HomeMy WebLinkAboutMinutes_Special Meeting_05/25/1973MINUTES OF THE PUBLIC HEARIlVG OF THE COUNCILMEN OF THE VILLA( OF TEQUESTA, FIARIDA A Public Hearing was held by the Councilmen of the Village of Tequesta, Florida at 7:00 P.M., Friday, May 25, 1973 at the Village Hall. Councilmen present were Messrs: Russell,. Little, Frank, Leone and Del Ninno. Also present-were Robert Harp, Village Manager and Clerk and Christopher H. Cook, Village Attorney. Also present were three other members of the Zoning Review Committee, Messrs: Corddry, Darcy and Hutchison. Member E. L. Sandberg was out of town. Approximately fifty-five (55) interested persons attended the Hearing. Mayor Russell explained the work that had been done by the Committee and stated the Hearing was being held to present the proposed new Zoning Ordinance to the Village residents prior to action to be taken upon it at the scheduled May 28, 1973 Special Council Meeting. He also spoke about the Hearing last night. He advised that the Hearing was being held to consider the proposed new Zoning Ordinance and to consider changing the zoning classifi- cation of the television antenna and well field site on Old Dixie Highway from C-3 to C-2. Maps of the existing zoning areas were on display. Correction sheets for the printed ordinance were handed out. Mayor Russell further advised that the Hearing had been duly advertised and that all property owners within 500 feet of the proposed zoning classification change had been sent letters advising • of same. Mayor Russell stated the Ordinance would be reviewed page by page with discussion on any part to be held when that page is reviewed. Mr. Roger Fulling said he favored the ordinance as discussed at last night's Hearing and favored a maximum height of sixty-five (65) feet in the R-3 area. Mr. Cook reviewed a new "building line" and "setback line" definition as discussed last night. The definition of 'front yard" on page 9 was changed by adding "and also includes all the area between the front building wall and the street line". Section VII-4, page 11, was discussed and Mr. Corddry stated this refers to Districts R-lA and R-1 and it was agreed to delete the item. The Village Manager advised that the section which prohibits buildings, structures of any type and parking of other than passenger automobiles in the front yard would prohibit fences, walls, etc. 5-25-73 - 2 • Section 10.4 (3), page 17 was discussed and it was decided to limit the number of units per acre by adding to the section "but in no event shall the overall density exceed thirteen (13) units per acre". .Captain Coleman questioned what is a "lot" and a "lot of record" and the definitions were referred to. Mr. James Weber, representing Mr. Melehan and Mr. DiVosta again objected to the height restrictions being placed at sixty-five (65) feet in the present R-3 District in the Village. Mr. Bill VonMeding, speaking for his mother, a resident of one of the Beach Road condominiums, urged the Council to limit heights to a maximum of sixty-five (65) feet on the Island. Mr. Ellis Simmons suggested the possibility of an initiative referendum by the electors, if a height greater than sixty-five (65) feet for the R-3 areas be adopted, Mr. Karl Kandell suggested a height of one-hundred (100) feet would be necessary to make property owners on the Island want to be annexed into the Village. Mr. Weber stated there were only two (2) R-3 lots in the Village at the present time and that the County would possibly permit buildings as high as twenty (20) stories. He suggested that the height should be controlled by densities and suggested the Council work out a compromise with his two clients for. their properties. Mr. DiVosta advised the Hearing that the Fire District had told him that his building under construction was meeting every requirement of . their latest Fire Code. rir. Weber further discussed accessory build- ings, parking garage, covered parking, fire walls for garages, etc. Mr. Hutchison, a member of the Zoning Review Committee said he favored open parking for cars that could not be parked under or within the main building in some manner, Mr.: Weber suggested allowing architect- ural flexibility in parking requirements and much of it would be controlled by the Community Appearance Board. Councilman Frank stated he favored ten (10) stories and 100 feet height maximum in the R-3 area. Section 11.5, page 21, pertaining to the location of air conditioning compressor units was changed by adding "with flat roofs". The remaining pages of the proposed ordinance were reviewed with changes being brought to the audience's attention. Item i6.1 (11), page 42 was amended by adding the words "for temporary living purposes" after the word "erected". The suggested additional ~rding of the Committee on page 4$ "in matters involving Districts C-1, C-2 and R-3" was not added to the ordinance, The Attorney is to prepare additional wording for Section 22.2, page 52 as to notice by the Village of violations. All changes discussed at both Hearings are to be incorpor- ated into the final document by-the Village Attorney for reading Monday night at the Special pleeting, • 5-25-?3 - 3 There being no further business, and the entire ordinance having been reviewed and discussed, the Hearing adjourned at 11:25 P.M.
