HomeMy WebLinkAboutMinutes_Regular_03/23/1971 MINUTES OF THE MEETING OF THE COUNCILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA The regular monthly meeting of the Councilmen of the Village of Tequesta, Florida, was held at 8:00 P.M., Tuesday, March 23, 1971 at the Village Hall. Councilmen present were Messrs: Sylvester, Cunningham, Russell and Barr. The meeting was opened with Prayer and the Pledge of Allegiance to the Flag by Councilman Russell. The Village Manager recapped the receipts and disbursements for the five (5) month period ended February 28, 1971. Balances on ha«id were as follows: First Bank ~ Trust Company Jupiter/Tequesta $ 30,737.37 Petty Cash 25.00 Community Federal Savings and Loan 19,939.62 Fidelity Federal Savings and Loan 15,383.99 Certificates of Deposit 65,000.00 X131,085.98 Account Summary: LJ Operating Account $131,060.98 Petty Cash 25.00 $131,085.98 The Sinking Fund balance for payment of principal and interest on the Village Hall bonds and bonds for the purchase of land east of the Village Hall was $22,728.60. The Water Department Financial Report for the two (2) month period ended February 28, 1971 showed total receipts of $48,147.61, operating expense $12,109.68 and debt service requirements of $25,679.52. The Village Manager presented his report for the month of February 1971. Building statistics were: February 1971 Year to Date No. Valuation No. Valuation 20 (6 houses) $169,400.00 130 (26 houses) $3,257,820. Last Year 32 (5 houses) $287,128.00 170 (51 houses) $2,637,862. The report also showed that 89.3 of the 1970 Tax Roll has been received from the Palm Beach County Tax Collector. Police Chief Dusenbery presented the Police Department and Civil Defense Reports for the month of Iebruary 1971. 24 3-23-71 Councilman Cunningham presented a proposed plan for four-laving Tequesta Drive between U. S, Highway No. 1 and the Florida East Coast Railroad tracks. This improvement is deemed to be necessary because of the construction of the Lighthouse Shopping Plaza on the north side of Tequesta Drive and anticipated future commercial development in the general area. Councilman Russell reported there was no further word on a Village Cultural Arts Center and that various persons were being contacted pursuing the matter of an additional east west road for the area. Councilman Barr reported on work the Sewerage Committee had done and of the written report of the work of the Committee to date which had been submitted to the Village Council. Mr. Ellis A. Simmons of the Village Financial Planning Committee asked why the report had not been submitted to his Committee and Mr. Barr advised that it was not concerned with finances or financing at this time and that he would be glad to meet with Mr. Simmons Committee to discuss the matter. The Village Clerk presented the Inspectors of Election Certificate for the March 16, 1971 General Election showing the results of the election as follows: C__ouncilman-First Ward (Two (2) Year Term) Arthur C, Barr 372 Votes • Councilman-Second Ward (Two,S2) Year Team) Frank D. Cunningham 218 Votes J. Robert Emry 213 Votes Councilman-Second Ward (One (1) Year Term) Joseph W. Blizzard 116 Votes Thomas J. Little 33? Votes Russell moved, seconded by Cunningham and passed that the Inspectors of Election Certificate of the results of the March 16, 1970 General Election be approved and accepted. The Village Clerk administered the Oath of Office to newly elected Councilmen Arthur C. Barr, Frank D, Cunningham and Thomas J. Little. Councilman Little was welcomed and congratulated and took his seat on the Council. Mayor Sylvester presented a Certificate of Appreciation to former Councilman Carl L. Long and thanked him for his past service to the Village. Mr. Long was also given his name plate. The Village Council then elected its officers for the year. Cunningham moved, seconded by Russell and passed that Arthur C. Barr be elected Vice~iayor. Russell moved, seconded by Barr and passed that Frank D. Cunningham be elected Village Treasurer. Sylvester moved, seconded by Barr and passed that William J. Russell be elected Tax Assessor. Russell moved, seconded by Barr and passed that Thomas J. Little be elected Tax Collector. 25 3-23-71 • The Oaths of Office were administered to the newly elected Village Officers by the Village Clerk. Cunningham moved, seconded by Russell and passed that the following appointments of the Village personnel be approved: Village Manager and Clerk Assistant Village Clerk Police Chief Village Judge Village Judge Ad Litum Civil Defense Director Water Department Superintendent Robert Harp Jean Frank Henry M. Dusenbery Allan V. Everard Gilbert T. Brophy Folice Chief Henry M. Dusenbery James W. Worth Mayor Sylvester administered the Oaths of Office to the Village Manager and Clerk, Police Chief and Civil Defense Director and the Village Clerk will administer the Oaths of Office to the other personnel. Mayor Sylvester called a Council Workshop Meeting for 7;30 P.M. Tuesday, Aiarch 30, 1971 at the Village Hall. No action was taken on the appointment of the Villa ge Attorney and the Council is going to discuss this matter with Mr. William A. Lord at the Workshop Meeting. • Mayor Sylvester advised that Mrs. Frank (Amanda) Cunningham, wife of Councilman Frank D. Cunningham had been appointed the the Adult Board of Directors of the Jupiter/Tequesta Junior Citizens, taking the -place of Robert Meyer, who had represented .the Village of Tequesta on the Board since 1963 and who resigned because his children were all grown- up. Upon motion by Sylvester, seconded by Little and tu~an;mously passed Mrs. Cunningham was approved as the Villages representative to the Jupiter/Tequesta Junior Citizens Board. Mrs. Cunningham was introduced to the audience as were the wife and father and mother of newly elected Councilman Thomas J. Little. Barr moved, seconded by Russell and passed that the following be the depositories for Village of Tequesta funds and that the signature requirements for all accounts be the Village Manager and/or Village Treasurer and one (1) Councilman: First Bank ~ Trust Company - Jupiter/Tequesta Operating Account Excise Tax Revenue Fund Sinking Fund First Bank ~ Trust Company-Jupiter/Tequesta - Water Department Revenue Fund Operation and Maintenance Fund Meter Deposits Fund • 26 3-23-71 Bank of Palm Beach ~ Trust Company - Water Department Sinking Fund Reserve Account Renewal and Replacement Fund Certificate Redemption Fund Capital Improvement Reserve Fund Community Federal Savings and Loan Association Account No. S 9774 Account No. S 15871 Account No. S 15872 Account No. S 15874 Fidelity Federal Savings and Loan Association Account No. P 25038 Cunningham moved, seconded by Little and passed that the 1971 Water Department Budget be amended as follows due to an increase of $21,OEJ0. over the estimated amount of Water Revenue Certificates necessary to be issued based upon revenues of the system for 1970. Operation and Maintenance Fund Office and Administration Fiscal Agent's Fee $ 210.00 increase Revenue Fund Transfers To Sinking Fund $ 1,050.00 increase To Reserve Account 1,050.00 increase To Renewal and Replacement Fund 196.00 increase To Certificate Redemption Fund 840.00 increase Mayor Sylvester reported on a letter from Congressman Paul Rogers advising that the name of the Tequesta Post Office on the building would be changed by eliminating the work, "Branch" . Mr. Christopher Cook, sitting in for Village Attorney William A. Lord, advised that Mr. Lord was experiencing some difficulty in drafting a Village Charter similar to the Atlantic Beach Charter; that the necessary documents required for the surcharge reduction to Jupiter Inlet Colony had been forwarded to members of the Offutt Trust for signatures; that the proposed occupational license ordinance seemed to be in legally correct form. Attorney Lord was not in attendance at the meeting because of illness. Mayor Sylvester reported on the progress of the Village during the past year and the status of the various projects. He spoke of some feelings against the present "Tequesta Indian" used as a Village emblem and it wasa~uggested that no type of emblem be used and that only conventidth green and white signs be used to indicate Village limits etc. He stated he would like to see the Village named on the cover of future telephone books and spoke of the need for expansion of the program and . facilities of the Jupiter/Tequesta Junior Citizens organization for the benefit of the youth of the area together with other recreation oriented projects. He further spoke of Village beautification especially in the area of the railroad right-of-way on Tequesta Drive. 27 3-23-71 The Village Manager reported that the fees for assessing and collecting Village taxes for 1971 b~ the Palm Beach County Tax Assessor and Tax Collector would be the same as last year - 6/10 of 1~ of the total taxes levied. He informed the meeting that Mr. Gox~lon T. Butler, former Secretary of the Florida League of Cities had passed away March 9, 1971. The Village Manager also advised that the purchase of a Police base radio and two hand held radios had been authorized from Spencer Communications (RCA) on their low bid of $3,064.40. Other bids were received from Gabriel Communications (GE) $3,360.00 and Motorola Comm- unications $4,160.00. Barr moved, seconded by Cunningham and passed that the Police Department be authorized to expand its personnel on a temporary basis for several months by the hiring of one (1) additional patrolman. This was made necessary by Sergeant Petrie being given 12 weeks desk duty while the deslanen take their vacations in an effort to assist Sergeant Petrie in recovering from his recent heart attack. 7:45 P.M., Tuesday, April 20, 1971 was set as the time for a Public Hearing to determine a zoning classification for Lot 12, Block 3, Riverside on the Loxahatchee, which was recently annexed to the Village of Tequesta. • Cunningham,moved, seconded by Barr and passed that Palm Beach County be authorized to stripe and edge-line newly resurfaced Tequesta Drive on their quotation of $495.00. The Village Manager spoke of the revision of Chapter lOD-6, Florida Administrative Code, "Standards for Individual Sewage Disposal Facilities'; the appointment of members of the Sign Committee for staggered terms as required by Section 16C - Ordinance No. 171 (Sign Ordinance). Letter to Arnold Ramos re: Alternate A-I-A Bridge; letter of thanks from Jaycees to the Village Police Deparbnent for their assistance with "Walk For Mankind Project". The Village Manager advised that an advertisement stating that the two (2) old Police Cars would be for sale would be in the local papers this week with written offers to be received until 5:00 P.M., Wednesday, riarch 31, 1971. CATV in the Tequesta Country Club - Country Club Point area is expected to be in operation about the end of April 1971 according to the franchise holder, Palm Beach Cable Television Company. Police Chief Dusenbery read a letter from the First Bank fs Trust Company, Tequesta, requesting that he present a Security Protection Plan to the Village Council whereby the Bank could be checked inside during the hours the Bank is closed, The letter stated the Bank found it necessary to take more stringent action due to the recent wave of bank roberies in the area. Chief Dusenbery advised that it could be worked out and the 28 3-23-71 Bank would compensate the police officers involved and he would administer the plan. It was the general feeling that the matter merited the further attention of the Council and the Village Attorney since it was a Village service involved and several Council members believed the compensation should be made to the Village if the plan was approved. The matter will be further discussed at the Workshop Meeting. Councilman Little verbally resigned from the Tequesta Auxiliary Police due to his election as a Councilman and submitted his badge and ID card to Chief Dusenbery. Councilman Barr asked the Police Chief about the control of bicycles at night without proper reflectors; control of noisy trail bikes on public and private property; noise problem and speed of nmtor bikes especially in the early morning hours and possible adoption of an anti- noise ordinance and purchase of necessary noise measuring equipment to provide for enforcement of the ordinance; and continual speeding on Country Club Drive. Councilman Barr suggested publicity as to more use of radar equipment and possible naming of violators and fines in the newspapers. Mr. A. L. Hutchison, representing the Beach Road Property Owners Association expressed the concern of that group that in the event of electrical power failure, the sewage system on Jupiter Island would continue to function; that the Village water system could continue to operate and the possibility of investigating the adequacy of designated stone shelters in relation to the increasing population of the Village. These matters will be pursued by the Village. Mr, Daniel D. Dayton, representing Lighthouse Plaza Shopping Center, appeared before the Council to introduce Mr. Robert Reynolds of the Town and Country Health Spa which is going to open in the Shopp- ing Center, and to request a permit for a tma7er to be used as a display center and office until such time as they can move into the new building. The Village Manager stated it was his opinion such a trailer would not be permitted under the teens of the trailer ordinance (No. 150) of the Village. The Council agreed to look at the trailer at 4:15 P.M., Wednesday afternoon before making a decision on the matter, Mr. Ellis Simmons suggested using an official record keeper to record the minutes of the Council Meetings. 10:00 P.M.
