HomeMy WebLinkAboutMinutes_Board of Adjustment_05/03/1971MINUTES OF THE PUBLIC HEARING O1~ THE • ZONING BOARD OF ADJUSTriENT OF THE VILLAGE OF TEQUESTA, FLORIDA A Public Hearing was held by the Zoning Board of Adjustment of the Village of Tequesta, Florida at 8:00 P.trl., Monday,~May 3, 1971 at the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Board members present were Messrs: Shiplett, Good, Gifford, Hutchison and Webster. Also present was Robert Harp, Clerk of the Board. ' Mr. Hutchison suggested that page 2 of the minutes of the April 9, 1971 be amended to strike out that part of the paragraph stating "with a suggestion that the o~,mer consider resutxnitting ......" since it was his understanding that this part of the motion had been withdrawn by Mr. Gifford who had made the original motion. Gifford moved seconded by Good and unanimously passed that the April 9, 1971 minutes be so amended. Chairn-an Shiplett introduced the members of the Board to those in attendance. The Clerk advised that notice of the Heari ng had • been published in the Beacon News April 15, 1971 and that all property owners within 500 feet of the subject property had been sent letters advising of the Hearing. The Clerk read the Notice of Hearing which was to act upon the application of Frank Patten, o~,mer of Lot 2, Block 23, Jupiter in the Pines, Section "B", 440 Beacon Street (Gene R. ~ Margaret C. Sarullo, Contract Purchasers) requesting a variance to allow the twenty-five (25) foot front yas~i setbacks to be reduced to sixteen (16) feet for the construction of a house on the subject lot due to the irregular shape of the lot. r1r. Karl Kandell, representing Franlc Patten and the; contract purchasers, presented a proposed plot plan for the house showing a rear yard set back of twenty (20) feet, side ~; yard set back of twenty-seven feet to the rear corners of the house on both sides, a twenty-three (23) foot front yard set, back on the left side of the house and a sixteen (16) foot - front yard set back on the right side of the house. He stated that the lot was one of the larger lots in the entire subdivision but the irregular shape made it impossible to construct a house of sine lar dimensions to other recently constructed houses in the area. He said he had made a survey. of the percentage of lots used by existing similar houses - and they use considerably more of the lot than the same type house would on the subject lot. The plot plan as submitted. allows for maximum setbacks on all sides and corners. He stated the purchasers had agreed to build a circular drive which would help to solve the problem of the parking of aut©mobiles if the garage was on the right side of the house. - -2-. • rir. Charles Keller, owner of Lot 8, Block 21, stated he was against any change from the requirements of the Zoning Ordinance and was concerned about future requests for variances on other irregular shaped lots, rir. Roy Tollefson, owner of Lot~12, Block 15 questioned the location of the garage, and was advised-about the circular driveway and said he would not object if the owners across the street had no objection. rirs. Arthur Harris, owner of Lot 29, Block 22, across the street from the subject lot stated the circular „ drive would solve the matter of parking and would not object to the garage remaining on the right side. Mr. Kandell stated the owners would prefer this as the adjacent property had a dog kennel near the property line. Mr. Thomas J. Little, o~,~rter of Lot 9, Block I7 stated he was opposed to changes or variances in zoning in general and did not like to see precedents set. Mrs. L. F. Edilliams, owner of Lot 8, Bloclc 22 said she could not see any reason for objection to the proposed variance. A letter from Joseph ~ Dorothy H. Schriner, owners of Lot 9, Block 17, opposing the application was read. Board member Gifford stated the proposed variance would not seem to adversely affect the general area since the house on Lot 1, Block 23 i,~as 20 feet from Beacon Street and Mr. Kandell had stated they proposed to construct a house on Lot 3, Block 23 which would be 20 feet from Beacon Street.
