainage and said he had reviewed the drainage plans prepared for Tequesta. and Jupiter and believed it would be necessary to have proper drainage planned for by a district covering the various municipalities and-two county aareas involved.- Mr. Harp read a resolution requesting that the Board of Comity Commissioners of Palm Beach County continue to maintain and fund the existing and separate Area PlannS.ng Board Director and staff. Motion was made by Leone, seconded by Little and unanimously passed that the resolution be approved and Resolution No. 8-72/73 was thereby adopted. Jupiter Fire Gontrol District No. 1 sent a letter to Mayor Russell-and Mr. Cook regarding impact fees and the Council felt more information was needed. They aisa asked the Vi]lage to donate the land east of the Pillage Hall for a new fire station. 101 9-25-?3 - 5 Mayor Russell stated that he did aot feel the Village could donate what was not completely paid for, and that traffic was so bad oa Tequesta Drive now, there must be a better site, and the land east of the Village Hall was for e~cpansion. Mr. Wendell suggested that Chief Baird stop by his office to discuss the possibility of Martin County and Jupiter Fire Control District using the wane site far their fire .stations. Mr. BandeLl. said he might be able to find a location to donate for this purpose. Mayor Russell said that for several years there has been talk of consolidating Tequesta aad Jupiter and asked for a show of hands from residents present taho voulld like to see this done - the hand count was 97~ against. Gary Preston said that State. Parks.. rules and regulations had been forwarded to the Village Attorney.:to consider as a basis for preparing Village rules-and regulations for the use of Tequesta Park. Page 100, paragraph 1 - The unallocated $22,000.00 received from the Federal Revenue Sharing Fund was also earn~arked for recreation. Page 101, paragraph 1 - Counci]man Leone then advised that the recommendation from our Consulting Engineers, Gee ~ Jenson stated ... Page 101, paragraph 3 - should be July 1, 1975 A motion was made by Leone, seconded by Shay and unanimously passed that the Village Manager authorize the Consulting Engineer to design a treatment facility to satisfy the requirements of Cha~ater lOD-4.02 of the Florida Administrative Code. Councilman Leone then read three letters which Gee ~ Jenson had sent to (1) Mr. ~Jm. Becker, PaLn Beach County Health Department with carbon copy sent to Central & Southern Florida Flood Control District, ~ (2) Florida Department of Health ~~ Rehabilitative Services, with carbon copies sent to Martin County Board of Conunissioners and Central ~ Southern Florida Flood Control District, (3) Central ~• Southern Florida Flood Control District with carbon copy sent to Mr. Harry Rodis.
