HomeMy WebLinkAboutMinutes_Special Meeting_09/24/1973MINUTES OF THE PUBLIC HEARING OF THE COUNCILMEN OF THE VILLA( OF TEQUESTA, FIARIDA A Public Hearing was held by the Counci Lnen of the Village of Tequesta, Florida at 7:30 P.M., Monday, September 24, 1973 at the Village Hall. Counci]men present were Messrs: Little, Frank, Leone, Shay and Mayor Russell. Also present were Robert Harp, Village Manager, Christopher H. Cook, Village Attorney and Charles R. Jonas, Village Clerk, Mayor Russell advised. the hearing of the proposed develop- ment of Mr. Kandell, and. that the hearing was to evaluate the situation and to hear from all residents of the Village for objection or approval. Mr. Harp stated that proper publication of the hearing had been made in the Beacon News. The land in question covers 80 acres with 4,6 acres to be annexed to the Village as co~-ercial. ~~ The land already zoned as R-1 is proposed by Mr. Kandell to be re-zoned as R-2 in order to build condominiums with low density. Mr. Kandell stated that the par-3 golf course would be • semi-private as it now stands, with a 7.02 per acre. density, with 500 units of condominiums and 64 units for single family dwellings. The single family dwellings will have 2000 square-feet and would start at $45,000., the condominiums will have 1800 square feet and will range from $32,000. - $80,000. Mr. Kandell had a traffic pattern designed to direct traffic away from Tequesta Drive. Mr. Kandell then showed slides of his proposed land for development, pictures of the Little Club and several other developments which he owns. Mayor Russell inquired of Mr. Kandell as to plans for the bridge to Countyline Road. Mr. Kandell stated the plans were in the County Engineers hands and bids were being offered for grade and fill and that work would be started not later than the first of the year. Mayor Russell also told Mr. Kandell that Palm Beach County and Martin County had budgeted $25,000. for the improvement of the road. Mr, Kandell stated. they would not begin work until he moves his heavy equipment in and out, so as not to tear up any more of the road, .Mayor Russell then asked Mr. Kandell for a copy of the traffic study from Kimley--Horn of West Palm Beach that was presented by Mr. Joe Pollack. The traffic study was from Seabrook Road to the shopping center, going by way of Countyline Road down U.S. #l, and also down Tequesta Drive. The study shows that a traffic turn lane was needed at U.S. #1 and County Line Road with turn lanes left and right on Tequesta Drive at the shopping center, Old Dixie and U.S. ~1, -2- Mr, Peter Baron stated he would like equal time to ,oppose the re-zoning of Mr, Kandell. Mr. Leone asked Mr. Kandell what would consume more water, single family homes or condominiums and Mr. Kandell replied he thought that it would be the condominiue-s.~~ Mr, Little stated that if most traffic used County Line Road a traffic light would be necessary at County Line Road and Seabrook Road. Mr. Shay asked Mr. Kandell about drainage and if Tequesta had developed the drainage problem that was proposed several years ago; also would it be possible to drain into the holding pond (Mr. Kandell's), and what he proposed to do about the open ditch above Seabrook Road. Mr. Kandell stated he would be happy to allow Tequesta to drain their surface water into his pond and that all ponds drained into one large pond with the overflow going into the River. As to the open ditch, he had made arrangements to have a closed drainage. Mr. Leone inquired about the depth of holding ponds and stated "if they were too deep they would hurt our water table and therefore would not help". He was told each pond would be 7 to 8 feet deep from top of crest. • ~~ Mayor Russell then read a letter from the Tequesta Voters Association of September 18, 1973 and they favor the project if the following provisions are complied with: 1. Development of separate water supply. 2. No permit or usage of water without the Village being satisfied. 3. Location of all buildings in accordance with plans submitted to Council. 4, All condominiums to be sold, no leases or rentals. 5, All feasible traffic to County Line Road. 6, The obligation holds to Mr. Kandell and binds all future owners. Mr. Edwards stated he didn't know how anyone could sign a petition without hearing Mr. Kandell~s plans. Mr. Kandell stated the golf course will be semi-private for at least 6 months and then hopes to make it public due to the PITD ruling from R-2, The first thing to take place if the re-zoning is completed is underground utilities, the par-3 golf course plus clubhouse and holding ponds, then on to condominiums and single family dwellings. r: -3- Mr, Baron then stated hi:S appreciation to Mr, Kandell for his presentation for re-zoning. After a lengthy, speech which was commended by several residents for his fine work in preparing his objections which dwelled on single family homes, highrises, number of people, amount of water consumed, sewerage and drainage, the amount of traffic, safety of children, cost of roads, bridges, etc., and the devaluation of property if they would four-lane Seabrook Road, his final statement was why should the residents of Tequesta pay for roads, bridges and improvements just to put money in the pockets of Mr. Kendall, Mr. Leone requested that all residents direct their questions to the Council as opposed to an individual. Mr. Edwards stated that condominiums take only teenagers. Mr. Zell, 15596 County Line Road stated his property line was 400 feet from Mr. Kandell~s condominiums and he was against the re-zoning and that he was closer than anyone else to the project and, had no sap because he lived in the County. Mr. Baron asked about sewerage and was shown where the temporary plant would be located until such time as they could tie into ENCON. Mr. Edwards stated it was alright for the re-zoning of any property considering the Village took more time reviewing the traffic, water, sewerage, plus .the future of the Village. Mr. Leone stated that at the present time Mr. Kendall had not requested water or a building permit, just re-zoning from, R-1 to R-2. Mrs. Jones asked Council if this property wa:s re-zoned from R-1 to R-2 how many more parcels of land would have to be re-zoned. As far as she was concerned this would be considered as spot zoning. Mr. Sal Mancuso stated he was tired of the hearings on Mr. Kandell~s re-zoning and felt that Council had better jobs to do and that Council had men working very hard on a new zoning ordinance to help control and beautify the Village of Tequesta and if Council doesn~t stay with the new Zoning Ordinance, all efforts were for nothing. Mrs. Jones stated the same property has been up before the Council several times for re-zoning, and she cannot see why Council would allow Mr. Kendall to be heard about re-zoning when Village residents are against it and had been from the start. • -4- A resident asked if there was anything in writing to sap that Mr. Kandell would do what he says and if it was in writing can the Council hold him to it. Mr. Cook stated there was no legal way to hold Mr. Kandell,.l to anything even if plans had been submitted. ' Meeting adjourned at 10:30 P.M. Page 3, paragraph 1 - Mr. Baron requested a referendum to be put to the voters of Tequesta and let them decide the re-zoning.
