OF THE VILLAGE OF TEQUESTA, FLORIDA
The First Regular May Meeting of the Councilman of the
Village of Tequesta was held at 8:2? P.M., Tuesday, May 8, 1973 at
the Village Hall. Councilmen present were Messrs: Russell, Little,
Frank and Del Ninno. CounciLnan Leone was not in attendance due to
being out of town. Also present were Robert Harp, Village Manager
and Clerk and Christopher H. Cook, Village Attorney.
The meeting was opened with Prayer and the Pledge of
Allegiance to the Flag by Mayor Russell.
Frank moved seconded by Little that the minutes of the
April 24, 1973 Regular Meeting and May 1, 1973 Special Meeting be
approved. Mayor Russell advised of a communication from CounciLuan
Leone indicating an error in the April 24, 1973 minutes. He said
he did not say "but would approve election at large for Mayor".
Councilman Frank stated Councilman Lu ne had made the statement.
The motion and second were withdrawn and approval is to be withheld
until Cvunci]man Leone is present.

Mager Russell read a report from Councilman Leone ern a
Water Committee Meeting held Monday, April 30, 1973, which included
a recommendation to drill a 300 foot deep test well at an approximate
cast of $1,000. - $1,200. for the purpose of reaching the Hawthorne
Formation (salt intrusion area). The well would be drilled on the
Kandell property along the FEC Railroad right-of way. Frank moved,
seconded by Del ATinno and unanimously passed that the Village Manager
be authorized to have the 300 foot deep test well drilled.
Vice-Mayor Little advised the matter of the Niwanis Park
sublease was expected to be on the agenda for the May 15, 1973 State
Cabinet Meeting, The Village Attorney advised he had received word
from Mr. Tolius on the re~xording of Section 2 to state "compatible
with" and had received a copy of the 1968 lease which he had reviewed
and which did not effect the ..proposed sublease. He advised Mr.
Tolius of the Villages approval by Air Mail Special Delivery letter.
Counci Lean Del Ninno mentioned the poor condition of the
Tequesta Drive, Old Dixie Highway intersection. Since the install-
ation of the traffic signal, westbound cars were turning around cars
making left hand turns and breaRing up-the pavement. He hoped to
set up a meeting with the Village Manager and County Commissioner
Culpepper to discuss this problem.

Mayor Russell advised of the Map 1, 1973 Special Meeting
at which the Zoning Ordinance was given the final review and the
Village Attorney was in the process of rewriting the final document.
He further advised Public Hearings on the proposed ordinance are
scheduled for ?:00 P.M., Map 24 and 25~ 1973 at the Village Aall
and copies of the Zoning Ordinance will benavailable, at cost, at
the Village Offic® for anyone who wants to purchase them, starting
Map 18, 1973. Mayor Russell called a special Council meeting, and
the Councilmen concurred, for 7:30 P.M., Monday, Map 28, 1973 for
the purpose of acting upon the proposed new Zoning Ordinance and to
act upon the requests for re-zoning of the Kandell and DiVosta
properties which were heard at the Map 8, 1973 Public Hearing.
Councilman Frank asked the Village Attorney if he could have a
revised zoning ordinance ready for the special meeting Map 28,
1973 in the event there should be changes after the Public Hearings
and Mr. Cook said he could. Mayor Russell introduced Mr. Bob Jonas
who has been hired as the new Village Clerk.
Mayor Russell advised of his attendance at the last
Loxahatchee River Environmental Control District meeting at which
arrangements were made for the transfer of the Village's Sewer
Plant to the District. The Village Attorney advised the necessary
papers were expected to be ready for signatures May 22 or 23, 1973.
Mr. Cook then read a Resolution providing for the transfer of the
• sewer plant to the Loxahatchee River Environmental Control District.
Paragraph 2 was changed to read "The agreement shall provide for
a sales price based upon cost paid, interest on the Bonds to
June 1, 1973 and $10,0. to cover the Villages expense., The
District will assua-e all obligations of the sewage system including
all agreements for which tap fees have been prepaid". Paragraph 4
was changed to read "--District will establish the same rates for
the sewage system now being charged". Paragraph 7 was changed to
read '!---All tap fees which have not been expanded and all other
funds in the Village's operating account upon the date of the
transfer". Del Ninno moved, seconded by Little that the Resolution,
as corrected, be approved. The motion passed unanimously and
Resolution No. 4-72/73 was thereby adopted.
Mayor Russell requested the Village Attorney to look into
the Village's position in the event Jupiter Inlet Colony would sell
their water rights in Martin County to the Village and Jupiter would
not. He further spoke of delays in a meeting with representatives
of the PaLn Beach and Martin County Commissions to discuss moving
ahead with improvements to County Line Road.. The Village Manager
advised that letters advising of the moratorium had been sent to the
various building departments affected.- The status of the 30 MPH
Speed Limit signs for Tequesta Drive and Country Club Drive; letters
to various property owners on Beach. Road in ,the County area request-
ing they post their properties to assist the Sheriff's Department
in policing the area. Asked for suggestions for members of the
Community Appearance Board; heave load tax ordinance, signs and a
report on Federal Revenue Sharing Fund for next Cohncil Meeting.

Councilman Little spoke of an apparent loophole in the
moratorium ordinance which allows private wells to be drilled.
Mr. Cook advised that if the Water Department Consulting Engineer
and the Geological Survey would state that the underground water
supply is inadequate, this would be a basis for prevexYting`~he
drilling of grivate wells. The Village Manager advised the Water
Committee had this matter under consideration.
The Village Manager advised of the request of the Fire
Control District for the Village to adopt their dire Prevention
Resolution No. 3. He further advised that Jupiter had adopted
Section 3, Paragraphs A, B and C of the Resolution. He then read
an ordinance providing for the adoption of Section 3, Paragraphs
A, B and C of Fire Control District Fire Prevention Resolution
No. 3. Frank moved, seconded by Little and unanimously passed that
the first reading of the ordinance be approved.
The Village Attorney advised he was about half way through
typing of the Zoning Ordinance and the Counci]men approved new
Sections 16.3 j,k and 1, to be inserted in the ordinance.
Councilman Little state8 he liked Mr. Kandell~s proposal
for Seabrook Road development as against the 196 single family
home development.
Little moved, seconded by Russell that action on consider-
ing the re-zoning of the Kandell and DiVosta properties be tabled
until the status of the water supply can be determined and until
the proposed new zoning ordinance is adopted. Councilman Del Ninno
said he favored withholding action until the zoning ordinance is
adopted which the Tequesta Voters Association and Tequesta Gardens
Apartments also agree is the proper course of action. Mr. Cook
said a written document from Kandell and DiVosta setting forth the
type of development to be built would not be a valid document and
could be considered as spot zoning. Mx. Kandell said he would give
his written consent to abide by the terms of the new Zoning
Ordinance should it be passed. Mr. Cook said this was a questionable
procedure and will review same to see if it is possible for the next
Council Meeting. Councilman Del Ninno said he prefers the Kandell
proposal over 196 single family dwellings. It was decided to include
resolving the Kandell and DiVosta zoning, as previously stated, at
the May 28, 19?3 Special Council Meeting. Various members of the
audience continued to discuss the Kandell, DiVosta zoning ,request
with the general feeling being to withhold action until the new
zoning ordinance is passed and adopted. The Village Attorney
stated the Council could. not take action on the requests conditional
on whether or not the new zoning ordinance passed. Mr. Peter Baron
made an emotional plea for the Council to deny the requested R-2
Zoning.

The Village Manager discussed a gift of 12 trees from the
Chamber of Commerce to be used for beautifying business district
rights-of way. Ae said they would probably be planted in the Bridge
Road area right-of-wag. He advised that the Tri-Community Library
Association, Inc, had been dissolved and that Mr. Harrg Gifford, Jr.
had been the Village's representative on the Board. He advised
that Mr. Robbins of the Adult Education Department of the School
Board was holding a meeting at ?:30 P.M., Friday, Map 11, 1973 at
the Jupiter Town Hall regarding the Community School Program.
The Councilmen are invited to attend. The Village Manager confirmed
a meeting of the Village Councilmen with the Jupiter Commissioners
at 7:30 P.M., Wednesday, Map 16, 1973 at the Village Hall to discuss
a water franchise and well field sites. The Village Manager advised
that the Palm Beach Countg Planning and Zoning Board will present
the Countg Land Use Plan at 8:00 A.M., Wednesday, May 2,3, 1973 at
a coffee at the Royal Lion Restaurant and all interested persons
are invited to attend.
Upon motion by Little, seconded bg Del Ninno and unanimously
passed, the meeting was adjourned at 10:15 P.M.
