MINUTES OF THE Pt1BLIC HEARING OF THE COUNCILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA A Public Hearing was held by the Councilmen of the Village of Tequesta, Fi©rida'at 7:00 P.M., Tuesday, May B, 1973 at the Village Hall. Councilman present were Messrs: Russell, Little, Frank and Del Ninno. Councilman Leone had reported he would be out of town and not able to attend the Hearing. Also present were Robert Aare, Village Manager and Clerk, and Christopher H. Cook, Village Attorney. Mayor Russell welcomed the large audience in attendance and advised that the Hearing had been duly advertised with letter notices having also been sent to all property owners within 500 feet of the various areas stated in the advertisement of the hearing. The Mayor read the Notice of Public Hearing which stated the Hearing was being held to act upon the requests of Kandell Associates, Inc. and Di9osta Construction Company for a change in zoning classification for their described parcels of land from R-1 to R-2 zoning classi- fication and to determine a zoning classification for a parcel of land owned by Karl A. Kandell Associates, Inc. which was recently annexed to the Village. Mayor Russell asked Mr. Karl A. Kandell to present his request to be followed by the other matters. Mr. Kandell stated he believed it would be better to discuss all of the matters together since he and Mr. DiVosta"were going to work together to • plan for the two developments but with no monetary interest between the two parties. Mayor Russell concurred in discussion of the matters together. Mr. Kandell reviewed the projects stating he believed their plans to be more harmonious and a better traffic plan than all single family dwellings for the area. He showed the land plan for the entire-area and said it would include 101 single family lots, "330 multifamily units, with his (Mr. Kandell~s) multi- family units to be rental units. They propose to use maximum open areas with density of 3.4 units per acre for single family and 8.? units per acre for multi-family areas. He showed the relation of the proposed. developments to Tequesta Garden Apartments on an aerial photo. Ht said it was approximately 1/3 the density of Tequesta Garden Apartments; discussed possible future railroad cussing and extension of Cypress Drive north. He said he and Mr. DiVosta were requesting R-2 zoning for all of their properties now under discussion. Mr. Little asked Mr. Kandell to define units per acre. Mr. Kandell said each building would contain 10 apartment units with 35 buildings for a total of 350 units. Mayor Russell read the proposed project densities and asked about proposed traffic flaw and Mr. Kandell indicated it would probably be from the developments south to Tequesta Drive, with a possible alternate route xw1'th to County Line Road and east to U.S. No. 1. :Councilman Del Ninno asked the size of the lots and was advised they would be 110 feet x 120 feet. Mr. Kandell spoke of a drainage holding pond to be constructed in the southwest corner of-the property on the south line more thaa 100 feet north of Tequesta Garden Apartments. Various -bers of the audience asked questions to define various zoning areas such.as R-lA, R-1, R-2 etc, Others 5-8-73 - 2 • spoke of densities and in opposition Kennedy wanted to know what would pr ing the maximum allowable units per approved, Mr. Sandberg read a lette Tequesta Gardens Association urging action of the requests until after t: passed and expressing their oppositi~ R-2 zoning requirements. Mr, Sandberg said the new Zoning Ordinance is passed and adopted. Mr. Kandell said the developments will fall within the new zoning requirements. A question was asked what was being done to relieve the traffic from the Martin County area to .Tequesta Drive and Mayor Russell advised of Mr. Kandell's work in building a bridge and road to County Line Road. Mr. Kandell said he had a $250,000. Bond with the Martin County Ccunmission for these projects and thinks both Counties will work together to provide for the necessary widening of County Line Road. Upon question, the Village Attorney advised that the Council is entitled to a reaonable time to study the applications after the hearing tonight. The question of water for the developments was discussed and the Mayor advised both owners and others had offered the Village well field sites. It was suggested that approval be contingent upon source of adequate water supply. Mr. Kandell stated his mortgage company was demanding that he proceed with development of the property but he preferred to develop as he proposed and not all single family dwellings. Several members of the audience stated we should not be concerned about the financial matters of Mr. Kandell in this regard. Mr. Kandell advised that he always builds to the plans as approved in any of his development areas. He advised that he will donate Seabrook Road to Palm Beach County who will pave the road. He stated the Loxahatchee River Envirornmental Control District has the control over surface drainage, and how it is to be handled including subsurface drainage and settling pond areas. Mr. Simms asked why Mr. Kandell could not wait until the new zoning ordinance is adopted' Mrs. Linda Mates asked to have a comparison between existing and --- proposed densities for R-2. Others protested the drainage settling pond and again said action should be withheld until the new zoning ordinance is adopted. Mr. Edwards of Tequesta Garden Apartments asked why should the decision have to wait upon the adoption of the new zoning ordinance. Mr. Kandell said his only option would be to build 196 single family dwellings or sell the land if the, request -- was not granted.. Mrs. Kennedy said this is .the third zoning hearing which the residents have attended to protest condominium developments on the subject properties. The audience was advised the people will be advised the date the Council expects to act on the requests, 5-8-73 - 3 Councilman Little said he favored presenting a resolution on the matter tonight and objects to water source with Village water as it is todap. A Mr. Carl Johnson objected to 196 single family residences. Mr. M. T. Montefusco, President of the Country Club Point Property Owners Association presented a petition with ?8 signatures from that area, stating they were unalterably opposed to any zoning change from R-1 to R-2 on Riverside Drive north in the Village of Tequesta.
