HomeMy WebLinkAboutMinutes_Regular_10/20/1970• MIAiUTES OF THE FETING OF THE COt9NTCILMEN OF THE PILLAGE OF TF.QDESTA, FLORIDA The regular monthly meeting of the Councilmen of the Village ®f Tegaesta, Florida was held at 8:~ P.~d., Tuesday, October 20, 1970, at the Village Hall. Mayor Sylvester welcomed approximately 55 students from the Him School history c]ass who were in attendance. Councilmen present were: Messrs. Sylvester, Long, Cunningham and Barr. Counci]~n Russell was out of tows and enable to attend. Also present were Robert Harp, Village Manager and Clerk and William S. Lord, Village Attorney. The .meeting was opened with a Prayer and the Pledge of Allegiance to the Flag by Mayor Syl~rester. The Village Manager recapped the receipts and disbursements f®r the twelve (i2) month period ended September 30, 1970. Balances on Hand were as follows: First Bank of 3upiter/Tequesta $ 16,066.22 Petty Cash 25.00 • Coas~unity Federal Savings and Loan 19,689.91 Fidelity Federal Savings and Loan 15.191.34 $ fr0.9?2.4? Account Summary: Operating Account $ 5q, 947.4? Petty Cash 25.00 $ 50.972.47 The Sinking Fund balance for pa'ment of principal and interest on the Village Hall bonds and bonds for the purchase of the land east of the Village Hall was $16.634.37. The Water Department statement for nine (9) months ending Septeffiber 30, 19?O, showed total revenues of $203,931.43; total operating expenses of $46,348.61 and debt service requirements of $102,544.00. The Village Manager presented his report for the month of September 1970. Building statistics were: September 1970 Year to bate No. Valuation N.~ Valuation 28 11 houses) $409,455. 318 (76 houses) $3,490,880, • Last Year 31 (15 houses) $770,780. 390 (129 houses) $7,438,357. -2- • The Vil]a,ge Manager also presented his report covering activities of the Village daring the fiscal year October 1, 1959 to September dfl, 19'70. Police Chief Dusenbery presented the Police Department and Oivil Defense reports for the month of September 1970 and for the fiscal year October 1, 1969 to September 30, 1970. Co~mcilman Cunningham reported he was waiting for an engineers sketch for Bunker Place drainage. The Council suggested Mayer Sylvester-send a letter to the Department of Transportation :~11=~: their attention to the amlhber and frequency of accidents on II. S. ~ii.ghway No. 1 in the Village of Tequesta. The Village Clerk gave second reading to an Ordinance entitled "An Ordlllance of the Village. of Tegnesta, Florida, Amending Ordi~nce No. 1©, Concerning Licensing; Regulating and Taxing the Distribution and Sale of All Intoxicating Liquors, Wines and Beverages; Providing for the Transfer of Said Licenses; Prohibiting ~Linors,from Being employed in Bare; Prohibit- ing the Sale or Serving of Iatexicatiag Lignbrs to Minors; Providing Penalty for the Violation of the Ordinance and for Other Purposes". It we,s explained this would permit places serving intoxicating beverages in the Village to remain open on any election day and sell intoxicating beverages to confo~a to the new State haw effective November 1, 1970. Barr moved, seconded by Sylvester that the second reading be approved. Couacilmlea • -Long and Cunningham expressed their opini®n not favoring the chafe since the few hours of closing each year did not seem like an undue hardship on p]a ces selling intoxicating beverages. Councilman Barr stated he believed such p]a,ces of business in the Village should come under the same regulations as those jest outside of the Village who would be able to sell such istoxi- ca.ting beverages on any election day. Attorney Lord stated the Village Council has the right to control such sales. Mayor Sylvester called for the vote on the motion which was: Sylvester -For Barr -For Long -Against Cunningham -Against The vote being a tie, two to two, the second reading of-the Ordinance was not approved a~ the Ordinance was therefore .not adopted. A single bid for the purchase of two (2) new 1971 Police Cars was received from Florida (~rysler Plys~uth. Their bid was a total of $5594.24 net. The total bid price was $89x14.24 less a t©tal trade is price for the two older cars of $350.00. This was considers blp in excess of the estimated cost of $3900.00. The Council did not accept the bid and it was suggested that the Police Chief find. out why the others did not bid and possibly get new bids. • -3- ~L-WSJ t...Tf~ o tj • The Village Manager read an-9rd#nernee which asked the State of Florida, Department of Transportation to select a route east of the Sunshine State Parkway through the Tegnesta-Jupit®r area for Interstate Highway 95 (I-95). The Councilmen were advised a map of the proposed mates would nut be available,to be seen until October 21, 1970. Barr moved, seconded by Long and unanimously passed that the resolution be passed subject to the Council seeing the map of the proposed routes. Resolution No. 1-70/71 was thereby passed and adopted. The Village Manager discussed the "Fl©od Insuunnce" grogram and read a resolution that is required by the Federal Insurance Administration HIED to have the insurance become effective together with other requirements. Barr moved,,seconded by Long and unanimously passed that the Resolution entitled "A Resolution of the Village Council of the Vil]age of Tequesta, Florida Recognizing the Public Need for Flood Insurance and Authorizing the Village Council to Take Whatever Action it Deems Necessary to Comply with the Flood Insurance Program" be approved. Resolution No. 2-70/71 was thereby passed and adopted. The Village Attorney explained that he had been asked to prepare an ordinance to rescind Village Ordinance No. 34 which required licensing of dogs and vaccination of dogs for rabies. It was explained that this action seems proper since Palm Beach County has had such a law in effect since January 1, 1970. Cunningham muvbd, seconded by Barr and unanimously passed that the first reading of the Ordinance as done by the Village Attorney be approved. • Attorney Gilbert T. Brophy, Village Judge Ad Litem, spoke for Mr. James Bobrce, resident of 319 Leigh Road, corner of Leigh Road and Fiesta Avenue, on his request fora permit to plant a hedge in the Swale of Fiesta Avenue approximately three (3) feet from the paving for the purpose of keeping dogs out of his yard. Mr. Boyce presently takes very good care of this swa le area but dons use the swale area and his lawn. Mr. Brophy stated other municipalities such as West Palm Beach, grant such licenses. Any such plantings world be subject to removal at the property owners expense when it would be required. Mayor Sylvester questioned if there would be any Village liability and suggested planting the hedge eight (8) feet from the paving with maximum height limit which should-not interfere with the public safety. Councilman Cunningham stated he was against such plantings as it could possibly lead to many mare such requests. Cunningham moved, seconded by Barr that the request for perffi.it be denied. Counci]ma,n Barr stated he eras sympathetic with Mr. Boyce~s problem but such permits should be worked out so they could be applicable to all properties and not on an individual basis. Councilman Long suggested the Village Attorney look into an ordinance on this subject. The motion for denial was passed unanimously and further study of the situation will be made. • -4- The Councilmen discussed the request of the Gallery Sq~re Association to erect a sign on the south-caster portion of the parking area to identify Gallery Square. A picture of the sign was shows and. the - Cc-uneiLnen were advised it has the approval of the Silts Caasmittee. yil]age Attorney Lord advised he had prepared a license for the use of the land for the sign to be erected upon. Cunsinghamt moved, seconded by Long and unanimously passed that the license be granted to Joseph B. 3tascliffe agd the Mayor and Village Clerk be authorised to sign samre. Counci]mas bong suggested that perhaps-the Village should at some time consider providing lighting for the parking lot. The Village Council and Village Attor~tey then discussed the proposal of the Village Planser, Mr. Frank W. Brett, that the Village adopt design criteria and other regnla,tions for gasoline service stati®ns which he had forwarded to the Councilmen. This would not be for any specific-area of the Village but would be applicable to all future gasoline service station cons#ataction. Attorney Lord advised that such criteria and regulations should be a part of the Zoning Ordinance and a Public Bear- ing would have to be held to amend the Zoning Ordinance to this effect. The Village Coruscil set the Public Bearing for this purpose to be held at ?:3O P.M., Tuesday, November 17, 1970 at~the Village Ba11. Attorney Lord advised that the revision of the tl~arter was taking considerably more time than anticipated and he expected to bare a written draft completed is a week or so and suggested a workahop meeting • for the sole purpose of reviewing the groposed Garter when the draft is ready. Attorney Lord advised that he was still trying to obtain more information from Attorney James E. Weber.®s his request for a subordination of the interest of the Village to the Ilepartment of Trassportatioa in a certain parcel of land lying sear or adjacent to the White property on Jupiter Island and would not recaeomend the Village apprc+~al until he rtes completely knowledgable of the request. It was reported that the Water Revenue Certificate holders had not approved or disapproved the proposed franchise with surcharge reductions for Jupiter Inlet Colony and Mr. Offutt wan expected to be in the area early in November and Mayor Sylvester e~cpected to .contact him os the matter then. Mr. Paui Thomson, C.ha,irnan of the Sign Committee, reported on the progress being maade to have signs is the Village conform to the requirements of Ordinance No. 171. A written report dated October 2O, I97O was presented. The Committee recommended the Council approve a six (6) months developers sign permit for two (2) signs; to be cotructed on their model apartment on the eorser of Seabrook Road and Tequesta Drive to conform to the requirements of the Sign Ordinance. Ounaiagham moved, seconded by Long and unanimously passed that Resort Properties be granted a six (6) months developers sign permit for signs to be erected on their • model apartment at Tequesta-Drive and Seabrook Road upon pagmest of proper fees. REVISED -5- The Village Attorney gave first reading to a "Smut Ordinance". Cunningham moved, seconded by Long and »*+A*+~mously passed that the first reading of the Ordinance be approved. Village resident Mr. Joseph Blizzard stated Mr. Bill Lund had asked him to request the Village Council to support Proposed Constitutional Amendments No. 4 and 5 to be voted upon in the November 3, 1970 General Election. Cunningham moved, seconded by Long and unanimously passed that the Village Council go on record as favoring the approval of Proposed Constitutional ,Amendments No. 4 and 5. The Village Manager reported-that Senate Bill 281 passed over the Governor's veto at the special session of the State Legislature held October 9, 1970 did not have an adverse effect on the Water Department since it permits up to a 50~ surcharge for water service outside of municipalities. He also reported the Department of Transportation had approved a full activated traffic signal at the intersection of State Road 5 (U .S. Highway No. 1) and Tequesta Drive. He also reminded the Counci]men of the Area Planning Board meet3aag with the elected officers of Tequesta, Jupiter and Jupiter Inlet Colony to discuss a proposed service area study to be held in the Village Hall at 7:30 P.M., November 9, 1970. Mayor Sylvester advised that the Tequesta Branch Post Office was expected to be in operation shortly after the first of the year and • that the Village Attorney was working on an, ordinance providing for clearing and cleaning of lots in the Village, Councilman Barr said he would discuss the matter of the fertilizer vats and other golf course equipment which could always be seen from Country Club Drive and adjacent properties, with the Country Club Board of Directors.
