COUNCILMEN OF THE VILLAGE OF TEQUESTA
A Public Hearing was held by the CounciLnen of the Village
of Tequesta at 7:30 P.M., Tuesday, July 13, 1971, in the Village
Hall. Councilmen present were Messrs: Sylvester, Barr, Russell,
Little and Cunningham. Also present was Robert Harp, Village Manager
and Clerk.
Mayor Sylvester advised .the Hearing that it had been called
to consider the application of Floyd Ciuci and Philip Weinsier to
have their property located on U. S, Highway No. 1 annexed to the
Village of Tequesta. He further advised that Ciuci~s-Bar and
Package store was presently existing on the property and was the
holder of a 4-COP State Beverage License. The Village Clerk advised
that the Hearing had been advertised in the Beacon News, June 24, 1971.
Mr. Joseph Farish, Jr., representing the applicants,
explained the desire of the owners to be annexed to the Village.
Upon questioning, he could not state why the owners had not requested
annexation previously. Mr. Farish pointed out that the Village would
derive additional income from license fees and ad valorem taxes.
• Mr. William Frank voiced objections to the proposed annex-
ation since it would bring a 4-COP Beverage License into the Village
and would prevent another such license in the Village for as long as
ten years. He suggested the applicants wait to request annexation
until the first such beverage license has been issued by the Governor
which would probably be 1973.
It was suggested that once the license is in the Village it
could be sold to some other persons and moved to another location in
the Village.
Councilman Russell stated he had no objection to the annex-
ation. Councilman Barr stated he thought Mr. Franks remarks were
germane to the issue and said he believes that it is not a desire to
be annexed but For the license to come into the Village and possibly
be moved to another location and he was against such an action. Mr.
Farish questioned if it really makes any difference who should get
the first Village license. Councilman Barr stated he believed the
State should issue the first license for the Village. Mr. Thomas
bhp asked if either of the property owners had appeared before the
Council to discuss the annexation and was advised they had not.
Mr, Frank said he thought the Village deserves a better deal for its
residents.
Councilman Little questioned the advisability of annexing
the property now or waiting until 1973 after the Village has been
• issued its first license by the State based upon the 1970 Federal
Census Population Figures.
Councilman Barr stated he believed the annexation request
was a guise for locating the beverage license anywhere in the Village.
At the conclusion of the discussion, Russell moved, seconded
by Cunningham that an Ordinance of Annexation for the subject property
be prepared to be read at the July 20, 1971 Council Meeting. The vote
on the motion was:
Little - For
Cunningham - For
Sylvester - For
Russell - For
Barr - For
The Hearing was adjourned at 8:00 P.M.
