HomeMy WebLinkAboutMinutes_Regular_01/18/1972• • rffNUTES OF THE MP~TING OF THT: COUr'CILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA The Regular Monthly Meeting of the Councilmen of the Village of Tequesta, Florida ~~as held at 9:00 P.M., Tuesday, January 18, 1972 at the Village Hall, immediately following a Zoning Public Hearing. Councilmen present were Messrs: Sylvester, Barr, Cunningham, Russell and Little. Also present were Robert Harp, Village Manager and Clerk and Christopher H. Cook, Village Attorney. The meeting was opened with Prayer and the Pledge of Allegiance to the Flag by Councilman Russell. Upon motion by Cunningham, seconded by Little and unan- imously passed, the minutes of the December 21 and 31, 1971 Council meetings-were approved. The Village Manager recapped the receipts and disbursements for the three (3) month period ended December 31, 1971. Balances on hand were as follows: First National Bank ~ Trust Co. $ 27,007.86 Petty Cash 25.00 Co~nunity Federal Savings ~ Loan 20,000.00 Fidelity Federal Savings fa Loan 16,172.69 Certificates of Deposit 120,000.00 $ _183,205.55 The Sinking Fund balance for payment of principal and interest on the Village Hall Bonds and Bonds for the purchase of land east of the Village Hall was $21,629.85. -The ti4ater Department statement for the month of Decembers w`as not complete at meeting time. The Village Manager presented his report for the month of December 1971. Building statistics were: December 1971 No . Valuation 38 (~~ houses) 283,890. ^3 (4 houses) 1,111,170. Year to Date No. Valuation 110 (12 houses) 837,175. Last Year 92 (17 houses) 2,985,510. Mayor Sylvester reported on a request for a street light near Beacon Street and Venus Avenue and the request of the Beach Road Condominium Association for additional police protection on Jupiter Island. He spoke of the necessity for sewage plant expansion and of the appearance of the Sewage Department Consulting Engineer and Village Manager before the Board of the Loxahatchee River Envirornnental 15 1-18-72 - • Control District last night to discuss such an expansion. Developers in the area are experiencing hardships because lack of adequate sewage facilities is preventing them from developing their lands. He urged the Council to seriously consider Mr. Kenneth Schmidt~s request for ten (10) sewer taps so he could construct a restaurant on the North side. of Tequesta Drive and said the Council should allow the issuance of a pern~it for the construction of this restaurant. He predicted assessed valuations ~:Tould go down due to lack of growth if expansion of the sewage plant is not accomplished. It eras the general feeling of the Council that no action on any requests for additional sewage service should or could be taken until the consulting engineer submits his report on the advisability of an expansion program. Councilman Barr and the Village Manager discussed the operation of the sewage treatment plant since the Village took over December 28, 1971 pursuant to the tuns of the agreement for acquis- ition of the facility. Mr. Paul Thomson questioned how and on what basis additional taps will be allocated and was advised such deter- mination would have to be made when the Council taas assured additional service Baas available. Mr. George Barlot:r recommended the Council wait for the engineers opinion on expansion and capacity before any action is taken in this regard, Mayor Sylvester suggested the facility should be turned over to the Environmental Control District as soon as practicable. Councilman Little asked concerning the status of the • appointment to the Board of the District by the Governor and ~:*as advised no further action had been taken at this time. Mr. Kenneth Schmidt said the Council must proceed ~ti~ith providing for the gro~~th of the Village and his proposed restaurant would provide much additional revenue to the Village. He said he had been in the area many years and did not t~ant to see it die. He questioned the legality of the Village zoning properties and then not providing sewerage service with a municipal system which is available in front of his property. Mr. Thomson said if individual on-site plants were used by developers, there ~ti~ould be five (5) such plants in the ir,Unediate area of Tequesta Gardens. l~iayor Sylvester said there is a need for additional sewage facilities and if the engineer gives his approval, the Council should proceed at once to expedite the program. Councilman Russell said he believed the engineer could plan for expansion without additional information. Councilman Barr said the Council should exercise expansion and gro~~tth control since good gro~:*th trithout careful planning could not be good. He further stated the Village should not increase pollution in the area. Mr. Schmidt said it ~~aould cost approximately $50,000.00 to expand the plant to meet requested needs. Mr. J. t~. Blizzard suggested ~:~ater usage as a basis, for computing additional. services and suggested storm leakage could, shop, increase flo~:~ through the plant. Mr. Thomson asked if aTl appli- cable governing bodies t~Tould approve an expansion of the existing plant., would the Village Council proceed ~:*ith the expansion? Mr. • Little said he would be in favor as long as other Village residents would be protected in this regard, Mr. Barr said he would go along 1a~ith the expansion if the consulting engineer and approving agencies 16 1-18-72 - 3 would authorize it. Mr. Cunningham said he was in favor of expanding the existing plant instead of developers constructing individual plants. The entire Council agreed that they would like to have the consulting engineers opinion in regard to plant expansion as quickly as possible. Police Chief Dusenbery presented the Police Department and Civil Defense reports for the month of December 1971. Councilman Little mentioned bicycles without proper reflection devices being on the streets at night. Chief Dusenbery mentioned the letter from the Beach Road Condominium Association and his memo to the Village Manager in this regard. Upon motion by Cunningham, seconded by Little and unanimously passed, the Inspectors of Election Certificate of the results of the January 11, ]_972 Charter Referendw~ii was approved and accepted. Upon motion by Cunningham, seconded by Barr, and unanimously passed P~tarch 21, 1972 was set as General Election Day pursuant to terns of the Charter. The election tai]_1 be held for the election of Council- men in Seats 1, 3 and 5 for t~ti*o (2) year teams. The polls ~~~ill be open from 7:00 A.M. to 7:00 P.M. in the Village Hall. Inspectors of Election will be Mary Zd. Elliott, Mildred Graef, Charlotte P, Kadlec, Robert W, Reaney, Ruth A. Schlusemeyer and John W, Stead. The Council acknowledged receipt of Jupiter Inlet Colony Resolution No, 122-71-16. The Village Attorney read an ordinance providing for the Village to adopt the Fire Code of Jupiter Fire District No. 1. Russell moved, seconded by Cunningham, and unanimously passed that the ordinance be adopted. All Councilmen being present and voting for the ordinance, Ordinance No. 190 ~~~as hereby passed and adopted on First Reading. The Village Attorney advised he ~,~as continuing to work on a noise ordinance and other nuisance ordinances. The Village rianager advised of a letter from the Tri-Corr¢nunity Public Library Association advising of Mr. Harry N. Gifford, Jr. 's term on the Board expiring and suggesting his re-appointment by the Village. Upon motion by Sylvester, seconded by Barr and unanimously passed, Mr. Gifford was appointed as the Village's representative on the Library Board, The Village l~fanager advised we were still awaiting the receipt of plans for the bicycle lath and Tequesta Drive improvements from the engineer; that candidates for election must file during the ]_ast ten days of February and that Palm Beach County tax assessor's personnel ~,~ould be at the Village Hall January 31 thru February 4, 1972 to accept applications for Homestead Exemptions. Councilman Russell suggested meetings with the "natural boundaries" but outside the municipal boundaries • annexation. Councilman Barr suggested the Tequesta Voters might be helpful tt7ith such a project. Village's to discuss Association 17 1-18-72 - 4 • Various matters concerning zoning variances and special exceptions under the existing zoning ordinance were discussed and it was the general opinion of the Council that the Ordinance should be re-done by professional people to conform ~•rith the Comprehensive Plan.
