HomeMy WebLinkAboutMinutes_Special Meeting_11/17/1970MINUTES OF THE PUBLIC HEARING OF THE COUNCILMEN OF THE VILLAGE OF TEQUESTA, FLORIDA A Public Hearing was held by the Councilmen of the Village of Tequesta, Florida at 7:30 P.M., Tuesday, November 17, 1970 at the ©illage Ha11. Councilmen present were Messrs. Sylvester, Cunningham, Russell and Barr. Also present were Robert Harp, Village Manager and Clerk and William A. Load, Village Attorney. Mayor Sylvester advised that the Hearing had been called for the purpose of amending the Village Zoning Ordinance to provide for certain design criteria and other regulations for the construction of gasoline service stations. The Village Clerk advised that the Hearing had been advertised October 29, 1970 in the Beacon News and that no corres- pondence of any type had been received on the subject. It was made clear that this was not a Hearing to change the Zoning Ordinance as relates to the locations in the Village for gasoline service stations but to provide the design criteria for gasoline service stations as recommended by the Village Planner. • The Village Attorney reviewed the ten (IO) regulations for gasoline service stations as presented by the Village Planner. After reviewing the regulations Russell moved, seconded by Cunningham that Section 7 of Ordinance No. 43, the official Zoning Ordinance of the Village of Tequesta, Florida, be amended to include the subject gasoline service station regulations. The vote on the motion was: Cunningham - For the Motion Russell - For the Motion Barr - For the Motion Sylvester - For the Motion The Motion was passed and the Village Attorney is to prepare the amending ordinance for reading at the next Council meeting. A copy of the gasoline service station regulations is attached to and made a part of these minutes. The Councilmen then discussed other regulatory information which had been suggested by the Village Planner such as preventing the gasoline service stations from becoming a rental agency for cars or U-Haul type trucks, prevention of overnight storage of vehicles unless under repair and other factors. The Village Attorney stated he believed this would be difficult to control by selecting only one type of business that might want to be involved in such rental businesses and not makzag it applicable to other businesses. -2- • Various methods were discussed and the Councilmen decided to have the Village Manager obtain copies of such ordinances from the Village Planner so the Village Attorney could study and review their. Village Clerk • 4 .~ l . ~,.~' Gasoline Service Stations The following regulations shall apply to all Gasoline Service Stations: 1. There shall be a building setback from all right-of-way lines a distance of not less than forty (40) feet. :Z. Service stations main and accessory buildings shall not be constructed closer than fifty (50) feet to any resi- dential district. • 3. The minimum distance between the intersection of right- of-way lines at a corner lot and the driveway to a ser- vice station shall not be less than twenty (20) feet. 4.' A raised curb at least six (6) inches in height shall be constructed on all street property lines, except at drive- way openings. S. The length of curb openings shall not exceed forty-five (45) feet. 6. tiVhere two curb openings are giving access to a single street, they shall be separated by an island with a min- imum dimension of twenty-five (25) feet at the right-of- way line. Curb cuts for driveways shall not be located closer than ten (10) feet to any adjoining property line. 7. To insure that sufficient room be provided on either side of the pumps without intruding upon sidewalks or on ad- joining property, gasoline pumps shall not be located closer than fifty (50) feet from any residential district. 8. Gasoline pump islands shall not be located closer than „ fifteen (15) feet to any street right-of-way line; how- ever, where pump islands are constructed perpendicular to the pavement edge, the pump island shall be located not ,less than thirty (30) feet back of the right-of-way line. 9. Canopies shall not be constructed closer than fifteen (15) ,feet from street right-of-way. 10. I suggest you talk with your Town Attorney to determine a method of preventing the gasoline service station from b®- coming a rental agency for cars or U-Haul type trucks. This rental trend is developing and can really clutter up a service station. The ordinance might prevent overnight storage of vehicles unless under repair, etc. Bob and I both appreciate your efforts in, gathering material for the plan. 6
