THE VILLAGE OF TEQUESTA, FLORIDA
The Regular Aionthly Meeting of the Councilmen of the Village
of Tequesta ~~~as held at 8:00 P.M., Tuesday, June 15, 1971 at the Village
Hall. Councilmen present ~~ere Messrs. Sylvester, Barr, Russell,
Cunningham and Little. Also present ~,rere Robert Harp, Village Manager
and Clerk and Christopher H. Cook, Village Attorney.
The meeting was opened with Prayer and the Pledge of Allegiance
to the Flag by Councilman Cunningham.
Upon motion by Russell, seconded by Cunningham and unanimously
passed, the minutes of the May 1971 meeting were approved.
The Village Manager recapped the receipts and disbursements
for the eight (8) month period ended May 31, 1971. Balances on hand

The Sinking Fund balance for payment of principal and interest
on the Village Hall bonds and bonds for the purchase of land east of the
Village Hall ti*as $25,863.51. The Water Department financial report for
the month of May 1971 was not complete at meeting time.
The Village Manager presented his report for the month of
May 1971. The report showed customers of the Village Water System
were conforming to the restrictions that had been placed on lawn sprink-
ling limiting it to one day per week, t~~hich went into effect May 7,
1971. Building statistics were:

Police Chief Dusenbery presented the Police Department and
Civi]_ Defense reports for May 1971. Councilman Barr reported on
complaints of noise of mini-bikes etc. and the Police Chief and Village
Manager were asked to obtain inforriation on ordinances and equipment
which might possibly be used to control this matter.
Councilman Little presented a plan for a kiddie park which
could be constructed on a lot 90' x 140' at an estimated cost of
$4,290. There is no site in mind at the present time but it was
Mr. Little~s feeling that it should be in close proximity to a residential
area such as the Jupiter Tequesta Junior Citizens property, Presbyterian
Church property on Tequesta Drive or Dr. V. M. Johnson property on the
south side of Tequesta Drive near the entrance to the Tequesta Country
Club Community. Mr. Little stated he did not think the Village well field
site on Old Dixie Highway was a good site. The Village rianager reported
the engineers had advised a six (6) foot wide bicycle path would cost
about $2.75 a lineal foot for construction.
Councilman Cunninghanl discussed the covering of the open
drainage ditch running north to south along the west side of lots 24 and
25, Block 15, Jupiter in the Pines, Section "B". The Village Manager
explained-that the Village engineers believe the proper way to drain the
area would be by the installation of a completely new drainage system
using 36" corrugated metal pipe which would cost an estimated $30,000.00.
They advised a temporary installation of an 18" corrugated metal pipe
together with other necessary structures would cost an estimated $4,000.
• The Village Manager was asked to have drawings completed and to obtain
several bids for the ~.ork on the temporary installation basis.
Councilman Russell reported a meeting is scheduled for
7:30 P.M., June 29, 1971 at the Village Hall with Pa]m Beach County
Commissioner Robert F. Culpepper, representatives of the County Engineer's
Department, Martin County Commissioner Timer Powers, Martin County
Administrator Jack Noble, Martin County Engineer and himself and the
Village Manager to further discuss the East-jdest connector road project.
He suggested that since most of those to attend were from out of to~ti~n,
that arrangements be made for the Village to invite them to dinner,
courtesy of the Village, and the Village Council so concurred.
Councilman Barr reported a notice pertaining to Approval of
Plans that had been prepared by the Village Manager had been t,Tell
received and approved. He reported Charter Revision itiTas progressing and
that he had attended a meeting of the Charter Revision Committee last
night. The Village Attorney bras asked to check with the Attorney General
as to the way the Charter will have to be approved, whether by local
referendum, State Legislature and/or both. Mr. Barr reported that there
<<Tere only three areas of concern to both the Village Council and the
Charter Revision Committee: (1) Requirement for appointing a Planning
Committee (2) Capital expenditure referendums especially if revenue bonds
z,~ould be used as a method of financing (3) Annexation - contiguity or
it~ithin a definite area. lair. Barr complimented the Village Attorney for
his work on the draft of the Charter and his review of various items

• that the property owners would deed the necessary land for the right-of-
z~=ay to the Village since a properly constructed road on a fifty (50)
foot «ide right-of-~~ay should increase the values of the properties on
the north side of the road,
In the interest of the health, safety and ~,~elfare of all users
of the narro~,i portion of Beacon Street, Barr moved, seconded by Cunningham
and unanirously passed that Beacon Street between east of Flm Avenue and
Seabrook Road be temporarily be made one ~aay from Nest to east and be
so posted, ~3rhile negotiations are being made for the additional right-of-
tt~ay.
The Counci]_ then discussed a letter from the Jupiter-Tequesta
Community Fund advising that they had not reached their quota for 1971
and requesting an additional donation of $500.00, Counci]man Russell
said he thought the spirit of such agencies was ]_ost t~:~en governmental
units ~~*ere asked to make up deficits since they ~*ere comrnunit3* projects .
The audience za~as advised that the Vi]_lage did contribute $500., but that
the recent total wreck of a North County First Aid Squad, Inc. ambulance
had caused extra funds to be diverted for this purpose by the organization.
It Eras stated that the First Aid Squad had a loss of $250,OO,the deductible
portion of their insurance policy and Russell moved, seconded by Little
and unanimously passed that the Village contribute $250.00 to the North
County First Aid Squad, Inc. to undert~*rite this loss and to notify the
• Jupiter-Tequesta Community Fund of this action,
Cunningham moved, seconded by Russell and unanimously passed
that the Village present a Certificate of Appreciation to Mr. ~a Mrs.
William E. Schlusemeyer for their donation of land to the North County
First Aid Squad, Inc. as a site for a future building.
Village Attorney Christopher H. Cook advised that Bliss and
Laughlin Industries had been in contact ~,~ith him asking for the Village
to sign a release of the easements in that portion of Jupiter-Tequesta
Hunt Club ~~rhich had never been developed by Mr. Charles P. riartyn. He
advised the Village Water Department has adequate and proper easements
in the Turtle Creek Subdivision and would therefor recommend signing of
the release, Barr moved, seconded by Cunningham and unanimously passed
that the Mayor and Clerk be and are hereby authorized to execute a
release to Bliss and Laughlin Industries, Inc. to release any and all
rights on interests which may have been conveyed in the original bill
of sale of August 11, 1961 and recorded in Official Records Book 74,
page 291, Martin County, Florida with nothing in the release to affect
or mitigate the rights conveyed to the Village by Bliss and Laughlin
Industries, Inc. in an instrument dated August 26, 1970, recorded in
Official Record Book 327, page 2636, Martin County, Florida,
The Village Manager advised that the estimated cost of a
traffic signal installation at Tequesta Drive and Seabrook Road was
$4,000.00. He advised that he had not been successful in getting the
ficus trees removed from Willow Road right-of-way at no expense to the
Village and the Council asked that additional costs for removal be
obtained. He advised that a Public Hearing was scheduled for 7:30 P.M.,

pertaining to same. The Village Attorney stated he does not believe the
Charter ~~ill have to have the approval of the State Legislature and will
review and advise the Council of the proper procedures to be followed
for submitting the final document for approval. Councilman Barr reported
an a recent meeting of the Sewerage Co~nittee with Harold Eckes. He
stated the Village Sewerage Committee would like to retain the services
of Mr. Anson B, Del~'olf, Vice-President, Gee ~ Jenson, Consulting Engineers
to conduct a feasibility report of Plantreat, Inc. at a cost of $1,000.00.
Based upon various sources of information, a report ~b~ould be made in
about 30 days covering the follotaing items:
1. Adequacy of the system to handle its present load
2. Expansion possibilities
3. Compliance with Pollution Control Department requirements,
State and local.
4. Approximate estimated value of system
5. Approximate estimated number of customers
6. Existing rate structure
7. Future expansion possibilities
A fee of $250.00 i~~ould be paid upon signing of contract and $750.00 upon
presentation of report. Barr moved, seconded by Cunningham that
$1,000.00 be approved for a feasibility report of Plantreat, Inc. by
• Gee and Jenson, Consulting Engineers (~nson B. De«olf), Councilman
Little asked if Mr. DeE~olf had any connection with Plantreat and was
advised he did not. rlr. Kadlec asked the purpose of buying Plantreat
and said if other plants are constructed the Village might also have to
purchase them. Mayor Sylvester called for the. vote on the motion and it
taas unanimously passed.
The Village Council then proceeded to discuss the matter of
obtaining additional right-of-~,~ay from the property o~~rners on the north
side of Beacon Street between east of Elm Avenue and Seabrook Road. The
Village Council had received a petition containing 222 names at its
[Workshop Meeting requesting the Village to widen this section of Beacon
Street to conform to the width of the street at Elm Avenue and westward
and to construct a 20 foot paved road betE~~een Seabrook Road and Elm
Avenue. The petition pointed out that the present 10 foot wide paving
is a dangerous driving condition for automobiles and trucks and also
very dangerous for pedestrians that ~ti~alk along the street. The petition
also described the existing set backs from the right-of-way line for the
residences on the south side of the street and for those on the north
side of the street. Cunningham moved, seconded by Little and unanimously
passed that the Village proceed ~:~ith the necessary action to obtain a
strip of land twenty-five (25) feet in ~ti~ dth from each of the six (6)
property o~tiTners on the north side of Beacon Street to make a right-of-t,;ay
width of fifty (50) feet from Seabrook Road to conform to the right-of-
ti°ay ~~~.dth of Beacon Street t,~estward co~unencing at approximately Elm
Avenue, so that a proper road could be constructed; that the Village
• engineer be authorized to proceed with the necessary dra~ti*ings, plans,
property descriptions, surveys, etc. but that no funds be expended to
pay for the purchase of said land. The Councilmen expressed the hope

July 13, 1971 to consider annexation of the Ciuci property; that cost
of resurfacing roads in Tequesta Country Club Community had been
received and fo n~arded to the Council and the Country Club Community
Association; that work on installation of water main interconnection on
Seabrook Road should be starting shortly; that the Building Inspector
had been advised that there had been some complaints from residents in
Jupiter in the Pines that they did not have a separate septic tank for
their ~Tashing machine, as required by the Village. He advised that
there appeared to be some mix-up in vrho is to inspect what in this regard
bets,~een the Health Department and the Village. Mr. Russell stated he
was concerned that the Building Inspector had approved houses ~,fithout
such a separate tank for the washer. The Building Inspector is to be
advised to pursue this matter further.
Mr. Roy White appeared before the Council to request a
burning pern-it for about 3/4 acre of land ~:~ich he cleared. for his home
presently under construction. He said he had contacted the Fire
Department and they agreed to stand by during burning. Russell moved,
seconded by Cunningham and passed 4-l, Barr dissenting, that Mr. White
have permission to burn his lot if he has a standby agreement with the
Fire Department and the fire Department approves the burning.
Mr. A. L. Hutchison of the Beach Road Association suggested
• that the Village consider funds in the 1971/72 Budget to construct
sidewalks in the right-of-way of State Road 707. Such construction
would have to have the approval of the State Depa rtment of Transportation.
The Village Attorney advised it was his opinion that the
Village could not annex Federal, State or County roads except by the
State Legislature approving the redescription of Village boundaries.
Mr. Jack Servies complained about advertising literature
which had been strewn about by the Tequesta Paint ~ Wall Covering and
the Village Manager is to write them a letter advising that such method
of advertising is nat permitted.
Mr. DiVosta asked if there was possibly any question about
the ultimate zoning classification of a parcel of land on Jupiter Island
which he had discussed with the Council at the Workshop Meeting. He was
advised the land would be annexed as R-1 and would have to be given its
zoning classification after the Village Council held a Public Hearing
to determine said classification. Mrs. Thomas Daly suggested that the
present ten story condominium under construction was interfering with
the Jupiter Light. It was the general feeling that the light was above
the top of the building, but the Village Manager is to contact the United
States Coast Guard for their opinion in this regard.

The Council was advised that the Tequesta Country Club had
reduced its use of water by 1/3. Mr. Russell reported that the planning
is al~eost complete E,rith the final draft expected to be received by the
end of the month. Mayor Sylvester stated he personally believed complete
Village sewage facilities and draanage were at least t~,in years away.
