HomeMy WebLinkAboutMinutes_Regular_01/23/1973MINUTES OF THE MEETIAiG OF THE COUNCILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA The second, regular January Council Meeting of the Councilmen of the Village of Tequesta E4~as held at 7:30 P.M., Tuesday, January 23, 1973 at the Village Hall. Councilmen present were Messrs: Russell, Cunningham, Little, Frank and Leone. Also present were Robert Harp, Village Manager and Clerk and Christopher H. Coo, Village Attorney. The meeting was opened. with Prayer and. the Pledge of Allegiance to the Flag by Councilman Leone. Upon motion by Cunningham, seconded by Leone and unan- imously passed., the minutes of the January ]~~, 1973 meeting were approved. 9 ,~'`~'` Upon motion by Leone, seconded by Little and unanimously passed, the financial statements for December 1972 were approved. The Water Department statement was not complete at meeting time. The statement for the three (3) month period ended December 31, 1972, showed the folloiring balances on hand,: First National Bank & Trust Company $ 39,403.26 • Petty Cash 25.DO Coaununity Federal Savings and Loan 20,000.00 Fidelity Federal Savings and Loan 17,001.82 Certificates of Deposit 218,000.00 $ 294,430.08 The Sinking Fund balance for payment of principal and interest on bonds for the Village Hall, land and sewer plant was $28,279.24. Mayor Russell revie~ti*ed the Sewer Department statement ore year. riayor Russell introduced Mr. Graham TJ. Corddry, Chaim-an of the Zoning Reviet4~ Committee who read his transmittal letter with the draft of the proposed new zoning ordinance. Mayor Russell thanked the committee for their work on the project and said therT ~~=ould. be continued in office until such time as the project is completed. Each Councilman received a copy of the proposed new ordinance. The Village Attorney advised he could probably have the ordinance reviewed in approximately six (6) weeks and would retain the services of other attorneys for assistance with the review a.nd. necessary consultations. A review of the proposed ordinance was scheduled for the February 27, 1973 Council Meeting. Councilman Frank asked the Village Attorney the status of the Beacon Street condemnation and was advised he would pursue same. u 19 1-23-73 - 2 • The Village Manager reported that work was expected to continue on reworking of the wells in Well Field. No. 4 about Thursday or Friday of this week. Councilman Leone reported the drying beds and fence had been completed at the sewer plant, that plants would be planted along the fence to screen it in and a bamboo fence would be erected on the west end. to provide more of a screen to the adjacent property. He reported that ENCON should have the necessary funds to assume owner- ship of the plant by mid-February. He also called attention to a recent article in the January 21, 1973 issue of the Outlook on the good reports of the plant operation. Councilman Little said the Village Recreation Committee was willing to help the Village Attorney in any way they could and that the committee had discussed the Lutheran Church Park as a recreational site. The Village Attorney reported the Attorney General had advised him the Village could lease Kiwanis Park and spend Village funds on the park but could not police the park with the Village police officers in their no anal course of duty. He said it might be ,possible to have the officers deputized. by the Martin County Sheriff+s Department, if the Sheriff so desired. Martin County lazti~s would have to be enforced. The Village could pay the police officers, even though they might be Martin County Special Deputies. The Village Manager, Police Chief and Village Attorney • ~,1ere authorized to discuss the policing of Kiwanis Park with the Martin County Sheriff+s Department, He reported he had not heard from the State regarding the leases. Councilman Little said he wants the Village police officers deputized to police Kiwanis Park. The Village Attorney said he believes the Village's insurance covers the police in the +aark now if on official business. Mr, "Bud" Jordan said he would prefer professional assistance in planning any Village recreational facilities, The Village Manager was instructed to ask Mr. James Sayes to provide us with resumes of applicants for the position of Village Recreation Director. Councilman Cunningham asked about the traffic signal for Tequesta Drive, Seabrook Road intersection and was advised the County traffic survey indicated a signal was needed and the County said they could make the installation at a cost of approximately $7,500.00 to be ?paid by the Village. The Village Afanager advised there ~4Fere no funds available in the 1972/73 County Budget for assistance to municipalities for traffic signal installations. The installation ~,=ould be delayed if the Village would want to be considered in the 1973,/74 Budget commencing July 1,1973. Little moved, seconded by Leone that the Village approve the installation of a traffic signal at the Tequesta Drive, Seabrook Road intersection by Pa]m Beach County crews with the cost of approximately $7.500.00 to be paid by the Village to the County from the Village+s Federal Revenue Sharing Funds. 20 1-23-73 ~- 3 The motion passed 4-1 with Cunningham voting against the motion, Councilman Cunningham referred to a letter from Ivir. Karl Kandell to Martin County in regard to the scheduling of comp]_etion of his road from the Little Club to the County Line Road. Cunningham moved, seconded by Frank and unanimously passed that the Piayor write to the Palm Beach County and Martin County Commissioners asking them to expedite the improvements to CountgT Line Road so that they will be ready to accept the traffic coming from the Little Club area. The Village Manager is to write to the County Engineer to find out the status of the drainage at Old Dixie Highway and Tequesta Drive, A recent _letter from Jupiter Fire District Iv'o. 1 suggesting the place- ment of fire hydrants in various commercial areas was discussed. The Village Manager explained. the existing situation in regard to the annual $100,00 charge fer Village hydrants. The Mayor ~,•as asked to t:•rite to the Commissioners and Chief of the Fire District in regard to fire hydrants. Councilman Cunningham announced that he did not intend to run for office since he eras building a home in Martin County and ~,Fould not be able to finish out his term of office. Pia3~or Russell discussed the appointment of a Sign Committee member, Ernest Bryan iti*as nominated upon motion by Cunningham, seconded by Leone. William J. Taylor ~.~as nominated upon motion by Frank, seconded by Little, [.t~illiam J. Taylor was elected 3-2. The • Village Pianager advised he had not had an answer from Aiartin County on his request for inforn-ation on their heavy load tax and will t•~rite again for the information. Mayor Russell said ENCON expected a large loan shortly from the State at a 2~~ interest rate. The Mayor discussed the recent Saturday morning Village tour, The Councilmen all believed that additional trees are not necessary for Norfolk Avenue and the property owners are to be so notified. The owner of the lot next to T~Jhitehall has been notified to get it c]_eaned yap. The Jupiter Tot,m Commissioners have asked to discuss a water service franchise and the Councilmen set the February 13, 1973 Council Pieeting for this discussion. Mayor Russell read a letter from Mr. Cubbins, Golfview Drive about ~,~ater in front of hi.s house. The Diayor checked. it out during the last heavy rain and found many other areas with worse drainage. The F.E.C, crossing paving is to be chec4ced out for its condition. The Village Attorney advised he had not had an opportunity to work on the work restriction ordinance. The Vil.].age Manager advised he had written to ENCON in reference to the possibility of their providing bulk water to the Village. The Village Attorney advised. that Village matters have to go before the Martin County Legislative Delegation now. The Vi]_lage Manager is to have Paul Hardy pick ur the newspapers at the Goodwill and Salvation Army collection boxes. Upon motion by Cunningham, seconded by Little and unanimously passed., the Sewer Department budget for 1973 was adopted. (copy attached. to these minutes} I~ J 21 1-23-73 - 4 The Village Attorney read a resolution providing for the condemnation of two (2) parcels of land on Beacon Street for a road right-of-kTa3T. Frank moved, seconded. by Cunningham that Resolution No. ]_-72/73 be adopted. Motion passed unanimously. Cunningham moved., seconded by Leone and unanimously passed that the First National Bank ~ Trust Company be permitted to construct an addition to their building wit}7 an overall height of 39'6", Frank moved, seconded by Leone that the Village's General Election be held Tuesday, March 20, 1973 with the polls being the Village Hall and open from 7:00 A.M, to 7:00 P.M. for the election of Councilman Seat 2 and Councilman Seat 4, both for two (2) year terms. The Inspectors of Election to be: Mary W. Elliott Mildred Graeff Charlotte P, Kadlec Robert W, Reaney Ruth A. Schlusemeyer John A. Stead It was suggested a sign be obtained to place outside for public hearings. The Village Manager advised. the trustee had. refunded the money to the contributors to the proposed sewer plant expansion since the agreement had expired, They had paid for the engineering fees to date. The traffic signal at Old Dixie Highway and Tequesta Drive etas awaiting FEC approval and should. be in oper- ation shortly, Mr. W. E, Dunham questioned a septic tank in the front of the VanBlarcam house with effluent running onto neighboring property. Village Manager is to check this out, Mr. Robert Sattley of Tequesta Gardens thanked the Village for providing for the installation of the traffic signal. Mr. Hutchison again called Council's attention to need. for a water study. The Village Manager reported the east drives+~ay on Tequesta Drive had been repaired. The meeting was adjourned at 9:20 P.M.
