• MINUTES OF THE MEETING OF THE COUNCILMF~T OF THE VILLAGE OF TEQUESTA, FLORIDA The regular monthlq meeting of the Councilmen of the Village of Tequesta was held at 8:00 P.M., Tuesday, July 20, 1971 at the Village Ha11. Councilmen present were: Messrs. Sylvester, Barr, Cunningham, Russell and Little. Also present were Robert Harp, Village Manager and Clerk and Christopher H. Cook, Village Attorney. The meeting was opened with Prayer and-the Pledge of Allegiance to the Flag by Councilman Little. Upon motion by Russell, seconded by Cunningham and unanimously passed, the minutes of the June 15, 1971 meeting were approved. The Village Manager recapped the receipts and dishursemeats for the nine (9) month period ended June 30, 1971. Balances on hand were: First Bank and Trust Co. Petty Cash Community Federal Fidelity Federal Certificates of Deposit of Jupiter/Tequesta $ 32,830.87 25.00 20,440,1? 15,770.1? 20,000.00 $ 89,066.21 Account Suaumary: Operating Account Petty Cash $ 89,041.1 25.0 $ 89,066.21 The Sinking Fund balance for payment of principal and interest on the Vi11a~e Ha11 bonds and bonds for the purchase of land east of the Village Hall was $27 799.40. The Water Department financial report for the month of June was not complete at meeting time. The Village Manager presented his report for the month of June 1971. Building statistics were: June-1971 No. Valuation 34 (6~houses 298.232. Year to Date No. Valuation 2?2 S3 houses) 7,535,257. Las. 2? (4 houses) $ 114,405 258 (58 houses) 46 $ 2,849,476. ?-ZO-?1 - 2 Police Chief Dusenbe ry presented the Police Department and Civil Defense reports for the month of 3une 1971. ~'he Chief also read the detailed data concerning the nusmber of complaints in various categories. Councilman Russell suggested that the Chief publish a recent report from the State on Village police activities to let the Village residents know the various activities and assistance given by the department. Councilman Barr asked how the radar was being used and was advised it was on a selective schedule at various locations. Councilman Little discussed possible park sites in the Village and said that his committee was trying to find available land. He stated that there had also been considerable discussion on construction of a bicycle path and moved that the Village start construction of a bicycle path along Tequesta Drive from Seabrook Road west to the intersection of Tequesta Drive and Country Club Drive. Councilman Barr suggested that the project be given more study and more detailed information as to location, cost etc, be provided before the decision is made. The Village Attorney was instructed to advise if and/or how such a path could be used both for pedestrian and bicycle traffic excluding motor powered vehicles. Councilman Little a~ the Village Manager will pursue the project and report when the necessary facts are available. Councilman Cunningham reported that a preliminary drawing for Tequesta Drive improvements between U. S. Highway No. 1 and Old Dixie • Highway had been received. He further' reported that he and Councilraa~ Russell had interviewed five persons for the position of Building f~'fficial to replace the present Building Inspector. The position would be to (1) conduct building inspections for adherence to the codes of the Village; (2) perform various engineering type services such as drawings and apecifi- cati~ns for smaller projects; (3) study of trash problems and various other duties. Councilman Cunningham reported that the person who in his and Councilman Russells opinion was the best qualified for the position was a mechanical engineer who vas a resident of the Village. Cunningham moved, seconded by Russell that the Village hire this person as the Building Official with a salary of $12,000.40 armuallp to be effective at such time. as the person can assume the position in the very near future. Mayor Sylvester suggested perhaps the Village should hire a person as an administrative assistant to the Village Manager in addition to performing building inspections and referred the Councilmen to his recent memorarulum to then in this regard. Mr. Joseph Blizzard suggested the vari©us contractors be asked what they. want. Councilman Barr suggested the person under consideration for the position could also be of great assistance to the Village Manager. Mr. Hutchison stated adequate. inspections were necessary for the benefit of the citizens of the Village. Mr. Blizzard asked if the person under consideration was qualified to make inspections. Mayor Sylvester read his memorandum to the Councilmen. Mr. Thomas H. Daly spoke in support of Mr. Lali.berte. Mr. Frank questioned the present building inspector's qualifications for the job. Mayor Sylvester said he would like to have an administrative assistant at a lower salary. Following the discussion, the Mayor called for a vote on ~ the motian which was unanimously passed. 47 7-20-71 - 3 Mayor Sylvester stated that-Floyd Ciuci and Philip Weinsier had agreed to table the reading of an ordinance of annexation for 30 days. He stated he had talked to Senator 3erry s and Governor Askew about the matter suggesting that since the Villagers license to be issued by the Governor was its first. one perhaps 'could be issued by the Governor now and then Ciuci-Weinsier could ask for annexation of their property. The Village Manager read a Resolution that protested the use of re-assessed values of property by the Palm Beach County Tax Assessor far 1971 because the entire County has not been re-assessed as yet. Cunningham moved, seconded. by Barr and unanimously passed that the Resolution be adopted. Therefore Resolution No. 5-70/71 was passed. Barr moved, seconded by Cunningham and unanimously passed that the Council accept the approval of the Sign Cottanittee for the signs for the Lighthouse Shopping Center pursuant to their letter of July 14, 1971. The Village Manager reported on two proposals he had for cutting down the 28 ficus trees on Willow Road and removal of same: Rood Landscape Co. Inc. $ 1,120.00 Schmidt Tree Experts 740.00 all trees to be cut off several inches below surface of the ground, leveled, smoothed and raked. Barr moved, seconded by Little and unanimously passed that Schmidt Tree Experts be authorized to remove the ficus trees at a cost e`f $740.00. The Village Manager read a petition from Atlantic National Bank of West Palm Beach, as Ancillary Administrator, C.T.A. of the estate of Paul E. Wilson, deceased, bg J. H. Paulsen II, Trust Officer, requesting annexation of two (2) parcels of land on the ea§t side, of $each Road lying between the north line of Jupiter Zn1et Colony"and the tlcean Towers Condo- m~.ni~ma. now under construction and more particularly described in the: petition. Russell moved, seconded by Cunningham and.unanimuusly passed .that the petition. be accepted. The Village Manager then read an ordinance providing for the annexation of the subject parcels of land to the territorial limits of the Village of Tequesta. Cunningham moved, seconded by Russell and unanimously passed that the reading of the ordinance be approved. All Councilmen being present and voting for the approval of the reading, Ordinance No. 185 was hereby passed and adopted on First Reading. The Village Attorney reported on progress with the prnposed Charter Revision and suggested a joint meeting of the Council and the Charter Revision Committee to iron out any existing differences. A workshop meeting for this purpose was scheduled for 7:30 P.M., Monday, Auguste 2, 1971 stt the Village Hall. Russell moved, second~l bq Little and unanimously pa~ss~ that the Water Department Consulting Engineers Annual Report be received. ~. 48 ?-20-71 - 4 Barr moved, seconded by Little and unanimously passed. that approval be given to Kendall Construction Corporation for use of Pen-Plant Bermuda Shingle Roof Product subject to the same terms and conditions as approved by the Palm Beach County Building Department. A~ discussed at the Workshop Meeting, Barr moved, seconded by Russell and unanimously passed that the Florida Power and Light Company be given approval to make residential service installations with use of direct burial cable for those persons who want underground service from the pole to the house, effective at once. Mr. Blizzard advised a culvert on Seabrook Road was stopped up and suggested a center line on Cypress Drive. Chief Dusenbery reported on progress with measuring annoyance levels of various noises. A sound-level meter can bo obtained from Technic Instr~anents to measure noise levels but an ordirisurtce would have to be adopted determining the mas;mu~ amount of measurable noise various activities produce. Councilman Barr reported that Mr. Richard H. Swallow had resigned as the Villages representative on the Loxahatchee River Environmental Control District and he had up to now been unsuccessful in getting anyone else to consider appointment. He also reported that Mr. James Cra~rford, 347 River Drive, Tequesta and Mr. Frank Henderson, 63 River Drive, Tequesta, had both reported seeing raw sewage i.n the Northwest Fork of the Loxahatchee River and suggested that the Health Department, Enviro~ental Control District and Plantreat, Inc. be so advised for necessary corrective action. The Village Manager is to look iato the matter of sidewalks along S. R. 707 on Jupiter Island. ?:30 P.M., Thursday, July 22 was set as a Workshop Budget Meeting. The Councilmen were reminded of the August 3, Public Hearing on the site .for a proposed sewage treatment facility. There being no further business, the meeting adjourned at 9:45 P.M.
