COUNCILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA
The. First Regular-March Council Meeting of the Councilmen
of the Village of Tequesta was held at 7:30 P.M,, Tuesday,
March 13, 1973 at the Village Hall. Councilmen present were
Messrs: .Russell, Cunningham, Little, Frank and Leone. Also
present were Robert Harp, Village Manager and Clerk and Christopher
H. Cook, Village Attorney.
The meeting was opened with Prayer and the Pledge of
Allegiance to the Flag by Vice-k~tayor Cunningham.
Upon motion by Leone, seconded by Frank and unanimously
passed the minutes of the February 27, 1973 Council Meeting and
the March 5, 1973 Special Council Meeting were approved.
Councilman Frank asked the Village Attorney about the
progress with an ordinance to restrict the hours of work in the
Village and was advised that no further work had been done on same.
The Village Attorney stated he was pursuing the Beacon Street
condemnation proceedings but had run into a problem with an
existing private easement when he was examining titles and was
referring the matter to the appraisers to see if the value of the
parcels of ].and would be reduced. Councilman Frank mentioned a
portable radar gun which the Jupiter Island Police Department has
recently put into use. He mentioned. some comp3aints about the
sodding of a swale on Seabrook Road possibly causing rain water
not to flow properly. He was advised the consulting engineers
were still pursuing possible new sources for water supplies. He
mentioned the Village's participation in the "Help Stop Crime"
program and the Police Department will present a film and present-
ation on the program at the April 10, 1973 Cohncil Meeting. He
mentioned the i-OT sticker program and the fact that unauthorized
persons were Obtaining the stickers and then bringing their trash
into the Dillage, dumping it on trash piles. He would like the
Council to authorize him to discuss the matter with the Police
Chief and perhaps have an ordinance prepared for the use etc, of
VOT stickers. Mayor Russell asked the Police Chief if citizens
arrests were in order and was advised they are but the complainant
must file an affidavit with the Clerk of the Village and appear
against the defendant. The Mayor said a Village resident noted
Jupiter made more arrests last month than Tequesta.
CounciLnan Leone stated he had talked to Attorney Wood
and ENCON would not lose the 6.7 million dollars. ENCON would
probably be able to keep $700,000. with $100,000. earmarked for
the purchase of the Village's plant and it was anticipated that
they could work out a scheduled draw for the remainder of the
funds. The transfer of the Village's sewer plant could quite

possibly be done as of the end of March. He advised that ENCON
now had an office on Jupiter Street and had hired an executive director.
He further mentioned the need for enforcement of signs of builders
and realtors.
Mayor Russell spoke of the Tequesta Association of Voters
candidates meeting last night and the need for enforcement of
ordinances.
Councilman Little reported that no further word had been
received on the Kiwanis Park leases; the recent COG meeting on
recreation and he and Jupiter Cor~unissioner Faucher are to work on
an areawide recreation program. Hiring a Recreation Director is
being withheld until the park lease matter is resolved.
Mayor Russell stated CAG had recently passed two
resolutions in regard tp recreation, one in support of Jupiter
retaining 22 acres for Lighthouse Park and the other that the
goverr~r-ent land on the north side of SR 707 in the Village be
set aside for afire station, auto inspection station and
recreation purposes, with the local governmental agencies to have
first claim on the property before any private interests.
Councilman Cunningham had nothing to report on.
• Mayor Russell asked if we had received any report on
the March 2, 1973 meeting between the Palm Beach County and A~artin
County Engineers at which they were to discuss the East West road.
No report had been received and the Village Manager is to see what
occurred at this meeting. Mayor Russell spoke of the progress
with the proposed new zoning ordinance and asked the Village
Attorney about Council approval of the Comprehensive Plan which
Barr, Dunlop and Associates had done for the Village. It was the
Village Attorney's opinion that it would be best to adopt the
ordinance and the Comprehensive Plan at the same time. He inquired
about the fact that a representative of Congressman "Skip" Bafalis'
office would be at the Village Hall the first and third Tuesdays
of each month to meet with any persons who might have matters to
bring to the Congressman. He asked about the Annual Report from
the Village's Pension Fund Trustee and stated the $150. annual fee
could not be quarreled with.
The Village Manager read a Resolution requesting the
Palm Beach. County Legislative Delegation not to defer the effect-
ive date of January 1, 1973 for 90% BOD removal for sewage treat-
ment plants until June 30, 1975 as proposed by State Representative
Thomas F. Lewis. Cunningham moved, seconded by Little and
unanimously passed that the reading be approved and Resolution
No. 2-72/73 was thereby passed and adopted.

The Village Manager read a Resolution requesting the
Palm Beach County Legislative Delegation to amend the Florida
State Comprehensive Planning Act of 1972 and to re-establish
planning district designations to include in District 10-only
Palm Beach, Martin, St. Lucie, Indian River and Okeechobee
,Counties representing a logical grouping of counties having
similar problems. Upon motion by Frank, seconded by Little and
unanimously passed, the reading was approved and Resolution
No. 3-72/73 was thereby passed and adopted.
Mayor Russell reported that Mr. Graham Corddry, Chairman
of the Zoning Review Committ+es had pre+vided the Village Attorney
with various standards for a Community Appearance Board which is
proposed in the proposed new Zoning Ordinance.
Councilman Little said he--thought perhaps meetings
similar to last ni.ght~s Voters Association meeting should be
held once or twice a year for elected officials to let the people
know what was going on in the Village. He also asked .the Village
Attorney several pointed questions to stress the point that the
Village Council has not and does not do things insslipshod manner
and must have some rational justification for its actions.
The matter of heavy truck loads and speeds on Village
• streets was discussed. 1'he matter of re-routing the truck traffic
was discussed. The Village Manager and Building Official are to
study load tonnages for trucks. The matter of a lower speed
limit on Tequesta Drive was discussed and the Police Chief is to
study and make a recommendation.. A resident of Tequesta Drive
asked about painted markings placed on the roadway recently and
some one had told him Tequesta Drive was going to be widened. The
Village Manager advised the markings were for use with aerial
photography of the area. The matter of parking on the sidewalk
area in front of Tequesta Hardware Company was mentioned and this
will be looked into. A Mr, Murphy asked what could be done about
the regulation of speed on U.S. Highway No. 1 since this commercial
area was becoming more congested; the matter of correcting the
driveways on Tequesta Drive along the bicycle path was discussed
and prices for correcting same will be obtained so that the work
can be done. A problem of motorists not observing the "Right Turn
Lane Must Turn" requirement at the intersection of Tequesta Drive
and U,S. Highway No. 1 was discussed. It was suggested an
additional warning information sign be placed in the area and
the road markings be repainted.
The Village Manager advised of some recent problems
with Court records from Tallahassee indicating that cases had
been handled by the Village Court when they had not been. It
was presumed this was due to computer error. He also mentioned

the new requirement and forms for reporting Social Security taxes
to the State on a monthly basis instead of a quarterly basis.
The Village Manager reminded of the General Election to be held
Tuesday, March 20, 1973 with the polls to be open from 7:00 A.M.
to 7:00 P.M. and that 5:00 P.M., Thursday, March 15, 1973 is the
deadline for voters to obtain absentee ballots.
There being no further business, the meeting was adjourned.
