VILLAGE OF Ti?,QUCSTA ZONING BOARD OF ADJUSTMEiVT
A Public Bearing was held by the Village of Tequesta,
Florida Zoning Board of Adjustment at 8:00 P.1~1., Thursday, Se~atember 23,
1971 at the Village Hall. Board members present Caere: Alessrs.
Shiplett, Gifford, Z4ebster and Hutchison. Also present Baas Robert
Harp, Clerk of the Board. The Clerk advised that Mr, Good had verbally
advised he would be unable to attend the Hearing.
Chairman Shiplett introduced the members of the Board
and asked the Clerk to read the application for which the Hearing Baas
being held. The Clerk read the letter from S>>i_llard C, h'heeler, Jr.
Attorney at La~:~for Tequesta Properties, Inc., requestinb a variance
to the terms of the Zoning Ordinance to pezr~it construction of an
office ?~ui1~?ing three stories in height, said building to be located
on the parcel of land on Tequesta Drive between the Inlet Professional
l~uild~.ng arrd the T3P Service Station. The Clerk advised that ,due
notice of the Hearing had been published in the Beacan News and
property o~mers within 500 feet had been notified by letter of the
Hearing,
• Attorney 4nzeeler read letters which had been received
ror~z various adjacent property ot,~rzers, all indicating they had no
objection to the proposed variance. (Letters are attached to and
-made ~~ part of these minutes). He further called the Boards attention
to representatives of the First Rani. ~ Trust Company Jupiter/Tequesta,
Dr. ~leskola and Thomas H. Daly, all property owners within the area,
Cabo were in attendance at the Hearing, He advised that the land cost
rrl«lces it important for his c]_ient to be allo~•,red to construct the
three story office building. He further sated his client believed
this proposed structure would be the hi ;hest and best use of the land
t•ritizout insulting the character of the surraundin; neighborhood.
Ivir. Anton Cedervall, Architect for the proposed
building stated the building ~,~as structurally designed far a three.
story building and the overall height to the top of the roof was
trirty-seven feet (37~), The roof was so designed to cover up air
corditioc~ir~g units on the roof and to give the building a nicer
aesthetic appearance, He further stated additional parking would
amount to five (5) additional spaces which his client could provide
on nearby land which they owned,
Dr. Nesicow reviewed parking, drainage onto his
property from the building and the fact that the land eos' 1ra.s not
too prohibitive. Mr. Cederval] :advised the building ~:~ould have
adequate roof drains and not drain onto Dr. Nestco~ats building,

SpiT"it of the zoning ordinance .and does not constitute a hardship
under the terr~zs of the ordinance. The vote on the motioix ~-ras:

Gifford suggested that action be tabled until the
Board gets a recor~v~nendation in this regard f rorzz the Village Council.

Folio~~~ing further discussion, Gifford moved that the
r~gtzested variance 'ae granted ~•rith the provision that the Village
Council be advised that the Zoning Board believes this to be a
ch.:,z~ge in zoning and further tl~za.t the Board requests the Village
Council to consider this matter and eitd:er vote on changing the zoning
ir. regard to height limits in the corntercial zoned areas and to
adv,~se ~•rhether or not the Zoning Boar~~ is ~;~ualified under th.e
o,~dirance to act upon any such sirlilar requests for variance in the
future, rlr. s'hipZ_ett sug ested tabling action until. sucl. ir~fo~ nation
is received from the Village Council. ~~ttorney j~xee;1_cr suggested
the hoard ha.s to consider if it is the highest and best use for the
fund; the ot~rnei^s have come to the Board zVith this r~:qu~;st foi variance

revised his motion to state that the application fQr variance be
approved, The motion died for lack of a second.
Hutchison r~~oved that action on the request be tabled
an the basis that this Boani refers the matter .to the Vili.ae Council
for action to change or keep tI-ze e:~isting oxziin<^4nce requircz:~t~nts in
this regard a.nd that no action be ts.ken until the Zo~iing Ordinance is
changed to pear+it a building of this height. IL ~:ras the genoral
feeling that this ~~as got a proper motion and the motion died for
lack of a second. Shi1,1_ett gain questioned lrhether the Board has
authority to approve this type of variance.
