MINtiTE,S OF THE MEEPTNG OF TAE GODNCIiMEN OF THE PILLAGE OF TEQUESTA, 'FIARIDA .The second Regular April Council Meeting of the Counci]~nen of the Village of Tequesta was held at 7:30 P.M., Tuesday, April ?~, ].973 at the Village, Hall. Couaci]men prese~~ rears Messrs: Russel]., Little, Frank, Leone and Del Ninno. Also present were Robert Harp, Village Manager and Clerk and Christopher H. 'Cook, Village Attorney. The meeting was opened with Prayer and the Pledge of Allegiance to the Flag by Vice~iayor Little. Upon motion by Frank, seconded by Del Ninno and unanimously passed, the minutes of the April 10, 1973 meeting were approved. Bpon motion•by Frank., seconded by Leone and unanimously passed the financial statements forl~arch 1973 .were approved. The Water Department statement was-not co~plete at meeting time. The Village Manager reviewed the statement-for the six (6) month period ended March 31, 1973, which showed the fo]].owing balances: First National Bank and Trnst Co. $ 61,_397.10 Petty Cash 25.00 Commm-ity Federal Savings and Loan 20,000.E Fidelity Federal Savings and Lean 17,212.71 Certificates of,Deppsit 224,000.00 Federal Revenue Sharing Savings Acct. 12.511.44 $ 335.146_75 ~_ The Sinking; Fund balance for:paymeat of principal and interest on bonds for the Village Hall, lead and sewer plant was 33 725.78. Cougci7man Frank reported that Beacon Street condemnation proceedings had been filed; no progress on a n~ work ordinance; new VOT stickers are available at the Police Depart~aent; need to appoint a roads .and drainage chai~nan; annexation during the ra~x~atorite~+; Charter. Revision to have..~fiayor,eleated for one (l) year ~g electors and to appoint his ~ice~iayor.` Elected Mayor would've fifth membeir of Council. C~unci~atl Del Ninno said he thought th~a` revision should include pPOVisians.for:district presentation and.Mayor at. large elected for two year terms Caunci]man Leone said he was ~y~z_~3 ~~}~r r~ apposed to the revision as stated ' but would grefer it to reman'a~ it is Mow under the existing Chatter. ~ice~iayor Little said,~the Mayor should be elected and there should be a ward or„district representation. The Village Attorney was advised to prepare the'necessar~r°documents to provide for a Charter Revision Referendum ia'time that any changes -~ c~o~ld be effective at the-1974 Village Gemeral Election. 45 4-24-?3 - 2 Couneilman Leone reported ENCON was finalizing actions far acquisition of the Villages sewer plant and was optimistic that the ENCON Board world approve this coming Thursday or at a special meeting. Connci]man Leone moved, seconded by Del Ninno and unanimously passed that the Village Water Committee be as follows; William E. Leone Ed Barnes Donald L. Osha James W. Worth Robert Aarp Be reported on a meeting of the Committee Monday during which they discussed-how to get n~re volume; ask voluntary reduction in use of water during dry spoll; plans to build a pilot aerator-for well field No. 2 to see if iron could be removed in this manner. Plant would cost an estimated $1(10,000. and take a year to construct. He further reported a recording pressure gauge had been installed on the water main on Beach Road. Re suggested the need for adequate booster systems is the existing high rise buildings; that Kandell was to start drilling test wells on his property on Thursday and that the Inlet Colony was agreeable to se173ng their rights they had in a well field with Jupiter to the Village for their cost of about $2,500.00. The Village Manager is to write to both the Inlet Colony and Town of Jupiter advising them that the Village would be willing to buy their water rights is their well field in Martin Couirty for their costs, or about $5,0.00 total.. The Village Attorney is to adeise where the Village stands in this regard if they would buy the Colony~s rights but could not buy Jupiter~s. 8e spoke of reverse osmosis as being expensive and again suggested a voluntary curtailment of water usage. Mayor Russell said other areas were having water problems. The matter of not using water system water for lawn sprinkling was discussed and the Water Committee will study this matter. C~nncilman beon® spoke of the comprehensive water study to be completed by the .engineer in about 60 days;. the defining of a water service area and that ENCON would probably sell bulk water to various systems in about six years. The Mayor asked the Village Manager to write to Inlet Golo~y and Jupiter re: sale o~ ~heir~water rights to the Village providing the water was still a good potable source of supply. Mr. Joseph Blizzard stated Village water should not be used for lawn sprinkling. CounciLoan Leone said the drilling of many small wells for lawn sprinkling might affect the drinking water. by a drawing down on the water supply'and wants to check this matter. Various .other persons spoke shout water, wells, etc. Vice-Mayor Little spoke of the Kiwanis Park sublease that had been received. Little moved, seconded by Leone and unanimously passed that the sublease be approved subject to the Village Attorneys approval of the lease ofter getting a copy of the January 23, 1958 lease and reviewing same. agd being advised of the meaning of the language in Section 2. At the request of Rev.. James Resnick for help in watering now at ,the Park, the Village Manager advised he would have the maintenance men water as needed, Mr. Little reported that action oa a Recreational Director was awaiting the apprnval of thesnblease b~* the State Capinet, hopefully on May 15, 1973. He reported on the STPO meeting April l6, 1973 at the High School at which he represented Mayor Russell. Mayor Russell appointed DeI Ninno as Chairman of Roads and Drainage; asked about the status of the traffic signal installation at Tegnesta Drive and Seabrook Road; East-West Road meeting with Falm -Beach and Martin Comity Commission Representatives. Mayor Russell suggested the Village be completely opposed to redistricting, Prank moved, seconded by Little that the Village go on record now as opposing any redistricting. The Village Manager was asked to ptar~ so~i.d wa~te_program in the County. The Mayor spoke of a request from the Zoological Society for the County to fund their program and work on signs. He reviewed the April 20, 1973 meeting with the Village Manager, Police Chief and Sheriff Heidtmnn in regard to alleged _ problems in the Cou~rty area of Beach Road, anggested posting of property by property owners. He spoke of Riwans Park as a possible site for wells after .the park lease has been finalized. Police Chief Dusent~ry was asked to show the "Help Stop Crime" movie at the 7:30 P.M., May 22, 1973 Conseil Meeting. Agayor Russell spoke of the Public Hearing of the Fire District to act upon Fire Prevention Resolution No. 3 held April l2, 1973 before a very swell audience; petitions from Beach Road peo le for a bicycle path along .4 mile of State Road 70? (Beach-Road and asked the Chief and Village Manager to study Mr. Skinners proposal for as automatic traffic signal on State Road 707 to help stop speeding. Mr. Lafferty asked ~tho the owner of the sewer lines to the Beach and was advised Mr. DiVosta did but E1~CON was acting to obtain ownership of them, ~e also spoke of emergency g~erators for the system is the event of extreme power failures. Mayor Russell read Chief Dusen~ry s recommendation for reducing the speed i;m;t from.35 MPH to 30 MPH on Tegnesta Drive and Country Clnb Drive from U.S. Highway No. l to the Pa]m Beach-Martin bounty line. Little moved, seconded by Leone and unanimously passed that the speed lim;t on Tegnesta Drive and Country Club Drive be reduced to 30 MPH. ' ,, The Council then proceeded to discuss a memorandum dated April 23, 1973 from. the Village Building Official, A, W, Butterfield, to the Village Manager in regard to the application of Ordinance IQo. 207 (Moratorium) to specific situations as detailed in the ipnemoraud~. The Village-Council suggested that ,items covered by 47 4-?A~-73 - 4 item 1 of the memo were approvable by implication; items covered by Item 2 were judgment cases on each individual case and items covered by Item 3 should not be approved since they would increase tl~e loads on-the water system. Mayor Russell called for a show of hands for action of the following after motion by Little seconded by Russell for approval: 1. Wendimere, Phase II Cypress Drive Townhouses Service approved by vote of 3-2 lA. Wendimere Laundry Building Denied by vote Q-5 4. Hart Building 3rd Floor Offices Denied by vote of 2-3 The Pillage Manager discussed the River Edge Clubs problem with getting water service from east of Riverside Drive at Jasmine on Conntp Line Road, that they had started construction and had been talking to the Water Department about how to obtain water service prior to the Moratorimn. The Village Co~mcil denied this request since an application for water service had not been received. Shirley Thorpe snbm~itted her written resignation to the Council in an emotional display, with the resignation to be effective immediately. . Mayor Russell-spoke of the need for long range planning-for the water system. The various building departments of the areas affected by the Moratori~sm are to be advised of-the existing building moratorium. The Village Attorney said the Village has no obligation to provide water in Martin County. CounciLnan Leone stated we have serious water problems which must be resolved before the moratoria fan be lifted. It was suggested that building permit application that had been received prior to the moratori,-=,s~aot~l~;.be ~i~r. The matter`of'one builder purchasing 9 meters for lots he owns prior to the moratorimn was- discussed. The Mayor said he-could not see anything wrong with this since they would have to pay the monthly rates. Orders and install - ation dates of these meters are to be reviewed. The Council reviewed their action in denying the Wendimere laundry building since the meter had been. installed. The original vote was stricken with the concurrence of the proposers and then was unanimously approved. The Vi11a~e Clerk read the .Ordinance. l~pon completion of the reading, Del Ninno s-oeed, seconded by Little agd unanimously passed-that the reading be approved. All Councilmen being present and approving the reading, ordinance No. 208 was hereby passed and adopted on First Reading. The Mayor asked-for recommend- , ations to the Community Appearance Board. The Village Attorney advised that-State Senator Philip D. Lewis was the only one to reply to his letter regarding well fields in Kixani.s Park. The Village Attorney reported that Mr. t~eorge W. Offutt III is deeding his suer lines to the pillage and Mr. Coots will call Mr. Wood, ENCON Attorney, in this regard. The Village-Attorney distributed the balance of the Proposed Nets Zoning Ordinance draft to the Committee members and Councilmen. A special meeting to discuss the proposed Zoning Ordinance was set for ?:30 P.M., Tu®sday, May 1,.1973 at the Village Hall.. Councilman Little read Miss Thorpe~s letter of resignation. Councilman Leone aelvised that ~'• Harry Koch had- asked hiFa to amaounce the Izaak Walton League meeting to be held from 9 -Sat the Holiday-Inn oa PGA ~ulevard, Map 5, ].~73. The meeting was ad3vnraed at 11:40 P,.M, n ffiotioa by Frank, seconded by Del Minna and unanimously passed.
