HomeMy WebLinkAboutMinutes_Regular_02/13/1973MINUTES OF TIC MEETING OF THE COUNCIIJ~N OF THE VILLAGE OF TEQUESTA, FLORIDA The first Regular February Council Meeting of the Councilmen of the Village of Tequesta was held at 7:30 P.M., Tuesday, February 13, 1973 at the Village Hall. Councilmen present were Messrs: Russell, Cuhningham, Little, Frank and Leone. Also present were Robert Harp, Village Manager and Clerk and Christopher H. Cook, Village Attorney. The meeting was opened with Prayer and the Pledge of Allegiance to the Flag by Councilman Little. Upon motion by Frank, seconded by Leone and unanimously passed, the minutes of the January 23, 1973 meeting were approved with.: the date in the third paragraph to be corrected to January 9, not 14 . Mayor Russell ackn~rladged the presence of Mayor White and the Co~:issioners from the Town of Jupiter who were in attendance to discuss the possibility of the Town of Jupiter grant~.ng a franchise to the Village of Tequesta for water service for that part of Jupiter serviced by the Tequesta Water Department. Commissioner Federsen discussed the possibility of the franchise and advised that the Town • of Jupiter and Jupiter Inlet Colony had water rights along the west side of the Florida East Coast Railroad north of the County Linen Road on Iand owned by Teleprompter-Cable Television. Mr. Pederenn " asked if the Village would consider the possibility of the use of the well sites as a consideration for-the terms of a proposed franchise. He also asked if the Village of Tequesta would consider selling then Water Department to the Loxahatchee River Environmental Control Distr~rict? He also asked if the Village did not sell the Department to the District but purchased bulk water from the District, would revenues of the Water Department be used for Village Capital Improvements, etc. The Village Manager reported the Water Department Consulting Engineer reported that one of the two ~2) test wells in the site as mentioned appeared to produce water of similar color and quality of the present wells but the other test well results were not good. The Jupiter Commissioners indicated the joist water rights were transfer- able. Councilman Cunninghaat, suggested the Village might purchase the sites if they are for sale'., Mayor Russell said if the Loxahatchee River Enviroisnental Control District should go into the water business he could not say whether or not he would favor selling the Villa.ge~s plant at cost. He explained that because of the manner in which the sewer plant was obtained, the CounciLsen generally believed that a profit should not be realized from the transfer of the facility to ENCON. He said he would like to see the District get into the water business 100. The Jupiter Commissioners said they would like the franchise to contain an escape clause in the-event the Village should buy bulk water from the District. The Village Councilmen generally'' 23 2-13-?3 - 2 a reed to g pursue the matter of a franchise with Jupiter and the Town of Jupiter will prepare a proposed franchise to be presented to the Pillage Council for further study and consideration. Mr. Harold Eckes, advised the Pillage Council he represents users of the Pillage water systea- in Martin County and would like to discuss the possibility of removing the 25~ surcharge from water bills for these users., The Mayor mentioned the possibility of a franchise from Martin County and the Dillage Manager advised the Pillage had been granted a franchise by Palm Beach County which includes the 25~ surcharge. Mr. John Robertson and Gordon M. Laing, Jr. from the local Jaycee's appeared before the Pillage Council to discuss their March 3, 1973 "Walk For Mankind" which will be a 2D mile walk as shown on a map to the Pillage C®uncil. They asked the Pillage Council for approval for the walk in the Pillage and the route. Upon motion by Little, seconded by Leone and unanimously passed the project and the route were approved. Councilman Frank asked about the status of the re working of the wells and was advised the work was proceeding. The Pillage Attorney advised that he had not had an opportunity to prepare a new- ordinance to restrict the work hours in the Pillage. • Councilman Leone advised of the January 25, 1973 ENCAN meeting and that Mr. Lund had said the District expected to receive a loan for over $6,000,000. within the next several days and that the funds could be used for the purchase of exi.stiag plants. He further advised that the Districts Attorney wanted a detailed inventory of tie plant items to be transferred and the Pillage Manager would prepare the inventory and submit it to the Districts Attorney. It appears that both parties are waiting on the: Attorneys to get together to resolve the necessary agreement for the transfer and that the District said there was no question about their taking over the plant. Mr.. Leone advised that Kandell had made application to the Dists~ict to build their own water system to provide water service for Riverbend and the proposed facility would be Large enough to include the Little Club development. Mr. Leone said the Districts Board discussed the ~llage~s letter in regard to their long range plan for water service for the District and their engineer is to make a preliminary study of the Districtes long range: water plans. He further reported the District plans to control the distribution of water for the District. Mr. Leone said the entire area is generally getting water from the same acquifer and other water aupplies.should be provided as rapidly as possiblet. Mayor Russell asked that we get ENCON~s answer to our letter as quickly as possible. Mr. Thomas Lafferty, President of the beach Road Association asked about the ownership of the sewer lines that service the buildings on Beach Road and was advised they are 24 2-13-?3 - 3 owned by Mr. DiVosta but that the Loxahatchee River Environmental Control District plans to take over-all distribution systems. Councilman Little advised that applications for the positia~n of Village: Recreational Director had been received from Mr. James Sages, of the State Department of Recreation and Parks. He called the Councils attention to the Z1 recommended Kiwanis Parr improvements which had been sutmitted by the Jupiter/T'equesta Athletic Association. The Village Manager advised that the usual annual $1,000.E~O contribution to the Athletic Association had been included in the Villages recreation budget for I9?2/?3. Cunningham moved, seconded by Little that ~1,C0~.00 be contributed to the Jupiter/Tequesta Athletic Association. There was some question by the Councilmen that some of the proposed improvements could be vandalized before the park would come under the control of the Village but it appears the monies available would only take care of the annual preparation of the baseball field prior to the start of the season. The vpte on the motion was 4-1 with Mayor Russell voting against the motion. Mr. Lafferty suggested the Qillage look into the Village conatructisg_ta bicycle path in the right-of-way of State Road ?0? (Beach Road). Planning for the use of the Lutheran Church property will be delayed until the Village Recreation Director can make recommendations for the type of use the area can best be used for. Councilman Cunningham reported that the noise meter had • been received. Chief Dusenbery reported he had taken sample noise levels and evaluated same. Ccaunci:]man Cu~mingham reported a recent letter from the County Engineers office indicated a long delay in improvements to the Tequesta Drive - Cld Dixie Highway intersection, including drainage, and this would delay action ®n improvements to Tequesta Drive. He suggested investing of the funds for this project in Certificates of Deposit. All excess funds are continually invested. Mr. Cunningham stated he believed a lot of the local drainage problems c©uld be solved by pining and using 4u force mains. He asked the, Village Manager to provide him with a map indicating the various troublesome drainage spots in the Village. Mayor Russell inquired, of the status of the Seabrook Road- Tequesta Drive traffic signal and. was advised the County Engineer had been advised to make the installation. He advised he had written to the Palm Beach and Martin County Commissions alwut the necessity of improving County Line Road so it will tie-in with the road-being constructed from the Little Club area, He read a letter of reply from the Chairman of Fire Control District No. 1 in regard to fire hydrants and hydrant rental fees. Councilman Leone said he believes it was each areas responsibility to pay for the annual hydrant rental charge. It was suggested that the various areas be sent invoices for hydrant fees. Mayor Russell asked the..Village Manager to contact Martin County again in reference to the developers heavy load road .tax. Mayor Russell reported oa a recent CUG meeting held to discuss • the Lighthouse Park area in Jupiter. 2-13-73 - ~ r A petition requesting annexation of a parcel of land lying north of the Village Limit and south of Jupiter Cresta, west of Seabrook Road and owned by Karl A. Randall ~ Associates was read. The area was shown on the map. The Village Manager read an ordinance providing for the annexation of the subject property. Cunningha® moved, seconded by Little that the ordinance be approved. Motion unanimously passed. All Councilmen being present and voting for the motion, Ordinance No. 206 was thereby passed and adopted on First Reading. The matter of setting a time and date to hold a public hearing to act upon the request to have the DiVosta property and a portion of Kandell property west of Seabrook Road changed from R-1 to R-2 Zoning Classification was discussed. Mayor Russell said he belie ved action should be withheld until the new zoning ordinance is finalized. Mr. Corddry suggested deference action until the new zoning ordinance is finalized in the interest of providing. better protection for the Village. Councilman Cunningham said he believed action should be taken on the request and moved that a Public Hearing be held at 7:00 P.M., Tuesday, March 13, 1973, seconded by Frantic. Councilman Leone said he would have to defer action on the. matter since the proposed new zoning ordinance was in hand. Councilman Little said we should hold action until the new ordinance was • accepted. The vote oa the motion was 1-4, with Cunningham voting for the motion and all others voting against the motion. Both parties are to be advised of the reasons for the Councils action in this matter. The Village Manager advised that only one bid had been received for a station wagon for the Water Department, that froffi Dick McCulley Ford, in the amount of $2,987.19 which allowed $300.0(1 for the trade-in of a 1969 Plymouth station wagon. The Village Manager suggested the purchase at the gross price of $3,287.19 and selling the 1969 Plymouth at public bid. Cunningham moved, seconded by Frank and unanimously passed that the Village Manager be authorized to purchase a 1973 Ford Torino Station Wagon from Dick McCulley Ford on their gross bid of $3,287.19 and to sell the 1969 Plymouth Station Wagon on bids. The Village Attorney reported that he, the Village Manager and Police Chief had gone to Stuart Monday morning to discuss the policing of Riwanis Park with Martin County Sheriff James Holt, who' agreed to making the Village Police Patrolmen Special Martin County. Deputies for the confines of Kiwanis Park only and this will be accomplished as soon as possible. The Village Attorney reported that data about well sites in the park had been forwarded to the State for their consideration. Mr. Cook advised he was pursuing the Beacon Street project attempting to get an agreement with the two (2) property owners for their ten (10) feet of property prior to filing condemnation proceedings which he expects to file Monday.. Mr. Cook reported he and the Village Manager will appear before the Martin County Legislative Delegation ~o g'hurada~y requesting consideration of annexation of a portion of State Road 707 at the. Bridge and Riverside 26 2-I3-73 - 5 Boulevard. He also intends to present a bill providing for the Legislature to annex several isolated parcels cif land to the Village. Mr. Cook said he will call Attorney Wood about-the progress of the transfer of the sewer plant to the Loxahatchee River Environmental Control District,- He also will look into the dissolution of the Village Court as quickly as :possible. The Village Manager advised of the Conference for City Officials to be held in Jacksoaville; Mayor Whites telegram to the Governor etc. re: the bad condition of the Alternate AlA Bridge; A County Animal Control Ordinance which had just-been received and would be reviewed. He said one of the Village police officers was interested in animal control irk for the Village. The audience was reminded the final day for voter registration is Friday, February 15,-1973 and the Village Office would be opea feom 7-8 P.M. to accept registrations. Candidates for the office of Councilman Seat 2 and Seat 4 can file starting February 19, 19'73 until 5:00 P.M. February 28, 1973. Councilman Little called the Councils attention to a recent magasine article about putting a brick in toilet tanks to conserve water.
