1 MINUTES OF THE PUBLIC HEARING OF THE COUNCILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA A Public Hearing was held by the Councilmen of the Village of Tequesta, Florida at 7:15 P.M., Tuesday, June 20, 1972 at the Village Hall. Councilmen present were Messrs: Russell, Barr, Cunningham, Little and Frank. Also present were Robert Harp, Clerk and Christopher H. Cook, Village Attorney. The Clerk read the notice of the Hearing stating the Council was going to consider amending sections 7B and 8B "Building Height Regulations" of the Zoning Ordinance to provide that no structure shall exceed two (2) stories and thirty (30) feet in height without permission of the Village Council after a review and approval of the site and building plans; to determine the number of affirmative votes of the Council necessary to allow a departure from the height regulations in the Ordinance and to determine if an absolute limit in height should be incorporated into the Ordinance. The Clerk advised that publi- cation of the notice had been made June 1, 1972 in the Beacon News and Courier; June 4, Jupiter-Tequesta Outlook. Mayor Russell spoke of the various reasons for the Hearing referring to the condemnation of the Council for the three (3) story Hart Building with the Council generally feeling that they should control the heights of commercial property if they are to be held responsible by the people. He further advised of the work being done by the Zoning Ordinance Review Committee. Mr. William Kendrick, President, First National Bank ~ Trust Company read a prepared state- ment from the Bank objecting to an absolute height limit and explain- ing their plans for a three (3) story structure. Various other persons in attendance spoke against an absolute height limit and the Council also discussed Planning and Zoning Boards and Zoning Boards of Adjustment. It was explained the Zoning Board of Adjustment would not be written out of the Zoning Ordinance and would continue to act upon requests for variances but not height variances or special exceptions to height. The Mayor asked the Clerk to read a letter from J. B. Stancliffe taking a position against providing an absolute height limit. There had been no other communications either for or against the items. Tt was the general feeling of the Councilmen that they wanted their vote on any matter in the Zoning Ordinance to be the same as required for all other matters. -2- Mayor Russell said the Council would act upon the Banks request for a variance if and when it would be requested. The Village Attorney said he had several ordinances prepared in this regard far action by the Councilmen during their Regular Meeting, The Hearing was adjourned at 8:0© P.M.
